I'm pretty sure the DA still has to report the allegation - AND that they investigated and described it as "unfounded". They don't get to provide the defense ONLY the evidence that supports their case.

The only thing worse for a defendant than the prosecution and judge colluding against them is if their own cousel is colluding with one or both of them against his/her client.
