@@despraterado588, it's not exactly that new, at least not to me. I believe that the first I heard of it was around the mid 1980s. The real problem is that getting insurance companies to pay for it. They'll say people can join a gym that has a pool and use that for therapy. So it's been slow catching on, at least here in the U.S.

What Brenda, the (now former) HOA president did in the title story was flat out illegal. Refusing to allow a homeowner to make any type of accommodations for a disabled resident is a clear violation of ADA laws, and Brenda could easily have been hauled into court and sued for her refusal to allow OP & her husband to make changes to their pool to allow OP easier access to it.
Upgrading an existing pool is not in any way the HOA's business. This is NOT their purvue. Toss in an ADA lawsuit, you've got that HOA biddy by the short&curlies. Make the lawsuit as painful as possible for her. And her screaming about OP in a bimini in her OWN yard!? Call the cops and charge her with tresspass. 😮

When confrontend about the money, tried to counter-bill me for her parents helping me move house. Without her parents' knowledge of course. Even when we were together she was nutty as, claiming she could see ghosts, having a bunch of stories of things that never happened, twisting stuff people said around to mean the opposite and then getting raging mad about it, and my favorite, not understanding that a small discount on an expensive luxury item isn't "saving money". (She'd spent a lot of my money that way.) I'd go so far and say she was the abusive one, on more than one occasion she threathened suicide if I didn't drop everything (study, work, etc..) and come over to stay with her. Insane. I'm not one to go for the "my ex was crazy" stories, people with more than one such ex are often the problem themselves, but this one definitely fucking was.
I suspect that she was basically booted from the H.O.A. with some type of a legal order such as a restraining order, which effectively forced her into moving out. It's also very surprising they didn't go after her for what she did. But maybe they didn't deem it worth the hassle.

Story 1 , the OP should have contacted the ADA ( Americans with disability Act) to tell the HOA that the stairs were medical devices and COULD NOT be told to get rid of them or otherwise not allow the OP to use them. I have had to learn ALOT about this disability bonus when my husband lost his leg and became wheelchair bound. We were able to make our property Owners to install a ramp so i would not get hurt trying to get my 500 lb hubby and his chair into the house that had a 2 inch step up threshold. I was literally breaking my back to power lift him and his chair just so he could leave or go back in the house. It took management 2 times to get the ramp on the correct home. the first time the ramp was put on a home 4 homes down. ( we live in a townhouse complex, and he and i live in the living room/dining room as he can not get upstairs and the complex refuses to allow us a stair lift for him, as a result its been almost 5 years since he has had an actual shower) I give him a bed bath every week.

I'm not sure what the Canadian version is called but both Canada and the USA (theirs is the ADA) have Federal Laws that say no HOA/Strata/Condo Association etc. can deny you permission to make any alterations to your Home/Property that are required to accommodate a Disability. So if you need wider doors, hand rails/grab bars, a ramp or a lift of some form, you can go right ahead and have them installed without asking the HOA for Permission...It's common courtesy to let them know you're having Disability Accommodations installed on [date], but you don't need Permission and they can't Legally tell you not to add them or take them out once in... Nor can they deny you Permission to place a communications dish (for Satellite TV/Internet etc.) in the place best suited for maximum Signal Strength...

