One of my favourite Korean games was inspired by LoL (I assume) and wanted to (also assumingly) ride the bandwagon, and actually did a similar thing. Sooner or later RUclips’s system will get around to analyzing it. And the detection technology is only improving.
BUT ISN’T A REACTION CONSIDERED FAIR USE? WHY DO YOU HAVE TO EDIT?
Fair use is a US law designed to protect the rights of people who want to use the work of others for critique, education, news reporting and even such things as reactions. If you watch a news show, or even read a movie review where they take clips of a song or film, that’s an example of what we mean.
While reactions like ours typically can fall under fair use, the reality is that if a company wanted to block our video to protect their copyrighted material they still can. And if we want to fight to get it unblocked, we can. But that’s a long and arduous process that just isn’t worth our time. So the safer thing to do is to make sure we add edits and commentary so that most companies don’t consider us simply copying their work.
A FINAL NOTE
There isn't no right way to avoid copyright issues because there are no clear laws, rules or policy about this that govern what should be done on a worldwide scope. Even RUclips admits these laws were never designed to handle the scale of new content creation that we are experiencing today. So yes, all this makes it frustrating to deal with. The laws are different per country, and the actions taken can be different per company. In addition, RUclips is secretive about their method for detection so different reactors try different things and some of the methods are quite frankly unproven.
Just know that we try to edit videos to give you the best experience we think is possible while balancing what we think is the right thing to do to stay within the laws. Ultimately our reactions are still genuine, because that’s what we want to share!
