Good interview, but why such a need to harp on the journalists all the time ? No one news source or journalist will ever sit right with everybody or anyone. Should "true" journalists - and we know who those are - not the ones that are so blatantly reading a script given to them from their boss on high - should strive to be fair, balanced and just reporting the facts. Will they always do that ? No... never happen.. it's going to slip and they'll report a left one time and a little right the next. I think we should stop complaining so much and take RESPONSIBILITY OF OURSELVES to determine or filter out what we need to from these news reports and interviews, because face it, whatever the reporter does or acts, we can learn a least something from what they are delivering.... We need to be smart enough, with attention spans long enough to get it.

Anyway, Breyer is right: if a Supreme Court reverses itself willy-nilly like this, going back to norms, jurisprudence opinions, etc. as they were 50 to 100 years ago, saying THAT was and is the way how jurisprudence works... then it makes itself a foolish looking institution in such a backward act by itself. Not to say any thing about FUTURE justices in the majority REVERSING that reversal, which would make the Court look even more stupid... as it is nothing more than a POLITICAL court whose decisions are underpinned by which political party has appointed more elderly men and women to the body. THAT IS NOT how law ought to work.

I once had the honour of meeting Justice Breyer in person at a dinner. We only spoke briefly, but he was every bit as understated and thoughtful as he is in this interview.

I admire Breyer for being wise enough to retire when he did. It was one of the best things he could do for the court and the justice system in this country at this time.

That’s the general consensus of those who are thankful to live in the U.S.
Actually... to highly mature and wise individuals, like Justice Bryer, it's probably _not_ all that heartbreaking. Because they're wise enough to understand that in a representative democracy, it's the devotions of _the people_ -- and not the devotions of the individual justices -- which matter above all else.
_The people_ are very well aware of which justices are, and are not, "up for replacement" when they vote every few years. And they know *exactly* what type of justices their chosen candidates will nominate and vote for. So a mature, non-petty, wise, and intelligent justice understands that they are placed in their position to serve *the people* , not to serve *themselves.*
They may _feel_ a certain way about an outcome, but as long as they're not a narcissist who doesn't care about the opinions of the populace they've been called to serve, they're mature enough to utilize introspection to assess _why_ they may have been on the losing end of a case, and move on, rather than being "heartbroken".
I don't intend to be insulting (truly, I really don't), but Justice Bryer's statement at 5:46 indicates why people like _him_ were nominated to be a Supreme Court Justice, and people like _you_ (or me) were not.
We are going to miss the time when we had reasonable court justices...

I wonder if he’ll talk about how anyone can be a Supreme Court judge or a Federal judge if you know the right people. And no one can ever vote you out, they are essentially a group of feudal lords.

The Founders didn't want future generations to be beholden to their views and wanted the law to be able to change with society. In order to adopt Originalism, you must claim to give ultimate deference to the Founders while simultaneously ignoring their wishes that you do not do so.
In reality, "Originalism" is just a cloak to hide judicial activism. Justices like Alito and Thomas tend to make their decisions based on their own political beliefs, cherry-pick whatever evidence they can to support it, and declare that "Originalism".
I have heard Justice Breyer speak before. He is really a gem, and it's really a shame that he must retire. But fully deserved!
And to give up his career earlier than he really wished to, just to make sure that we get another great Justice in his place. That just speaks volumes to the kind of man he is.
His replacement is a nutter.
Justice Stephen Breyer, amongst the very finest jurists, will greatly be missed.

Nice to see Wallace doing these types of interviews again and the former Justice was a gracious man. The problem I had with this interview was that the audio was horrible. I am 64, my hearing is very good considering my military time, my laptop is at 90% volume and the 32" TV I use as a monitor is at 50%, so the sound guys need to get on the ball. Was the audio edited, post edited, altered, to cause ambiguity? When Justice Bryer expressed what Alito thought...."and Alito thinks" you notice it. At "not for an instance" I thought it might have been a slur. "but here we are and now we go on...dada" Were these slurs due to age, illness or was it deliberate or both? Not sure......Thanks you for pointing this out.
