It's a balance HP with a condition and a cap, that's why it specifies UP TO 40% max HP since it's intended that it can't reduce less than 1 HP (although it should be clarified in the skill). It's Similar to Vivachel or for example how Chasun bypass heal block with S3 since it's also a balance HP and not a heal skill.
