      Our land lord raised the rent to a phenomenal including monthly fee. Therefore not affordable to live there ESA pet or not

      Um think again. An esa will be charged monthly ( animal fee). A legitimate service dog will be exempt. An esa dog cannot fly for free, a service dog will. I’ve seen lots of people charged the monthly pet fee from rental companies.

    Some of the Petscreening companies are landlord friendly and make it difficult to get an emotional support animal so the landlord can charge monthly pet fees. They even brag about that in their advertising, Renters should know the landlord can not force a renter to use a Petscreening company. The renter can apply directly to the landlord. That is usually the best way.

      Not all management groups will allow you to put in a reasonable accommodation for an ESA or service animal. They will continuously state " it is our right to use outside sources to conduct work for us." Unfortunately I know that's not true. Pet screening does not know the resident with the disability, hence, they can not approve or deny an ESA or service animal. Currently in the middle of a fair housing complaint pertaining to this issue as well as another issue. I am disgusted with the way real estate companies are treating their residents (30+ years renting from the same company)

      The way to address this issue is to remember your animal is not a pet. I haven’t had to use this type of service but if they ask if you have a pet, I alway say no and then make the reasonable accommodation after I am approved.

      An esa dog is just viewed as a normal pet and will be subject for a monthly fee. A real service dog will be exempt from those fees etc

    It seems everyone can get an ESA letter. 🤦‍♀️ The following living situations are exempt from rule of the FHA:
    -Owner-occupied buildings with four units or less.
    -Single-family homes sold or rented by the owner without an agent involved. (Myself)
    -Housing operated by a religious organization or private club.

    There is no reason an individual should be able to take a German shepherd pitbull or Rottweiler that is completely untrained on to a commuter airliner with just a little ESA sticker it’s ridiculous

    What if the ESA pets pee and poop in common areas and tenant refuses to clean up? There is a specific provided area for the animals to go to the bathroom, thx

      An animal still has to be well behaved. Document these issues, send a written notice or 2 informing them of the problem and telling them to cease the issue.
      If it continues, tenant can be evicted.

    My landlord is evicting us because I rescued a dog and made sure she was well-behaved first contacted my mental health provider that I've been seeing for over a year and have dealt with mental health issues my whole life I am 30 years old when she found out about the dog before I could tell her due to I was waiting to see if I found the original owner and I was going to give it one week she found out on December 17th the dog was brought in the property on December 12th I contacted my doctors on December 14th about getting the paperwork for the dog well when I asked my landlord said hey so I can't have an emotional support animal she said no absolutely not we made an exception for your wife my wife has a registered ECA Chihuahua and we will not tolerate two pets and told me I must take it to the pound which in our county is a kill shelter so on the 28th had a termination of lease on our door says that they did not renew the lease 2 months ago that they brought to our house and sat down and went over all sorts of crazy crap I've already filed a complaint with HUD they got in contact within 6 hours and extradited things to speed them up even when I sent her the paperwork on my ECA animal she said that I don't have one she allowed my wife to have one but she's treated me differently than my wife the whole little over year and a half that we have been there and says that we have till January 31st to get out that she does not need to hire a lawyer or take us to court file eviction paperwork I hope she doesn't think I'm that stupid because we have done nothing wrong and places are very hard to find right now anybody have some advice we're just trying to stay in the place we're in for the remaining 6 months of our lease and go on our separate ways or has anybody ever dealt with this situation how did it play out for you because on the 28th she said she gave us two weeks to comply from the 17th to the 28th is not 2 weeks and I asked her on the 28th I said so if I take the dog to the pound like you said I have to do can we stay she said absolutely not so she's not trying to negotiate has it from the start we've never been laid on rent haven't caused any problems. Seems crazy to me to throw good tenants out over something so small said the only way she would have to take us to court is if we did not pay rent this month but we would still have to be out by the 31st a landlord cannot evict you without going through the courts I do know that and I do know a landlord cannot deny an ECA animal and tell me that I don't have one nor do I have mental health issues but our neighbor who rents from the same person has multiple animals and they can do what they want but they've been renting for 18 years any advice anybody we are in North Carolina if that is helpful

