    Sir, I really appreciate the way you take a neutral stance while explaining such news. As a law student I can clearly state that not many channels do that.
    Half of them cover a one side story with no knowledge of the facts.
    Infact, leading newspapers these days cover so many legal news in such a general manner that it looses its true essence. Many times I have seen reputed newspapers using wrong legal terminologies and at times failing to deliver out the correct position.

      This is a misuse of power by highcourts. There should be a law protecting officers from judiciary. Otherwise dyarchy is back. Both HC and state governments are running the state

      Then why should we conduct election.       @Devraj Singh government can't violate fundamental rights of citizen.
      Executives are answerable and accountable to legislature. They have to face election. Fear of public outrage is always there. And more importantly we have separation of power in constitution. Its more act like checks and balance.
      What about courts? To whom are they accountable.
      Moral here is judiciary need to respect separation of powers and they shouldn't cross blur line between judicial activism and judicial over reach

    DM acting in excess of his authority, Ordering against judgement/order of honourable HC is wrong instead would have informed the honourable HC of his situation due to the review petition filed by State Government as well as marking the reply & judgement/order of honourable HC to Secretariat.

    भारतीय न्याययिक व्यवस्था चाहे अच्छी हो या बुरी लेकिन कभी भी सनातन की हितैषी नहीं रही है।ऐसा निर्णय कोर्ट का अपने आप को सबसे उपर दिखाने का बहुत सुन्दर नमूना है। धर्म और देश से तो इनका दूर दूर तक कोई लेना है ही नहीं क्योंकि जो कोर्ट देशद्रोहियों और सनातनघातियों के लिए अपना वार्तालाप का पैनल भेजता है उनका विवेक कितना होगा भगवान जाने।

    Responsibilities ek labour ki bhai hoti hai... It's all about the pressure. How well you perform under pressure. How quickly you can think out with solutions. And while dispensing your duties how well you protect yourself is important. All the jobs are challenging today, but not all the jobs have the same level of pressure which a bureaucrat has to undergo. ☺️ A great example for all the aspirants to know wt they are aspiring for and wt challenges it may bring. 👍🏻

    Many people here are justifying the order of the court and condemning the act of Mathura DM. I think they fail to understand that the order passed by DM is not on his own whims and fancy. It as per the policy and guidelines of state government.
    Political leadership and High Court having opposite policy/ruling on same issue. Both of them ordering bureaucrat to fulfill its policy. And then punishing bureaucrats for not fulfillment of the order.

      If D.M has the EXECUTIVE POWER then honble court will not address the order to Ministers.... I guess u missed ur political lecture. The power a bureaucrat enjoys in our country,has been designed in such a way that HE/SHE IS QUALIFIED ENOUGH TO MANAGE THE DILEMMAS. Bt the D.M issued a ORDER against a High Court bench order Is a very very very serious contempt. Think this way "AGAR SARKAR HI COURT KI NAHI SUNEGI TOH AAM AADMI SARKAR KE KHILAF KAHA GUHAAR LAGAGA?

      @@arsih3013 Once NON BAILABLE warrent is issued the person have to be taken into custody (until court quash this warrent). Court to tab hi choregi jab wo sunwai karegi 12 may ko. Tab tak to custody me rehna parega.
      Problem here is that this step of going to jaid for few days only stops all the future career growth of the person. Even if the court find it non guilty later on 12th may. Still the person is punished for life.
      No one have problem with some person (whoever it be, a politician or officer) being punished after found guilty. But these steps of the court lead to parallel punishment which remain even the person is not guilty.

    I m sure judges never go on ground..even they don't have direct contact with public.. My lord over prolonged period make them feel God.. Making judgement sitting in office may not b correct.. Govt / executive have their own challenges. too much of democracy is not good for a nation.. Judiciary & executive services should have policy of exchange of services(like deputation) for some period .. It's possible by enabling through Job requirements/ educational requirements..

    You explained judicial part excellent but problem is executive part
    1) a person served a nation for years and after retirement he/she has to wait for years for legal benefits .
    2) Bureaucracy is not working neutral way in most cases.... If person is influencial then things would be different
    3) there is special policy of litigation acts and govt has separate department of legal proceedings which includes judicial experts.
    4) but in most cases govt delegates matters to District or tehsil
    5) this officers at bottom level don't have legal knowledge but under pressure file affidavit on behalf of government
    6) bureaucracy don't show little courage to return such cases back to government
    7) there is provision to ask for help or guidance or written order when working outside of your power but being IAS. , They are considering themselves superior or they don't have knowledge staff to follow such processes
    8) in this case there is major two issue - one government already denied and other is court's order - being DM , he should have taken permission from government....
    However ,in all this , pensoner would suffer delay.

    For those who are arguing about this case, I want to say one thing. Courts are above all, even higher than the president(apex court) then who is IAS IPS🤣🤣 sometimes bureaucrats neglect court orders but depending upon the weightage courts acts like this.. they are here to protect the law, constitution not for ego battle okay!!

