This is incorrect: assault at common law is either fighting words or is a verbal threat to committ a battery, coupled with the apparent abillity to carry out a battery. Battery at common law is the inpermissible or reasonably offensive touching, of any nature, of the person of another. However this is also an area where the statutory law of each state has many varriations. Attempt is never an element of any crime- attempt is rather an incohate crime (the other two incohate crimes are accesory, and conspiracy) which is punished in the manner of principal. Conspiracy is an agreement to commit a felony coupled with an overt act in furtherance of the felony conspired to, and accessory is any act which is intended to assist the comission of a felony or to conceal from a law enforcement officer the identity or location of a person wanted in connection therewith.
