- Jurors in former President Donald Trump's New York "hush money" trial have asked for readbacks of the judge's instructions and portions of Michael Cohen and David Pecker's testimonies. Criminal defense attorney Caroline Polisi joined CBS News to discuss some of the wrinkles in the case that may have led to those requests.

The jury instructions violate the 6th Amendment and the Richardson v United States Decision (1999).

Regardless of how anyone feels about the man on trial, this can be a major problem going forward if the convictions are upheld.
Basically, the prosecutors weren’t required to provide proof beyond a reasonable doubt that the payments were motivated by a “further crime”, such as influencing the election. They don’t even have to agree on what the motivation was; only that they’re positive that motivation must be illegal in some way.
What that means is they’ve removed the burden of proof. The jury could convict him if they just didn’t like him, and felt he deserved to be punished whether the evidence supported the prosecutor’s claims or not.
If this sets legal a precedent, it could potentially be used against others in the future. Imagine a judge instructing a jury they they could find a defendant guilty even with ample room for reasonable doubt. “You don’t need proof; if your gut says they’re guilty, run with it.”
That’s an enormous deviation from the standard rights every defendant has, regardless of how much the jury (or anyone else) dislikes them.
thanks - I've wanted to know where this was. I sincerely hope (but doubt is will happen) that this Judge loses his bench and attorney loses ability to practice law
They also violate common sense. No matter your feelings on Trump you should be outraged that any single person could be deliberately railroaded that way regardless of how detested they may or may not be
So.... the prosecution presents three "theories" for what the "underlying crime" could be, they couldnt prove any of the three beyond a reasonable doubt. And The judges instructions to the jury are "take the evidence, and figure out which of the three theories it is for us, but you don't have to agree on which one to find him guilty?

Sounds like the judge grouped all the charges together and just left the jury to figure out how to even figure things out. Each charge should have been separate.

With it, they dig into many codes to fabricate as many criminal counts as possible, not from legal facts but again from weak legal theories. They pile up criminal charges knowing that no jury is likely to dismiss all counts. Thus on the basis of nothing they in advance try to secure a conviction: Today, even the Chinese legal system is fairer than ours.

Ok, so I hate to break this videos bubble, but in New York state law the jurors were given instructions on 3 separate charges that had multiple accounts. If they thought he wasn't guilty on either one of the illegal checks, invoices, or ledgers he filed, he wouldn't have gotten a felony charge for the coinciding charge. That's why he said they all didn't have to be unanimous.
Really a bad check filed is a misdemeanor but if your check and invoice, and ledger are all wrong it bumps up to a felony.

A copy of jury instructions would confuse and distract laymen of the law. Jurors can figure out truths, and closer to the end get technical.

I’m not clear on what crime he has committed? It is not unlawful to compensate an injured party to stay out of their affairs for the foreseeable future. We’ve all sign Disclosure Agreements, I have that is, and yes, I was awarded a very nice fee and accepted it. It really was a left handed severance payment, but I did sign because it would give my Employer peace of mind.
