If I've Been Drinking, What do I do if I get pulled over?

  • As a DUI defense lawyer, I get asked that question more than any other question. Over the past 15 years I have tried to verdict literally hundreds of drunk driving defense cases. And that question, when people find out what I do for the a living that is the question that I am most often asked, whether it be in a social setting or at the soccer field or at the hockey rink, people wanna know "If I've been drinking, what do I do if I get pulled over." And I think the only way for me to fairly and accurately describe what I think you should do is tell you what I would do if I were in that position.

    one note for those of us living in Oregon: if you refuse to take a breathalyzer test, IMMEDIATELY, you're going down to the station, they pull your blood for a test, and you automatically lose your license for 6 months. This is what WILL happen if you refuse the breathalyzer test. Whether it's your 1st or 31st dui.

    Officer, attorneys generally advise, that under circumstances like these, one should exercise his Constitutional right to remain silent. I am so doing. I want my attorney to be present during any questioning or testing.

      It seems to me that telling an officer what your attorney advised you would constitute a waiver of the attorney-client privilege. Now you can be compelled to tell all.

    What he didn't explain is that you cannot be found guilty of drunk driving if you do what he explained. Though you will lose your license for a while in some states for not doing the tests. When you get your license back your insurance will not go up. You have not been found guilty of drunk driving. If you are found guilty you will lose your license and when you get it back your insurance will be raised for years to come.

    Refuse field sobriety and breathalizer tests. You will lose driving prielegs for awhile, but not have to go to state pen. Your lawyers may be able to raise resonable doubt with at least ONE juror. That's all that is needed. BE POLITE AT ALL TIMES , but do not answer any questions except your name and address.

    My friend had a .12 was slammed. A female cop pulled him over. My friend is very good looking and the she was bowled over by his looks. He got off the ticket, landed up having a good time. Started dating, later got married, been together for 10 years. He never drinked and drived after that again.

    My advice don’t drive if you have been drinking alcohol if you know you had too much. A little bit and you can drive that is fine. Pay for a Uber, Lyft, or Taxi.

      A little bit causes officers to swear they smell alcohol. If one refuses breathalyzer, which can be inaccurate, it will be jail for the night. One beer can land you in jail. It can even get you a year in jail if you get the wrong judge.

      @@maggiemmoore My point was to use your best judgement. One to 2 beers over 5 hours I don't see how you can't drive home. But if you know there is DUI checkpoint or bad cops then don't take that chance. Your far better off paying for a ride to and from then a possible DUI.

      No, any amount = don't drive. I once owned a brand new car and was pulled over and the cop says "i smell weed." - i thought it was hilarious actually, my car was brand new, only 2 miles on it and I didn't use Marijuana at the time since it was illegal in my state.

    I had a rookie cop tell me he smelled alcohol. I said no you don't. I had zero drinks all week. Then he said more forcefully he smelled alcohol and I said "NO YOU DONT. I don't drink and I didn't even use Listerine today so there is no way you smell alcohol. I demand you give me a breathalyzer test right now!" He let me go.

    The whole thing is B.S. one drink and you can be over the limit. They know people go to restaurants and have a drink or two. Nobody can always have a designated driver. Being a DD sucks beyond belief too. Nobody can afford to add $100 taxi ride to their cost of dinner. Plus another $100 taxi in the morning to go back and get your car. A $55 meal at Applebee's becomes $255. The whole thing is so stupid. The legal limit should be raised. Nobody is killing anyone after 2 beers.

    If you roll the dice do this. Roll down your window, put your hands on the sterring wheel at the ten and two position, provide the officer your D.L. registration and insurance card, do not answer any of his questions, if asked to step out of the car do so, no not take a breath test on the side of the road, refuse to take any coordination test. You will be taken to the police station and there you must submit to test. ALWAYS request a blood test and most likely there will not be a blood taking specialist there and they will have to send for one before drawing your blood. In the meantime go to the toilet pee and drink a lotof water.