We had an above-ground pool in our back yard. Whoever put it in had dug a two-foot deep hole to put it in, then built a wooden deck that came to to actually top of the pool. So it functioned like an in-ground pool, but we had to keep painting the wooden deck every couple years. No big deal. There was a giant pine tree in the center of the yard, and about half of what was left was set aside for my grandmother’s plant-growing hobby. She lived with us because she only had limited mobility, but still did her gardening. She said that it hurt to get down onto her hands and knees, or to stand up, but once down, she could crawl around and do what needed doing just fine. I’m not sure I believe that, but if she chooses to endure a little pain to chase her joy, who am I to argue? I have tattoos, so what’s really the difference? After we’d lived there a few years, grandma started seeing signs of some kind of tunneling animal, doing damage to her plants. She tried some mild things to get rid of it… that was mid-1980s, so I can’t really tell you what, but things had not reached the level of killing it at any cost. Then one morning, the pool was empty. And there was a network of dead grass and other plants in the yard. Apparently, it had burrowed under the pool, then tried to come up. Once it had punctured the plastic bottom of the pool, thousands of gallons of chlorinated water rushed in. However many critters there were… none survived. And the water filled the whole tunnel network, where the chlorine killed any grass above it. I want to say the most expensive part was the thousands (or however much water is in a pool) of gallons we had to fill the pool with, once we’d sealed the hole at the bottom.
First story: Brenda brought this upon herself acting all entitled along with trespassing making a false nine one one call volition of the A.D.A denying permission to modify the pool and the recording of her antics in social media was the icing on the cake.
I got a phone bill from my AT&T for my cell phone long ago, for ZERO DOLLARS and ZERO cents. Every time I called to tell them to stop sending me that silly ZERO $ bill, they told me I had to pay my bill. So I wrote them a silly check for that ZERO & zero cents. I told my bank what was going to happen, they just started laughing. I mailed them that stupid zero $ check. Lol I still laugh about it.

The moment H.O.A. Brenda said it was only a cosmetic change should have been enough to bring in an attorney. Smart to make use of the phone to record what was happening, especially considering she'd been asked to leave, and then proceeded to ignore the request to leave, and calling the police in on the matter. That was evidence enough legally to charge her with trespass, and invasion of privacy. Plus the video was also evidence that she had bot been hit. Which means her allegations were false and also could have her charged with bearing false witness. The board in the end had no choice but to get rid of Brenda or face potential serious issues. Which with the outcry from within both the H.O.A. left them little in the way of options to pick from. The fact that she left the community was likely due to being banned through legal means that placed a restraining order against her by other members of the community. Which while normally I'm not in favor of such a strong restraining order, this is a case off being warranted if such action was taken. Which would be in regards to thee overall safety of everyone within the community, and any nearby neighbors not part of the H.O.A.

1st story; if you live in the US the ADA allows you to make any necessary changes to your living environment to improve your quality of life. HOAs might complain but if it ends up in court they loose automatically.
Law student here: Not always. ADA has a reasonability clause that prevents the law from being abused. As an example, you can’t expect the HOA to allow you to build a full on elevator on the side of your house. That’s why in many cases you can install a motorized seat that can take you up and down stairs. Before you get on my case, I’m autistic. I’ve fought many a battle with people who think they’re above the law. But I’ve also seen the reverse, where people take advantage of the law making things worse for us.
NexTel story. I had a similar situation with our local hospital but it was for five cents. After several months of bills I was visiting a friend post op in the hospital and went to the business office and gave them five pennies.
second story : should have been offered in 4 monthly payments of 1 cent each, explaining that having a negative overdue balance is detrimental to MY credit and paying it in small increments helps raise my credit , so please help me make my credit better by accepting the 4 payments of 1 cent each for the next 4 months.

When I moved from the US to Europe, I had to inform Apple, because I got a new bank that used Euros. It was kind of a hassle to find how to do that, and it very briefly cut service for me. But then one of the subscriptions I had tied to that Apple ID billed me in dollars. I couldn’t pay it from my European bank, because it was in dollars. I couldn’t pay it from a US bank, because I’d closed them all. Called Apple support, and they just waived the $8.50 or whatever stupid charge.
2nd story: I did something similar when some credit card telemarketer tried to make me get a card Back then there was this rule of "you had to have a job to have a credit card".. after about 20 minutes of talking, and I was agreeing to have my credit card, finally in the part of "your job" I answered I was at the university and had no job "As far as I know you need to have a job to get a card, right?".. maaaan I could feel the telemaketer's voice tone for losing a lot of time with someone who would not have a card :D
The last story, it sounds like the neighbors both had some type of emotional/mental issues, and most likely undiagnosed. Which they'd also very likely deny having anything wrong with them. I'm familiar with mulch ad mower blades along with how it can come out from underneath the back of the mower if it's a push mower. You definitely want to wear a pair or decent pants to cover the legs, or the shins.

