What constitutes an independent judiciary? How can a judiciary appointed by the president hold him /her tp account? Is it not the accountability of the CJ to the President who exercises influence through the appointing relationship that the duty to hold the executive to account was placed on the legislature who are elected directly by the public? By reverting to the judiciary, does this not create a conundrum whereby the President is conferred with a power to supervise himself via his subordinates such as the hawks, SAPs, and NPA? Does judiciary become independent just because Motsepe says so? I wonder.