    Those who denies court order how can he maintain law and order in a district? The Allahabad High court has definitely done a commendable work. In India we need a strong judiciary. Allahabad HC has a tradition of passing strong judgement against powerful persons including former prime minister Indira Gandhi.

    When there is a review petition pending how can hc give orders on contempt proceedings?? In terrorist afzal case, and Delhi rape case courts were giving continuous judgment on all the petitions filed without any contempt proceedings on jail authorities that why you are not hanging when orders are already given.

      Don't make any foolish comment like a joker unless you have proper knowledge in this regard. Judiciary, legislative and executive functions independently... District judges are appointed by High Courts.. And jurisdiction of HC expends within a state.. So here concept of all india test is a joke... And HC justices are recruited by SC judges based on performance , eligibility and most importantly impartiality of their self to uphold the Transperency of higher judiciary.... If exams are conducted then influence of gov will cast on judiciary that 's unfair and it's not necessary that all aspirants qualifying the exam will not be sold to money... 90% of beurocrates who passed interview are corrupt . That's why to sustain the nutral image of higher judiciary , reliability of justice is to be evaluated by on ground performance not exam

    Obviously I don't know about the intricacies of the case (wrt the pensioners) but if pension/salary is a subject of the executive and they have decided not to release it (definitely there must be a rationale behind this). Isn't the judiciary encroaching over the executive in this particular case ??
    Can anyone elaborate where am I wrong?

      Rationale is decided in court not by executive's descretion.

      Pension comes through pension rules and services act. If not followed then court will interpret law, weigh facts and circumstances and then decide. Court is not encroaching, but doing its work of keeping a check at executive discretion.

    This is how a Senior HC Judge behaves when his ego gets bruised. They went too far with NB warrant. When matter sub- judice for review and DM was not bound to execute the order.
    Just like one can get a stay on district court’s order from HC.
    4 crores cases are pending in India judiciary will not do anything about that but so much interference in the name of justice

      its not judge ego , its that the DM issued an order, against an order , already passed by court , which is illegal, Judge have more power than DM , and even its not a district court , its an order passed by allahabad high court , and if you know in 1970s , even then PM Indira Gandhi election was deemed wrong by same allahabad high court , forced then prime minister to step down , Even PM can’t deny same court’s order , why do you think a DM would have any chance ?

    SSP doesn't salutes DM. DM is not direct boss of SSP, its DIG. DM has magisterial powers , which means , in order to use force , SSP needs DM permission first, also SSP reports to DM on law and order situations , but DM doesn't have operational control over police, once permission to use force is given by DM, it is upto SSP whether to use force and how to use it. SSP is more or less equal in rank to DM

      SP/SSP is not of the same rank as DM. Check your State's Order of Precedence. In my state, DM comes in rank 35 in Order of Precedence & SP/SSP comes 39. Even the SP/SSP's Annual appraisal report is given by the DM, which is always given by a senior officer. If an SP/SSP doesn't salute DM, that's because of their ego, but DM is a higher post than SP/SSP.

      Police comes under DM as a tool to maintain law and order... Hence, SP/SSP reports to DM and in many states DM write the ACR of SP/SSP. SP/SSP has to salute DM but they avoid it by not wearing cap with uniform as you are not supposed to salute someone without wearing complete uniform which includes cap.

    I want judges also to be held behind bars who give unnecessary verdict which eventually turns into a crime!! Example : many time judge gives bail to rape accused bcz of lack medical reports but later the victim is killed by the accused as soon he got bail!! So in this case judge should be taken under custody.

    DM ko Pension release kar dena chahiye tha..Sarkar ki petition ka decision court baad me leta , Agar decision sarkar ke favour me aata to pension amount ko recover kiya ja sakta tha..DM ne court decision ke upar apna decision liya jo court ke order ke against tha..Ye Contempt of court hai. Allahbad court ka sahi decision hai...

    On one hand its necessary for courts to get their decisions implemented and on another hand the executive and legislature branch has to see the larger repercussions of the decision taken. I wonder if judiciary takes everything into consideration. If Govt goes bankrupt paying pensions, how will any funds be left for development. Pensions are an important part for an individual but its also a curse for Govt. Why does only a Salaried person gets pension. A businessman cannot work in his old age, how does society expect him to stay alive without continuous source of income. Businessmen do avoid taxes in many cases by evading them. Govt should reduce income tax levied on Businessman and increase income tax levied on Govt employee to level the field.

    DM is at fault here clearly. DM should clearly enforce HC court orders first than government policy. Second mistake he did is he issued a order against the orders of high court. He should have enforced the orders of court and if some uper authority could have stopped the pension he could have atleast present his ground on court.

    Court should hv issues a suo motto Constitutional writ of Mandamous and directed the DM.
    This is misuse if powers by the court to issue arrest orders to DM.
    What if people of executive start harassing Judges like wise?
    Court doesn't hv the authority to humiliate Officers and in many cases officers are not responsible as they are constantly transferring.