Before he retired my brother got some company shares as some sort of bonus at work. He had it set up to reinvest dividends with his broker and promptly forgot about it. When he retired he decided to sell these company shares but he could only sell whole shares so that 0.07 of a share he was unable to sell. For the 15 years after his retirement he would get a dividend cheque for $0.01, one whole shiny penny, every quarter. After about 15 years he now gets a cheque for $0.02 every quarter. After taking into account staff costs, operating costs, and postage, we figure it costs "them" about $20 every time they send him a $0.02 cheque.
I liked this story. In the 60s, a 2 piece bathing suit was as risky as a person got. Mom and I went to Hawaii in 65. I bought a bikini. Mom said if she looked as good as me, she would buy one too. Fast forward a couple of years, I went to a state park on a date. We put our towles down. The lady next to us talked about how disgusting I was. Picked up their towels and left with her kids. On a vacation a kid asked permission to take a picture of me. Some years latter, mid 70's in my house building inspectors came to complain about paint chips along the side of my house. I was prepping for painting. Anyhow I said that I was cleaning my freezer. One said you look like you are cleaning. I didn't know a bikini was not the uniform for cleaning inside my own house. I was 5''7", maybe 110# very flat chested 32AA. I had taken lifesaving, water safety instructor, certified scuba diver. I'm 81 lost 3 & 1/2" Do to ostriphosis, a bit of a hunch back. now 5'4" 145# and enough sense to no longer wear a bikini. But I do swim 30 minutes most every day.
The Nextel one was great. I canceled my Verizon account. Paid the final bill. A month later I got a refund debit card with $5.50. I used it finally somewhere that left about .25 left. I shredded the card. A couple months later I got a bill for .28. I refuse to pay it. This is a ridiculous practice. I'm just going to let them continue to send this. I don't care if they file someone my credit. It's costing them so much money to deal with this. These companies get away with whatever they want, I'm tiredof it.
We've been receiving statements from a credit card we closed over 10 years ago reminding us that they owe us $0.50. Every month like clockwork. It must cost them close to that just to send the monthly statements.

I live next to a family with a bin-thief dad, a woman who can interpret knocking load into a threat against her life and a peeping tom daughter who shouts at her sister or friend at night in her yard, so loud that I can hear it crystal clear over my TV. Often about the "crazy guy" next door. Apparently I've done everything from recording her to threatening her (never spoken to her ever) to try to poison her dog. Just the other week she was describing in great detail how dirty my bathroom was, how the yard door broke because I farted near it and how I ate an entire pig every night (I am on the big side) Some people just like to make up stories.
in terms of what op wanted to add to pool, I dont think hoa would have any leg to stand on to refuse. seeing how its to accommodate someone with a disability. rejecting it wouldve been ada violations. hoas cant refuse to allow ramps to be built. so adding to a pool for a wheelchair bound person would be the same
Nta. The changes weren't cosmetic. They are absolutely necessary for safety. Sue branda and the hoa for discrimination of a disabled person. They have been collecting dues. They can do their job and step aside. I bet alot of those homes need updated

ADA is only in the USA. And some people are just unaware of what it is and what it entails. They park in ADA parking spots, block ramps, tell people in wheelchairs that they have to sit in a “normal” seat, etc. The ignorance is astounding. 😢
2:00 If an HoA doesn't get back to you, when you have actively been trying to get into contact with them, you are legally allowed to continue with the project without their permission, or ANY input from the HoA after construction starts.
From what I've seen,that can vary. With some H.O.A. policies not hearing back is considered as a form of denial. In others it can be considered as accepted.That's where you would need to read how things are written. If there is nothing one way or the other, then although costly always consult an attorney before proceeding.

I'm not sure what the Canadian version is called but both Canada and the USA (theirs is the ADA) have Federal Laws that say no HOA/Strata/Condo Association etc. can deny you permission to make any alterations to your Home/Property that are required to accommodate a Disability. So if you need wider doors, hand rails/grab bars, a ramp or a lift of some form, you can go right ahead and have them installed without asking the HOA for Permission...It's common courtesy to let them know you're having Disability Accommodations installed on [date], but you don't need Permission and they can't Legally tell you not to add them or take them out once in...
Nor can they deny you Permission to place a communications dish (for Satellite TV/Internet etc.) in the place best suited for maximum Signal Strength...

