I am not really sure if any company can I write such a clause because it's hypothetical. Can I claim points without this particular clause?
You will need to have a letter from the company specifying you will be under their employment after you get PR. This is tricky, so just get your offer letter which mentions the numbers of days which has to be around 1.5 years from current date considering it takes 6 months to issue PR and by that time it shows one year of guaranteed employment. You can not obtain CRS points for a job offer if you are working on an open PGWP. Your name would need to be added to the LMIA if it is a Permanent LMIA before you can use it to claim CRS points.

No you can't. You need to have a LMIA based job offer.