    Ive been accused by police at a dui checkpoint of drinking and driving and the cop said "the smell of alchohal is pouring out of this car" and asked me to do a field sobriety test, i said absolutely not , then was detained for about 45 minutes and asked multiple times and phrased it multiple ways if im free to go...waiting for a "certified" officer to show up to do a breathalyzer, i blew .00 three to five times in their breathalyzer, then their tones changed real quick, calling me sir, apologizing for the misunderstanding.

    I have gone down the rabbit hole of attorneys on youtube pertaining to protecting your rights....and I have learned so much that I never knew. The legal system is in place to protect you, BUT it will only protect you if you educate yourself. Otherwise, you will get eaten alive, no matter how smart you think you are. Educate yourself!

    Take the chemical test. Refusal almost certainly will bring about a suspension of your license. If you didn’t take the test, you can’t challenge the calibration or the method of application. All you can do is wait for the Court to decide how long your license should be suspended. I am also a lawyer and I would advise you NOT to do the field tests but DO take a Breathalyzer test.

      Understood. But if a cop askes you to take a field sobriety test, he has already made up his mind you're drunk and going to jail. For this same reason, I would refuse the breath test. Any idea how many people out there are driving to work with a suspended license? The trades are full of them, especially back when I started. People still have to make a living, and they are still going to drive to work license or no license. Also, laws vary from state-to-state. My state (MI) has an implied consent law and for those reading this that don't know what that means, it means that by accepting a drivers license in my state, you also consent to chemical tests from police officers who suspect that you are driving under the influence. It only applies "after" an arrest. You can refuse the preliminary test in the field and will get a $150 fine, period. But if you refuse the secondary back at the station, 6 points are automatically added to your license and you get a 1 yr suspension. They can also get a warrant to draw blood if they want and then you'll have no choice.
      I don't know what lawyers charge these days, but it cost my buddy 5k back in the mid 80's to get out of his drunk driving fiasco. Personally, I'd take the suspension. Best to just not drink and drive.

    I heard one about an off duty cop that got pulled over by a state cop the off duty cop grabbed his heart said he was having chest pains they call for ambulance the state cop told the off duty cop they were going to check his blood at hospital to see if hed been drinking when the ambulance got to the hospital the off duty cop said I'm ok and took off obviously to sober up I never found out what happened after that

      Someone I know did that. The officer accompanied him to the hospital. Never left his side for a second. He was checked out and no health issue was found.
      He refused the blood test and was taken to jail.

      If he smells alcohol on your breath and you say no he's going to know you are lying. If he has you on audio recording saying no and the breath test reveals alcohol in your system the judge and jury will know you are a liar. It's best to only say no if it's the truth. Just exercise your right to remain silent otherwise, and don't drive when you've been drinking anyway.

    In North Carolina, refusing to take the test after you've been arrested is an automatic one year suspension. I'd rather take the test and hire a good attorney to keep the damage to a minimum.

      Blow .08 and you got an automatic DUI AND license suspension, refuse and get charged with limited evidence. It all depends if you feel lucky at the moment.

    Dude is telling you to lose your license for 180 days by not taking test once back at the station. This will depend on how many drinks you have had, if it's less than 5 in the past 2-3 hours I would take my chances and take it after stalling as long as I could back at the station.

      I agree with your statement but I think his advice is valid if you know you are going to blow hot. With a DUI conviction, you will lose your license for at least that long and have a record of being a drunk piece of shit follow you around forever.

      It depends on a few things. How much you weigh and what kind of drinks you’ve had. 5 IPAs are going to hit you harder than 5 light beers because they have a higher abv. 5 cocktails will most likely be higher than 5 shots or beers because most cocktail bars serve 1.5-2 oz of 80 proof liquor per drink, and that’s assuming the bartender isn’t over pouring, which most do. The best thing to do is plan ahead and take an Uber or other form of transportation if you plan on drinking. The cost is way less than getting arrested

      But last 2 was arrest were in 1 month or 1 n a half Ur they meaning west coast of. Florida Clearwater. The last back to back was 2 in about approximately 6 weeks tried thinking bad prosecutor or plural n or lawyer this is in Palm Beach Florida he wears a non drinking Florida anckel thing scrambler whatever it’s called but especially if might sound dramatic but true we will die if he goes to jail more than weekends to keep his job n family if procecuter r lawyer knowing his job judge to give him weekends n us alive not overly dramatic but 100 percent true!!!

