@@rhs1578 good point. I think I have the revise how I said that. You can use the 5th in any criminal case and that’s been affirmed by the Supreme Court, however it’s only in the case of your defense. If you’re asked a simple question of do you know a group of people that are in a video/ picture with you and they can establish by other means in addition to the video footage that you know them. The judge can hold you in contempt and sentence you to jail for the duration of the trial. But the most common way to get people to talk is to hold current and potential new charges over ur head. Let’s say he was on probation at the time and wasn’t supposed to drink, if they found evidence he’s been drinking they can threaten to revoke his parole or probation, UNLESS he cooperates.
