  • GERMANY: Legal bombshell! Federal Administrative Court overturns Nancy Faeser’s Compact ban
The Federal Administrative Court has temporarily halted the ban on the right-wing extremist magazine "Compact". In an expedited procedure, the judges expressed doubts as to whether the ban was proportionate and demanded that milder measures be examined first.
In mid-July, Federal Interior Minister Nancy Faeser banned the magazine, which is published by the AfD-affiliated publisher Jürgen Elsässer. She justified the ban by citing incitement against Jews, people with a migration background and parliamentary democracy.
However, the court made it clear that a complete ban on print and online content is only possible under strict conditions, even though an anti-constitutional attitude is evident and there are indications of a violation of human dignity.
The German Journalists' Association (DJV) welcomed the decision as an important commitment to press freedom. DJV Federal Chairman Mika Beuster stressed that the Compact ban was a political hasty decision and that Faeser must continue her fight against right-wing extremism while respecting fundamental rights in order to avoid political damage.