    The problem with refusing the chemical test if you have been drinking is - If you test less than 0.08 BAC, then you will not be charged with DUI, and you avoid any further penalty. If you are less than 0.08 BAC and refuse the test, you can lose your license for the year (same penalty as the DUI). 0.08 BAC can register with 2 to 3 drinks within the past several hours. If you have had say 5 drinks that evening (say its obvious to you that you are over 0.08 BAC, then I would say refuse the chemical test in the station.

      That isn't necessarily true. Over 0.08 is presumed to be impaired, below 0.05 is presumed to not be impaired. From 0.05 to 0.08 is could be impaired, and the officers observations, video evidence etc can be taken into consideration to determine if you were impaired even if you are below 0.08.

      0.01-0.04 - possible DUI
      0.05-0.07 - probable DUI
      0.08 and above - definite DUI
      If you drive after having even a single drink shortly before, you’re an idiot. If you use a personal breathalyzer that’s never calibrated to determine if you’re safe to drive, with the exception of registering zero alcohol, you’re an idiot. If you can’t afford the ride both to and from the drinking establishment, then you cannot afford to go out and drink

    😂the best way to beat a DUI is to beat the PC. That's a long shot with a good lawyer but that's all you have. Nobody can force tests but any other objective symptoms will then lead to breath blood or urine test. Refusal now isn't an option other than automatic suspension. So refuse a test and you lose your license.

    If you refuse the test or tests in Wisconsin you get revoked 1 year and counts as owi and need an interlock for 1 year after you get unrevoked.
    If your 1 time over the limit and do the tests you get 6 months suspended and no interlock.

    But, the best protection against having to suffer the consequences of a DWI conviction is....don't drink and drive. Great legal advice though. Though I support our police officers 100%, never, never, never talk to the police. They are not there questioning you because they like you, care about you, or want to give you a break. Also realize, it is absolutely legal for the police to lie to you. So all of that "Just be honest with me and I can work with you". Yeah, "working with you" will add up to you in hand restraints in the back of a patrol car. Look up the video "Shut the f*ck up lawyers", and they will tell you everything you need to say to law enforcement when they begin questioning you. lol.

    Maybe just don't drink and drive. My family and I shouldn't be put in danger just because you wanted to "go out and have a good time." And just to clarify, I'm not against drinking. I enjoy a few adult beverages from time to time, but there's a time and place for it.

    I know almost everything is against you. If you refuse the test there are punishments defined in some states.
    Aside from refusing can you request the test from your primary care physician? Or to take the test at a time of your choosing? Say 6h later, the next day etc?
    In Oregon I don't see any requirement of a time frame on when the test is performed or any requirement that you consent to have the police or government administer the test. As a medical procedure I believe I have certain rights to privacy.

    I see a lot of RUclips videos regarding what to do if pulled over and you've been drinking. But what if you don't drink at all and get pulled over? The cop will take one look at me and never believe I don't drink. So then what? I won't agree to do field sobriety tests. At my age (71) and my bad knees, I would never pass. But what about a breathalyzer? I don't drink alcohol, EVER, so theoretically I should easily pass. But should I refuse? And if so, why?

    Fairly sure in CA you will lose your license to drive for a full year or more if you refuse a chemical test. Agreed on the rest, be nice and just say "I haven't got much to say, can I go"?

      Remember that the assumption is that you'd fail the test if you took it. So there's no downside to refusing to provide evidence against you.

    Just give name and say you want to consult with attorney before you do anything else. By the time you get ahold of an attorney, the alcohol will be reduced and there is nothing to charge.

      That's a completely different set of circumstances.
      The limits are so low you could have two beers with a meal and technically be under the influence.
      It's a racket for government as well as attorneys. It lines everyone's pockets.

      When I was 16 years old I was sitting at a red light and I got T boned by a drunk driver and totaled my car out they didn't find him until later that night after he had a tree so I know what that's all about.
      However when the limits are so low And they are extremely unrealistic it becomes nothing but a business and that's wrong.
      It's a cash machine for all involved.

