I agree but this doesn't change my opinion of her and her overall being a wonderful judge! She hands down harsh sentences when needed but also believes in giving people chances to get their shi$ together.
I do think she had bias in this case to the attorneys and client and did not give a fair and impartial ruling. This was confirmed with the hearing and judge recusing her. As a judge you take the highest oath on bias. She continued bias so I hope this opens her eyes because she really is an amazing judge.

    • @ReturnTheSanity
      @ReturnTheSanity Месяц назад +27

I like Judge Boyd, but she is in the wrong . I believe she is partially motivated by being transparent, but I believe her bigger motivation is elevating her status for political purposes. She has let her personal feelings about this case skew her judgement to the point she began making rulings she knew were at a minimum controversial and out of character with the purpose of harming the defendants in this case. disagree if you like, but it’s pretty compelling when you have former prosecutors that worked for her and the current prosecutor on the case and question, expressing their concerns her judgment in this case.

@@Jabberjaw99 Judges often mute the camera for sidebar conversations. This happens in the courtroom, too: Judges effectively "mute" themselves by calling the attorneys up to the bench, turning on a pink noise generator, and talking to them out of earshot of the jury, the gallery, the court reporter, etc. It's for off-the-record (but not ex parte) communication about the case. Next step up from there is a chambers conference, which is the exact same thing but in the judge's chambers rather than in open court.

Judge Boyd should be able to swear and affirm that she never monitored live chat during a hearing -that would be an intolerable situation for people going before her in court on either side. I'm unsure whether that is what is being alleged here.
As to the underlying shooting, in order to have a lawful lethal force situation the suspect would need to have Ability, Opportunity and Officers would need to be in Jeopardy before lethal force would be justified. From the body worn camera's I can't see that the woman had the Ability to harm the officers while she was inside the residence and the Officers were on the back porch -from the BWC's I don't see that there was a third party in Jeopardy inside the residence either.
This is one of the quite rare situations where it seems that containment and a callout for mental health crisis workers would have been appropriate.

The streaming isn't the real issue: that's one attorney's crusade. But from watching this, it is pretty clear that Judge Boyd's often "my way or the highway" attitude (which is often refreshing) has run contrary to the law. Her refusal to allow more time for accurate discovery and a very legitimate FMLA leave is actual evidence of violating the rules of procedure. And while I don't think this is necessarily based in bias against one side or the other, it is not impartial and shows a tone deaf refusal to consider the best interest of the accused. When both the prosecution and the defense are saying they cannot issue a fair trial without more time, and there haven't been unnecessary delays, the judge can't just ignore that for the sake of "I don't do that in my courtroom."

Yet, she has no issue using the word “gay” as a reference to homosexuals, as “gay” in that context has only been around since the 1960s! Gay use to mean happy!
I’d love to a linguist call her out!

Unfortunately, I most likely disagree with most of you. I would not want anyone on a jury trial who have this much access to watching a judge’s performance on RUclips. The bias possible is supported by all the comments against this hearing. I would absolutely want these attorneys for my defense. Whether guilty or not, all deserve a fair trial. Most compelling testimony is from former prosecutor, Nesbit working in Judge Boyd, courtroom.
Disagree his testimony was speculative. He could be considered an expert witness.
These attorneys are protecting their professional licenses. There is very much at stake and this may become case law up before the Supreme Court.
If the prosecution and defense agree on too short length of time for discovery etc..then this is compelling that there have been reversible errors made.

I love Judge Boyd but I have often wondered if the posturing with setting a scene so to speak , would not backfire some day. The whole flower /purse thing is lovely, but I find the purse thing wholly strange and pretentious. Who would put a pocketbook in a prominent place in a courtroom where it has no use, no contribution, no relevance to what is being said/done. And, arguably could present a constructive nuisance and/ or distraction. My discipline has been criminal law for almost 15 years and I have never taken my own purse into a court room, and in fact, endeavor to take as few things with me as possible, especially expensive things, wallets, money, electronic devices, etc. if I needed ‘personal’ things with me that would customarily be kept in a purse, I kept them on my person, in a pocket, etc. if I wanted flowers or decoration, I kept them in my office where I was free to enjoy the item in question. This is not a dinner table or even her office. The flowers and a pocketbook, albeit beautiful, do seem incongruous with the purpose, nature and sanctimony of a courtroom. And careful placement of both, in the angle of the camera, are self serving and pretentious and add nothing to the expected decorum and focus of the court.

I thought it was fast as when argued their motion so many valid points were made including the fact that it had been leas than a month that the prosecutor on the case had even been assigned and also the fact that the case was only a few months old as I believe its a 2024 case. I further remember it standing out again that she seemed to have a problem with this lawyer. I thought that due to her not just denying his continuance motion for family leave with a wife due to delivery shortly, but specifically her comment and suggestion that basically if he didnt like that ruling that his CLIENT could always sever his case from the other two! Part of what made that so blatantly wrong was thinking that she's been a defense attorney herself and such a suggestion to change a clients entire trial strategy due to his family leave time like a ludicrous suggestion and I was like what's going on here?!? Those defendants have rights and she is violating them in very indirect ways via the attorneys. And, to walk in the courtroom without warning during testimony on her recusal hearing is showing blatant disrespect and outright egregious behavior to not only those attorneys but as well as the judge who will undoubtedly view that negatively. The nerve of her to feel she could do that is evidence that those lawyers may actually have a point. Also, to have a former AND current prosecutor testify is very validating to the bias accusations. Ok I don’t think people know what’s goin on with the judge. She rushed to set the trial date. BOTH the defense AND prosecution asked for more time because they needed to gather more evidence. She said no. The reason? One of the lawyers on the defense team filed a motion about a year back that said her live streaming RUclips showing his clients face, who was not found guilty AND had no record, is against the law. So what did the judge do?? Make his life hell. So yes she should be recused.

Courts are public, and all should be on camera at all times as a matter of the constitution. Nevada has it right: the default is that the media is involved whenever they want to be, and it must be extraordinary to deny them.
RUclips is just another way we can hold our public officials accountable and to be frank I think they are over blowing a lot of her conduct as well as misconstruing things in the light most negative, but she definitely is someone I find unreasonable on a regular basis. I know that is blasphemy to law tube, but her and Judge Bryant have always left bad taste in my mouth. Their behavior has always bothered me. Bryant way more than Boyd, though.
Courts need to be on RUclips, but judges need to treat it like what it is: just another face in the crowd. That said, those people dont get to use our right to an open court and the commentary of the public as a way to escape scrutiny.