We had an above-ground pool in our back yard. Whoever put it in had dug a two-foot deep hole to put it in, then built a wooden deck that came to to actually top of the pool. So it functioned like an in-ground pool, but we had to keep painting the wooden deck every couple years. No big deal. There was a giant pine tree in the center of the yard, and about half of what was left was set aside for my grandmother’s plant-growing hobby. She lived with us because she only had limited mobility, but still did her gardening. She said that it hurt to get down onto her hands and knees, or to stand up, but once down, she could crawl around and do what needed doing just fine. I’m not sure I believe that, but if she chooses to endure a little pain to chase her joy, who am I to argue? I have tattoos, so what’s really the difference?
After we’d lived there a few years, grandma started seeing signs of some kind of tunneling animal, doing damage to her plants. She tried some mild things to get rid of it… that was mid-1980s, so I can’t really tell you what, but things had not reached the level of killing it at any cost.
Then one morning, the pool was empty. And there was a network of dead grass and other plants in the yard. Apparently, it had burrowed under the pool, then tried to come up. Once it had punctured the plastic bottom of the pool, thousands of gallons of chlorinated water rushed in. However many critters there were… none survived. And the water filled the whole tunnel network, where the chlorine killed any grass above it.
I want to say the most expensive part was the thousands (or however much water is in a pool) of gallons we had to fill the pool with, once we’d sealed the hole at the bottom.
First story: Brenda brought this upon herself acting all entitled along with trespassing making a false nine one one call volition of the A.D.A denying permission to modify the pool and the recording of her antics in social media was the icing on the cake.
Busy Body Neighbors should have absolutely no say what you do with your own damn property. Fuck HOAs.
I got a phone bill from my AT&T for my cell phone long ago, for ZERO DOLLARS and ZERO cents. Every time I called to tell them to stop sending me that silly ZERO $ bill, they told me I had to pay my bill. So I wrote them a silly check for that ZERO & zero cents. I told my bank what was going to happen, they just started laughing. I mailed them that stupid zero $ check. Lol I still laugh about it.

I mean, the thing with those low payments is that usually no person actually sees them, they are just automated and unless you call they don't go away.
The moment H.O.A. Brenda said it was only a cosmetic change should have been enough to bring in an attorney. Smart to make use of the phone to record what was happening, especially considering she'd been asked to leave, and then proceeded to ignore the request to leave, and calling the police in on the matter. That was evidence enough legally to charge her with trespass, and invasion of privacy.
Plus the video was also evidence that she had bot been hit. Which means her allegations were false and also could have her charged with bearing false witness. The board in the end had no choice but to get rid of Brenda or face potential serious issues. Which with the outcry from within both the H.O.A. left them little in the way of options to pick from.
The fact that she left the community was likely due to being banned through legal means that placed a restraining order against her by other members of the community. Which while normally I'm not in favor of such a strong restraining order, this is a case off being warranted if such action was taken. Which would be in regards to thee overall safety of everyone within the community, and any nearby neighbors not part of the H.O.A.
These stories always get me. Why would anyone be stupid enough to join an HOA... It boggles my mind.

Not always. ADA has a reasonability clause that prevents the law from being abused. As an example, you can’t expect the HOA to allow you to build a full on elevator on the side of your house. That’s why in many cases you can install a motorized seat that can take you up and down stairs. Before you get on my case, I’m autistic. I’ve fought many a battle with people who think they’re above the law. But I’ve also seen the reverse, where people take advantage of the law making things worse for us.

Everywhere else, it basically takes dissolving the HOA to get out of it and that usually takes a 2/3rds majority Vote of ALL the Homeowners in the HOA, not just the HOA Board...