    Anyone who represents himself represents a fool. That's why you make sure to take your defense attorney out to go drinking with you, and be his ride. At worst you'll get a suspended license, and that's a heck of a lot better than a DUI

    I got pulled over for drunk driving once, late at night. It was a younger female officer, maybe a rookie. She asked if I had been drinking, and I said no (which was true). She said I was weaving and driving slowly, was I sure I hadn't been drinking? I said yes, I'm sure. She let me go.
    In that situation, I don't think it would have been better for me to refuse to answer, and it certainly would not have been in my best interests to refuse all chemical tests. However, the advice in this video assumes you HAVE been drinking.

    OK, so your license can be suspended just for refusing the chemical testing... So, what is the benefit of refusing? Is the benefit that a lawyer might get you off on some technical issue? And if that doesn't work, what happens? Perhaps your insurance won't go up because you were not actually convicted? I'm guessing most insurance companies will raise your rates just because you refused testing, unless the charges are somehow dropped. Trust me, I'm not trying to be a wise guy, just trying to understand how all these refusals might play out.

    It is NOT the same suspension time atleast in WA if you refuse. If you live in WA, I recommend to always blow. People that refuse to blow in WA will get a search warrant for their blood (blood test) within 30 mins. And it comes with much worse

    I do not understand. You say do not take the field sobriety test which guarantees you will be arrested and taken to the station. At the station you say do not take any of the three chemical tests which guarantees your license will be suspended at least 180 days, longer if you have a record! Your advice guarantees suspension of license for at least 180 days!
    Why not take the field sobriety test and hope you pass? At least there is a chance your license wl not be suspended for 180 days.

    What is the best way for a hemophilliac to legally refuse blood testing 'outside' of a hospital setting; ... and, which can sometimes result in historical near exsanguination of vascular blood volume. Im not a 'drinker'. Is there ANY way to legally prevent such danger by over-zealous cops ?????
    Is there any way to legally require that such blood testing can ONLY performed in a hospital (with adequate stock of BLOOD), and without any unecessary personal expenses if the blood testing results in extreme untowards probabilities ?????

      If you wanted to avoid going to jail you shouldn't have driven after drinking. He's giving advice to people who are going to jail regardless to have the best chance of winning in court. And while cops aren't bad guys, when one stops you when you are driving, for any infraction, not just a DUI, it's an adversarial encounter. He's gathering evidence against you, and it's up to you to protect your rights and give him as little evidence as possible.

      I have had friends that were stopped for a DUI/DWI with the cop saying they state they smell alcohol and/or saw weaving or stumbling gate. They all registered 0 on the BAC, so no I do not trust cops. It is hard to dispute cop testimony when it is just a cops subjective witness (a lie).

    The usa laws are far too lax on drinking and driving
    In the uk, the endorsement stays on the licence for 11 years after disqualification ends, and with a maximum ban of 5 years for the worst offences, it takes upto 16 years to get cleared

      @@landonk7549 well, once the ban is ended, you can drive again, but the cost of insurance rockets with the endorsement, and hiring a car can be difficult, but it's not the end of the world, but in many uk, and usa areas that are remote in the countryside, public transport is very limited and a car is necessary, but in London uk, I find public transport and a pushbike are suitable alternatives to having a car

    I work for a funeral home. My main job is picking up those that have died and secondly, i am the man that cremates those that want it. Recently a pregnant lady was hit by a drunk driver. She was eight months pregnant. When she got to the hospital the fetus was moving all over the place and then stopped moving.They did a test and found out that the umbilical cord had severed between the mother and fetus. So the fetus had starved to death. So the drunk man, who has had two DUIIs, was arrested for manslaughter and will probably get ten years in prison. I am the one that had to pick up the little fetus at the hospital and today I had to cremate the small female fetus that had no chance of life. Such a heart breaking task to do. I pray that the mother and father will find peace one day.
    I have said for years that there is no reason why anyone should ever have the need to drink and drive. My dad was an alcoholic and had at least three DUIIs.
