My ex-husband opened a cell phone account in my name in California, while I lived and worked in Missouri. I had to jump thru flaming hoops to get them to drop their attempt to collect. It was infuriating to have to prove that it wasn't me, when they didn't do their due diligence in opening the account. It happens.

I understand that the system has to take precautions, and sometime it sucks, but there is absolutely no reason we should be accepting the idea that innocent people just have to sit in jail for 15 days before being dragged off to another state and they get no recompense and nobody has to pay for that.
Somebody has to pay, like a thousand dollars a day minimum.
If it's a cop that screwed up, the cop pays.
If it's a DA, the DA pays.
      A judge, the judge pays.
A criminal, the criminal pays, and hell yes if they have no assets make em work it off in prison!

Another case where he is unwilling to look at exculpatory video.
I watched another case before this judge where a man was accursed of something that could be disproved by viewing video, but the judge declined to view the video, that man had a very good lawyer who continued; to insist that the judge look at the video that the prosecutor had on a laptop in court at that time. When he finally looked at the video, he found no probable cause because the video clearly showed the charges were false.
Here he declines to look at video that another judge said existed and kept a woman falsely incarcerated. If video is available that shows she is not the person sought and that could free her, he is a part of the problem if he won't view it.

    • @ryansta
      @ryansta День назад +3

12:39 He fully explains the situation and how to resolve her issue of having an outstanding bond. He also states he has no access to any video should it exist that would be a matter for later down the line. So I find your comment in this instance on the unfair side. He even offers to look at the situation again should she present further proof when many would just stamp the form and say next.

It's a bond hearing rather than a trial. This is a Texas court which I'm not very familiar with. generally multiple defendants can be tried at the same time for the exact same crime. It would also make sense if they had the same attorney.
The defendants and attorney could move to sever the trials for a bunch of reasons, but again this was a bond hearing, there was no jury, and if they were going to be tried on the same day it would help with scheduling.

My experience is the Irish criminal courts (only as an intern) but the only difference here was where they were standing, and if you noticed they were cuffed together. England and Wales IIRC allows defendents to appear cuffed, we don't so different strokes for different folks.

Where I live (California), if people commit the same crime together, they are tried together, unless the judge allows them to sever the joint case. But they are always (at a minimum) arraigned together. I don't know about Texas, though. That's the annoying-- I mean "beautiful" part of each state being allowed to write their own laws, we often don't know which state does what.

Observing this judge’s actions leaves me convinced that he is a rare asset to the judiciary and must be safeguarded at all costs. Were someone of his caliber serving on the Supreme Court, Trump would undoubtedly be incarcerated, and Kamala Harris might very well occupy the presidency. The integrity and fairness exemplified by judges like him are indispensable to the restoration of public trust in our judicial system.

16:40 what a nutter. For it to be identity fraud on a DEBIT card for minimal 60K she'd have had to have 60K in her own account for someone to steal it. Plus she'd have to have incredible credit scores and substantial assets of her own person for someone to benefit from stealing her identity by opening huge lines of credit. Didn't happen.

First, my brother in christ. Two lawyers and a judge heard her defense and if the charges were really for Debit and not Credit they would have called her ass out on camera. Certainly her own lawyer wouldn't have used that as a defense if that were true. Second you only need a 670 to get 60k in credit not real that hard to accomplish. I'm up to my ears in medical and student loan debt and I still got a 750. You don't know any more if she is telling the truth than the lawyers and judge listening to her. Just gotta wait for the evidence.

    • @OmateYayami

That's what op is saying, however with forgeries and impersonation suddenly it's probable enough, then the burden shifts to the actual victim. Simply denying the fact and asking to prove it was actually you doing things is not enough, and that's ridiculous.
Banks and courts love to assume they did due diligence and force victim prove it wasn't them rather then taking a burden to prove correct identity of the offender.
I mean they have some proof, e.g. they checked i.d. document but asking whether it was forged or not, suddenly becomes unreasonable.