When I moved from the US to Europe, I had to inform Apple, because I got a new bank that used Euros. It was kind of a hassle to find how to do that, and it very briefly cut service for me. But then one of the subscriptions I had tied to that Apple ID billed me in dollars. I couldn’t pay it from my European bank, because it was in dollars. I couldn’t pay it from a US bank, because I’d closed them all. Called Apple support, and they just waived the $8.50 or whatever stupid charge.
2nd story: I did something similar when some credit card telemarketer tried to make me get a card
Back then there was this rule of "you had to have a job to have a credit card".. after about 20 minutes of talking, and I was agreeing to have my credit card, finally in the part of "your job" I answered I was at the university and had no job "As far as I know you need to have a job to get a card, right?".. maaaan I could feel the telemaketer's voice tone for losing a lot of time with someone who would not have a card

The last story, it sounds like the neighbors both had some type of emotional/mental issues, and most likely undiagnosed. Which they'd also very likely deny having anything wrong with them. I'm familiar with mulch ad mower blades along with how it can come out from underneath the back of the mower if it's a push mower. You definitely want to wear a pair or decent pants to cover the legs, or the shins.

Before he retired my brother got some company shares as some sort of bonus at work. He had it set up to reinvest dividends with his broker and promptly forgot about it. When he retired he decided to sell these company shares but he could only sell whole shares so that 0.07 of a share he was unable to sell. For the 15 years after his retirement he would get a dividend cheque for $0.01, one whole shiny penny, every quarter. After about 15 years he now gets a cheque for $0.02 every quarter. After taking into account staff costs, operating costs, and postage, we figure it costs "them" about $20 every time they send him a $0.02 cheque.
I liked this story. In the 60s, a 2 piece bathing suit was as risky as a person got. Mom and I went to Hawaii in 65. I bought a bikini. Mom said if she looked as good as me, she would buy one too. Fast forward a couple of years, I went to a state park on a date. We put our towles down. The lady next to us talked about how disgusting I was. Picked up their towels and left with her kids. On a vacation a kid asked permission to take a picture of me. Some years latter, mid 70's in my house building inspectors came to complain about paint chips along the side of my house. I was prepping for painting. Anyhow I said that I was cleaning my freezer. One said you look like you are cleaning. I didn't know a bikini was not the uniform for cleaning inside my own house. I was 5''7", maybe 110# very flat chested 32AA. I had taken lifesaving, water safety instructor, certified scuba diver. I'm 81 lost 3 & 1/2" Do to ostriphosis, a bit of a hunch back. now 5'4" 145# and enough sense to no longer wear a bikini. But I do swim 30 minutes most every day.
You can ask your neighbor to keep their dogs in but they dont have to since it is the middle of the afternoon.
The Nextel one was great. I canceled my Verizon account. Paid the final bill. A month later I got a refund debit card with $5.50. I used it finally somewhere that left about .25 left. I shredded the card. A couple months later I got a bill for .28. I refuse to pay it. This is a ridiculous practice. I'm just going to let them continue to send this. I don't care if they file someone my credit. It's costing them so much money to deal with this.

I live next to a family with a bin-thief dad, a woman who can interpret knocking load into a threat against her life and a peeping tom daughter who shouts at her sister or friend at night in her yard, so loud that I can hear it crystal clear over my TV. Often about the "crazy guy" next door. Apparently I've done everything from recording her to threatening her (never spoken to her ever) to try to poison her dog. Just the other week she was describing in great detail how dirty my bathroom was, how the yard door broke because I farted near it and how I ate an entire pig every night (I am on the big side)

ADA is only in the USA. And some people are just unaware of what it is and what it entails. They park in ADA parking spots, block ramps, tell people in wheelchairs that they have to sit in a “normal” seat, etc. The ignorance is astounding. 😢

2:00 If an HoA doesn't get back to you, when you have actively been trying to get into contact with them, you are legally allowed to continue with the project without their permission, or ANY input from the HoA after construction starts.
From what I've seen,that can vary. With some H.O.A. policies not hearing back is considered as a form of denial. In others it can be considered as accepted.That's where you would need to read how things are written. If there is nothing one way or the other, then although costly always consult an attorney before proceeding.
