So he didn't appeal because he couldn't. The difference now is that they admitted knowing about it in 2008 when an appeal was possible. The two scenarios are not the same. The only remedy for Hamilton is to invalidate the race result of abu dhabi 2021. If the race result is invalidated, then Max would still be champion because he had more points than Hamilton before the race.
If anything would happen from this, it would end up disqualifying Renault from the race and Massa still wouldn't be champion based on those results. There is no way invalidating one race because cheating happened by one party results in invalidating a whole race (would think it would result in a lot of races getting the same treatment by that same reasoning).
