If Costello wasn't commiting crimes with Cohen then privilege may still apply if Cohen thought that Costello was his lawyer or was giving him legal advice. If it exists, this is Cohen's privilege to waive so Costello can't testify about conversations with Cohen without Cohen's consent unless he is prepared to be disbarred. Also the judge wouldn't allow the testimony in in the first place.

Lol the entire case relies on, he said she said. Stormy went on television in 2018 to denounce being a victim and even stated the Left tried to persuade her to act as one. Cohen is a convicted perjurer, and Stormy has changed her testimony now suddenly when Trump is running for reelection, which means they were able to back her into a corner to cooperate.
All you need is two conflicting testimonies and the judge is obligated to dismiss the case, by law, especially when there's zero evidence to back the prosecution. The audio file only indicates Cohen.

Won't testify, needs to protect himself from perjury charges; the accused cannot be forced to testify against himself, either (5th Amendment). He's told so many lies and differing versions of what he did and didn't do, how can he keep his lies in order? How can he remember what he said to whom and when? Even a sane person would have a difficult time with that!
Trump can sit back and watch the entire case implode. The judge must dismiss all charges with extreme prejudice or further damage judicial integrity.
