  • A 67-year-old Virginia man sued Raytheon on Tuesday for age discrimination, claiming that the aerospace giant illegally favors recent college graduates over older workers in its hiring process.
    The AARP Foundation, the charitable wing of the national advocacy group for older adults, filed the case in U.S. District Court on behalf of Mark Goldstein. The suit alleges that Goldstein applied to many positions at Raytheon since 2019, but was never offered an interview - “based on his age.” The AARP Foundation is seeking to make the lawsuit a class action on behalf of other possible plaintiffs.

      Exactly the older generation cannot keep up with the changing technology. They don't want to go back to school. They actually can't afford it either and that's with well-paying jobs

      That’s a ploy to scare people away from applying. Cause obviously they understand a college graduates don’t have that level of experience. Then those who aren’t afraid to apply without that level experience they pick their best option.

      But I did have that now I have 13+ experience and finishing my master's soon. I'm still trying to get a high level job. But high school grads get the job for some reason and then can't do the job and quit.....

      Let's get real - the companies want unpaid internships at the bottom for 10 years and then to kick you out once you hit 45.

      It's only legally age discrimination if it's excluding people forty and above. No law protects young people against age discrimination.

      Not in Canada whoo! You can only discriminate against minors when hiring and that makes sense as there are A LOT of labour protections for minors. In fact, in Canada, there has been companies that have been fined for the requiring x amount of experience under age discrimination laws.

      ​@@sirdeadlock Fact is it makes sense too...Old people can't work as much, a lot of times as well.....This is a cutting edge US defense contractor.....They don't need old folks who just need a check to build up their retirement...They need sharp people. This stuff and affirmative action are a joke. The people that can best work the job should get it....companies shouldn't be checking their employee list like "oh no, we don't have enough geriatrics to fill our roster, go hire some useless nursing home patients that badly do their job and bring everything down" or "oh jeez, we don't have enough of this race or that race, I guess we'll outsource from people 30 miles away just so we can fit into the diversity laws"

    On the other hand, if they posted "must be 40+ years old" that would be entirely legal, since there's no age discrimination law protecting young people.
    Edit: Before jumping in to say I'm wrong, look up § 1625.2 and then look for the definition of age discrimination according to your local laws. Age discrimination law applies to people of all ages, meaning nobody (even older people) are allowed to discriminate when dealing with people age 40+; it doesn't mean people of all ages are protected.

    There is currently a shortage of younger workers in military procurement. These hiring policies are designed to address the issue.

      But the lawsuit doesn't involve any procurement positions, and Raytheon is production far more than procurement. And you can't break the law regardless.

Also I highly doubt he was as qualified as they claim unless he was recently back to school. The industry has advanced and someone with experience from 10 years ago isn't qualified anymore without more training and schooling to bring them back up to speed

    As a contractor for a defense company. I can say without any problem that hiring older personal is a problem and I mean 60+ years because they never leave until they drop dead.. And it just hold off jobs for younger generations from getting experience in those said jobs. I've had many run in over the years with guys that are 70+ and still not even thinking of retiring.. It's a weird world

      In Canada we actually do have anti-discrimination age laws and unlike in the USA it doesn’t only pertain to people over the age of 40. So in Canada you can’t say, “no students,” or as in your example using out of proportion experience requirements to deny younger applicants.
      Now it still happens, but companies have to be a lot more careful and not do it too frequently

    Its chronically known that most working in the defense industry are older and aging. These companies desperately need younger and newly educated workers to get going into the future. Im not saying its right, but its a well known issue in the industry

    It's not discrimination based on age, due to the ever changing requirements in the military field, they favor recent graduates of more modern educations, so if 3 60 year olds applied having just graduated from current relevant college courses, they'd likely be hired on the dot.

    Take notes from the british motorcycle industry. They failed to catch up to the newest generation of motorcycles, starting in the 1970's, cuz they didn't feel the need to teach young workers and kept the ones that'd been with them since the 1960's. Fast forward to today, no "english" manufactured motorcycle i.e. Triumph, Royal Enfield, Norton, are made in Great Britain.
    Employers need new recruits, fresh ideas pay well.

