Decree can be preliminary as well as final. Decree is operative part of Judgement. Judgement comes before decree. The definition clause of 2(9)CPC is not happily worded. There are a lot of sections which are not happily worded and their interpretation is clarified under landmark judgement of CPC. Please stay abreast with case laws to understand them more.
Judgement is a decision given by the court by determining the facts and issues of the case. After coming to the conclusion of all issues and facts the judge gives a reasoned decision to it. Whereas decree is a formal expression that determines the interest of both the parties conclusively. Here the rights of the parties are determined. A judgement can be of any number of pages it can be 1-1000.. xyz. Whereas a decree is usually of 1-2 pages. Which only states that what are the rights of the parties after the judgement. In short we can say decree is the abstract of judgement.
Ma'am sec.23(3) is now redundant as no HC is subordinate to any other HC, so we can directly go for the application u/s 25 for transferring the case from one HC to another. Thank you for such a good session .

If the decree is passed by a trial court, can it be transferred by the trial court u/s 39 to any other trial court or it can be transferred only by district/HC under section 24 only?