    #Update - The HC has recalled it's order after DM has submitted an affidavit on May 6 and has complied with order of the Hon’ble Court.
    When the sword is pointed above their heads they immediately follow the orders. Hail ! to Judiciary for keeping these egoistic bureaucracy under control.
    1. High Court was perfectly right in issuing Non Bailable warrant as the order issued by the DM on 18.04.2022 was unconstitutional and outside his limits when the order of High Court was clear and pending action since September, 2021.
    The problem is that Bureaucrats have high ego problems.
    2. The decision of HC on September 2021 was after an elaborate hearing, if the court have passed the judgment and the Bureaucrats were just playing delay tactics. It is wrong to say that Government was thinking of other 1000 people who were to claim pensions in future. It is not Government Ideology or arbitrary decisions which run a state office. A person who is eligible for pension must get it in any circumstances whether the number is in lakhs or thousands, these pensioners must have given their dedicated service to the government for almost 30 years.
    3. The DM would have saved himself if Government had issued some order before September 2021 and he was not in authority to pass an order contradictory to HC Order even Chief Minister or Prime Minister don't have such powers. He could have easily moved to SC challenging such an order of HC.

    Filling Review petition is not enough, unless a stay is granted on the previous order in the said review petition, one has to obey orders of the court. After all they have fought the case and won a battle in the court on merits, if the administration is in contempt, what can you expect from common citizen. DM should not pass an order which has disempowered/underpowered a HC order

    वे 3 कर्मचारी ये अच्छी तरह से जानते है के वे बोहोत बाद में रेगुलर हुए है, और रेगुलर होने के बाद की सेवा अवधि के आधार पर वे पेंशन की पात्रता नही रखते है। ये जानते हुए भी की नियुक्ति के समय ही उन्हें ये बता दिया गया था की आप रेगुलर नही है, तब रोजगार पाने के उन्हे सब मंजूर था अब जब सेवा निवृत हो गए है तो इस प्रकार की याचिका लगाकर सरकार और कोर्ट का समय खराब करते है।

    Harshit sir with all due respect, but I think you have misunderstood some time line of the facts of the case.
    In its September 2021 order, the Court had observed that the services rendered for a "very long period" cannot be ignored while computing qualifying services.
    It was in this context, hearing the contempt petition in Feb 2022, the Court sought the response of the DM Mathura, and again ordered it to comply with the order of the Writ Court.
    Pursuant to the above order of the Court, the DM Mathura filed a compliance affidavit filed before the Court enclosing an order passed by him on 18.04.2022, wherein, he had refused to grant the benefit of service rendered by the applicants prior to their regularization.
    So the administrative order by the Respected DM of Mathura was passed after the response was asked by the Honbl HC seeking the reason for not implementing the previous dated order and again a reminder was made to comply with the order.
    As far as review of the order is concerned, the court stated that:-
    It is expected that the District Magistrate should know the basic principle of law that till the order has not been stayed, the order shall remain in force, and the authority is bound to comply with the order.
    Thus, his later act of issuing an administrative order contrary to the current existing decision of the Highest Court of the state amounted contempt as the DM had no such overriding administrative power to do such an act, since until the court's decision was stayed the previous order was unconditionally applicable over the state.
    Also Terming the order of the DM as nothing but an abuse of power on the part of the District Magistrate and which amounted to gross disrespect to the order of this Court, the Court further remarked thus:
    " Though, normally this Court would have issued a nonbailable warrant, but in such glaring facts where the order of this Court has been violated with impunity, this Court cannot shut its eyes, and to uphold the majesty and dignity of the Court so that confidence of public may not erode in the judicial system, this Court finds it to be a fit and appropriate case in which non-bailable warrant is issued against the District Magistrate, Mathura who shall be produced in police custody on the next date fixed."

    Ab sarkar ko kuch aisa karna chahiye jisse judiciary ki Maa-behen ek ho jaye. Bahut ho gya inn judges ka natak. Aj toh CJI khule aam govt ko phatkar laga rahi hai. Kal dhamki dega aur manmani karega. Aukat mein rehna toh yehlog bhul gaye. Apne nepotism ko banaye rakhne k liye collegium system ko hatane nhi de rahe hai. Aisa lagta hai ab yeh judges sabse jyada corrupt hai. Bahut ghatiya judiciary ka halat hai iss desh mein.

    Simple, RDC could notify DM's residence as prison and he could stay and work from home till then. DM didn't commit any serious crime. He is just the disbursing authority of Pension at district level. Issue of Pension has to be dealt with state Pension Dept, which is headed by another IAS officer of Principal Secretary Rank. It's easy for a court to issue an order to give the pension, but the question is we're is the funds to generate the pension ??

    Sarkaar ke khilaaf bolo to ... UAPA.. sedition charges thok do...
    Or courts ke khilaaf bolo to Contempt of court thok do... Kuch bhi ho... Courts/Govt nahi sudhrenge hum sahi hai to bas hai... Aapki emotions, justice delay, or wrong verdicts hamare liye kuch maayne nahi rakhte....

    There should be law to even punish judge if they pass wrong judgement, few of judges in their old age are passing any judge's. Law should be respected not the once who is sitting there as judge.

    Couts should not interfere in govt policy