      Advancements in their field bring you advancements in flight technology. Gotta love the trickle down economy. No but seriously, all these technological marvels you've seen, are born for war.
      Radar, GPS, Internet, Jet engines, Satellites, Prosthetics, Computers, etc.
      Add the word "Modern" and actually put work into making a list instead of just listing things off the top of your head and you'll have a very long list, with nearly every single invention. Because at some point in history, every single invention has been innovated primarily for war, many very greatly.
      I wish AARP would focus more on how people's retirements have been completely destroyed by inflation and helping out those people, but I'm not the head of AARP, I don't really care what they do with their lives.

      That's the discrimination. What you don't want are people who are unfamiliar with technology or accident prone, which is fair. But you imagine that of all old people, and old people are not a monolith, so that is unfair. You can't use age as the aggregate, you have to hire for the individual and their individual merits, not the average merit of someone in their category.

      Companies don't think much beyond the next quarter when the shareholders are upset they haven't made all the money yet. If they thought long-term, they wouldn't be giving millions to the executives while laying off the people who actually do the work.

      Ya, that’s not how that works. They just have to prove with a preponderance of evidence that the company is engaging in discriminatory practices. The bar for civil courts is lower than for criminal so they just have to prove that it is more likely that it is happening than that it isn’t happening. So you have to be like 60% sure and not 99%.
      Edit: also the EEOC is supporting the claim and they win about 96% of their cases.

    Defense industry has a lot of old, expensive workers that work slow and are just burning out the clock until retirement. They're definitely discriminating.

      Now THIS is accurate. I worked for Bendix Aerospace for a short period of time. Holy crap, the freeloaders showing no shame, taking a paycheck, while reading the paper all day long. This was in the early 1990s. Probably still true.

      They're not discriminating. Newly graduated means anyone who graduated these older people need to go back to school to learn the new technology and are refusing to do so. They can't afford the college education either and they are ready. Make good money.

    When I went to college for aerospace engineering, I found out the entire program was actually an extended job training for Boeing. 80% of the graduates for the school I went to worked at Boeing, and reps from Boeing gave a presentation to the entire freshman class on day 1, immediately after the dean of the school

      No, at least not anymore. Technically it doesn't stand for anything anymore ("retired" isn't in the name). "Our mission is simply to enhance the quality of life for all as we age. We champion positive social change and deliver value through advocacy, information and service and we do it on the national and at the state level. "

      They are one of the most wealthy and powerful lobbyists in the US with nothing better to do. I get that a lot of old people don’t advocate for themselves, bit it feels like they forget how insane some people are getting post-retirement. Lobbying is kinda screwed rn, and gets more ridiculous each year, especially considering how many people don’t have any lobbyists working for them and their interests

      The Right to Retire is coupled with the Right to NOT Retire. If you can't keep working at 64, it's not a choice.
      The government/system actually punishes you with lower social security and pensions if you retire before like, 70.

      The EEOC investigation found that Raytheon was engaging in age discrimination. The court will take that under consideration. Plus, even if Raytheon wins in court the EEOC is likely to pursue action separately. Raytheon was warned by the EEOC to knock it off three or four years ago so this time they are likely to face sanctions.

      Yes, in the USA, for whatever inconceivable reason, age related protections only start at 40 years. I don’t get why that is the case, most other developed nations age related anti-discrimination laws protect against any age related discrimination (besides minors and that’s because we don’t really want minors working for the most part). So in Canada for example, you cannot discriminate against younger applicants by having disproportionately high years of experience requirements (though companies still do it, but they have to be a lot more careful and subtle about it). But even though I 100% agree with you that discrimination against younger applicants is a real and vast problem that doesn’t mean that discrimination against older applicants should be tolerated. Two wrongs don’t make a right. Plus, weakening protections for older applicants would end up hurting the chances of getting age discrimination protections for younger people.
      Edit: also the EEOC is backing the suit and the EEOC wins about 96% of its court cases. So Raytheon is definitely fighting an uphill battle.

      Ya, that is not how anti-discrimination laws work. If you set up requirements that don’t specifically exclude a group directly, but do so indirectly it’s still a form of discrimination.
      As an example let’s say a business in Town City says we are only hiring people from X and Y zip codes. When someone looks at the demographics for Town City it turns out X and Y zip codes are 98% white. That is still racial discrimination even though they are not specifically saying whites only.

      He refuses to go back to school to get the education. It doesn't have an age limit. It just wants you to be newly graduated with the knowledge of the new technology. He doesn't want to get an education because he can't afford to pay for it. So he's suing instead?

      4 yrs with annoying prerequisites and non related courses doesn't justify it if you've been in the field for while.

    I’m a child of two parents who cannot afford to retire yet. If anything happened to their current positions, their age immediately makes them umarketable to hiring companies. It stresses me out I can’t imagine how much that stresses them out. So many of our parents can’t afford to retire; which is its own problem that needs addressing. But if they’re looking for work, they should not be discriminated against.

      Okay but for this kind of work. Yes they should. As someone who works... close... to this field (being vague on purpose) I'm 23 with perfect vision and have to use microscopes, the old guys just straight up don't see things, some get confused and we've had million dollar machines break due to a confused input. I do understand that you worry about your parents. But truly this isnt a field they are qualified for. Say whatever you want about discrimination THEY CANNOT DO THE JOB ACCURATLY. You can't make employers hire employees who are gonna break machines and cost the company more then they ever payed any workers
      I'd argue what you actually want is proper safety nets to catch your parents and a solid retirement system.
      Unfortunately if your parents are old. They voted against all that cause taxes. They didn't wanna pay then so they'll have to pay now

    So let me get this straight, this guy's been trying to get a job at Raytheon for 5 years and still hasn't taken the hint that they don't want him so he's trying to sue them? The real question is why does he want a job specifically at this company? What job has been has he been working for the past 5 years while trying to get a job at Raytheon? If I don't get a call back for an interview I just apply to a different company, I don't keep applying for different jobs at the same company over and over.

    I went to school in an area where Raytheon was one of the biggest hirers of new college graduates.
    I cannot confirm that this is true, but I can confirm that they do hire a shit ton of people right out of college, especially in the engineering and finance sectors of their company.

    My grandfather worked part-time as a computer engineer when he hit 60. this way, the company didn't have to worry about him just retiring one day, because he was less likely to since he worked less, and they could also hire younger workers who needed to work part time because of school. those younger workers usually became full time aftetr graduating. in other words: more places should have part time routes for older (and younger) applicants.

    The huge defense company I worked for laid off tons of older (i.e. more experienced) workers in order to replace them with younger (inexperienced) people to save salary money, and did it despite laws against age discrimination. They simply aimed the layoffs at upper grade levels, rather than higher ages, because the only way to get into those upper levels is to put in decades of work so the only people there are older workers. The courts apparently have no problems with this even though it's obviously age-targeted layoffs.

    And yet there are businesses also openly saying they don’t want to hire Gen Z, and who list job post with so many years of experience required for positions that it effectively excludes Gen Z. Though this has been going on for so long that millennials also faced this kind of discrimination.
    Despite now being in my 40’s, I find it refreshing having a business wanting to recruit employees right out of college. It gives me hope for my kids finding jobs when they get older and not facing the same struggles.

      With all do respect, this research is not talking about soon to be retirees. This is referring to the 40 or so crowd - those with much experience but they demand slightly higher pay (or maybe they’ll even accept entry level pay) but also have to work for 25 more years. I have a lengthy resume, 12 years management experience, high performance in college, recently graduated with another masters degree yet I can’t get an interview. Not one out of over a thousand applications. I even spent $2400 on a resume class.

    But giving people their first job after graduation is a good thing though? Obviously not for _all_ positions, but a grad role for those without industry experience yet that focuses on mentoring and upskilling recent college and university graduates is extremely useful and, yes, useful for that very particular demographic.
    I myself was in a grad role when I started at my last company, and every year my team took on 1-2 new grads (in addition to more senior roles) because a) fresh faces, fresh ideas, and b) this is how we give back and make sure there's a ladder for new folks to climb to where we are now!

    I think that it actually makes sense that a defense contractor is hiring new people, as they may bring more imaginative and creative ideas to the table for new products, while older people may be more down to earth and not suggest those ideas due to it not being realistic in their eyes.

    I have a feeling it has more to do with the fact that recent college grads have lower salary expectations than established professionals. Basically if a job listing says “recent college grad” it can be translated as meaning “we have this position to fill and the budget we have been given to do it is a joke so we need someone that we can pay peanuts, grind into the dirt, and will be grateful for the privilege”

    If Raytheon is like most companies, they weed out older workers with their pay scale. New grad positions are paid too little for someone who already has an established career to want to take based on a decrease in salary. Someone making $80k wont bother with a job paying $45k to start.