      And sue her for discrimination based on Sex and ESA

      It's generally the tenants that are being wronged there are laws that protect landlords but it requires them to prove the burden a simple dog or cat or other average pets that we have should not result in undo burden. I do believe if this animal becomes clearly aggressive or destructive and the owner or rental property is made aware they can take actions for their right at that point. I honestly wouldn't be here if it weren't for my dog. He changed my life he got me going my severe anxiety and not leaving the house and no job and depression are very much alleviated by this dog I now have a job I now get out of the house I now interact with people in public even without him there without his presence though I was not in a good place and he came into my life unexpectedly was not even supposed to be my animal but my mother's but he attached to me and we bonded and I immediately began doing much better mentally I saw therapists and psychologists for a while. I'm currently having to move and he has been an emotional support animal for a few years now and we were given 60 days notice that the owners of this home are selling and as much as we wanted to buy the home we could not yet afford the asking price for this home so we started looking immediately... we've exceeded that time frame have spent hundreds in applications our credit scores have gone down with the amount of credit checks being done which I've never seen before they are all doing hard credit checks on us and we are told everything looks good we move onto the animals where I have two a small pomeranian and a 75 German shep mix. And we let them know he is an emotiomal support animal with every place for over 2 months now have denied us for this animal or requested $1000 or more in non refundable pet deposits for him alone which we clearly we cannot afford. It's stressful it's one dog...we are not even going for homes that say no pets because we want to respect their right to say no pets even though he is an esa and they should ...legally allow us but we don't we only go for homes that say pets allowed and over two months now nothing had worked out I'm out hundreds. I'm so stressed I'm not eating properly I keep getting sick and I'm exhausted I've missed work to meet up to look at a place that said they would allow dogs to be denied again for my esa dog. I'm also missing work due to straight stress and not being mentally able to perform I work in a place for customer service and it is very hard to be upbeat and empathetic in this type of job when all I want to do is go crawl in a hole. I've had to leave early with massive migraines due to again stress and depression now and severe anxiety my father is so stressed as well he ended up in the hospital so.i left again for that. Thankfully my work is being understanding so far but this isn't fair he is a very polite well behaved dog my little pomeranian is more likely to bite someone although she never has and she is more likely to potty in the house or chew on walls which again we don't allow that and she listens well too it's just that my boy my 75lb boy sits when I say sit comes when I say come lays down when I say down will literally die before peeing or shitting in the house he also would not chew a single thing he only chews his toys apart and then brings them to me when he is done with them. I'm so lost and stressed thankfully the owners said we have a little more time but they do want to sell so eventually we need to leave and there is nothing out there so far that is allowing my dog. We've even offered to pay their asked for pet deposits when reasonable and pet rents for him even though legally they shouldn't do that either but we just need a place to live and we are willing to do anything at this moment just to find a home to live e in we want to buy but are just not there yet and need a home to rent until then.

      If you’re not on the lease, you’re not offered the same protections as a resident. The landlord has no obligation to approve YOU, let alone any reasonable accommodation such as ESA

      i would say that some people don't have good halesome relationships with people for lots of reasons but to have a dick landlord looking to shit on your need of a friend is pretty low i guess a school shooting or something like that would be more to your liking. sorry for the raw comment but it is strongly possible thar a big wet kiss from a dog could mean the difference.

      No. Although a unscrupulous landlord may decide to invent a different reason not to renew, or raise the rent to the point that you can't afford it...but if you can prove it, they are walking on thin ice because hud can fine them 10s of thousands of dollars for violating fair housing laws.

      @@micahalba753 I'm sure these statements would go a long way in a case against you for discrimination. it shows that you believe the law does not apply to you and is evidence as to your intent to evade said laws, resulting in 50 thousand in fines and could result in punitive damages as well should harm come to the individual as a result of your actions possibly leading to your selling the property to pay said fines and damages, easy to just not be slick.

      @@musictosoothe the only thing that can be asked is is it a service dog and what task does it preform, real trained service dogs you can tell apart from pet dogs, tehy are not distracted, they remain in a stay position when prompted and stay focused on their owners

      Hi, service dog handler here. Landlords are legally allowed to ask for a doctors note for a service animal or ESA. This note is often a generalized note just saying “this patient would benefit from a service animal due to their disabilities.”

    This is vague and misleading. Breed absolutely can matter. Insurances have a breed ban list. If tou rent to someone with one of those breeds, insurances can and will either raise or cancel insurance. A landlord can deny because forcing them to pay more for insurance is not reasonable.

      Yes you can legally get one. My apartment doesn't allow pets but because it's an emotional support animal you can get one as long as you get a letter from a licensed therapist. If they say no you can report them to HUD and they'll get charged a large amount of money.

      @@vlheno3170 She can't require all of that information. She can only restrict it if it's a large or "dangerous" breed. It's not a service dog so she legally can't do that. You can report her to HUD and she'll get reported and in trouble with the law

      First of all, an esa is not a "pet". Get that into your head, and it will make more sense. If you have an esa letter, you don't have a pet. You have a support animal. You have an obligation to inform the landlord of your support animal, but the landlord cannot deny you reasonable accommodation (allowing the animal to live with you), no more than a landlord could deny you housing because you use a wheelchair. Get it?

    Actually you can get past it as a landlord. If the animal causes damage that is beyond accommodation then you can get rid of it. Also, if you are a landlord and you own less than 3 single family homes you do not have to let the tenant keep their ESA

      You're slightly off with that last point. You can own as many sfh as you want, but you can't use an age or broker to handle the business end of it. Also, if you're living on a multifamily property with 4 units or less, then you can exclude the ESA people.

    This is what’s wrong with this entire country. I don’t know who makes these laws, but they are completely one-sided. Now, before anybody jumps down my throat, I understand that somebody may have an actual service animal. I don’t really understand how a pitbull can be an emotional support animal. That’s where the law starts to get out of hand. Also, only somebody who is as dumb as a rock would make a law that treats these animals as human beings. They are not human beings they are and will always be animals. So to say that a landlord cannot charge a pet fee or additional fees is absolutely ridiculous. I understand if they want to regulate fees so that they don’t get crazy but now you have animals living in your house that shit where they want to, shed hair, chew baseboards and other damage to hardwood floors, etc. they are not human beings. If somebody puts a cat into a house that is their emotional support animal, many people are highly allergic to cats and now the landlord must pay to have all the carpets cleaned or possibly replaced for the next tenant. These laws are absolutely ridiculous. I’m not posting this comment to offend anyone who has service animal although if you have a pet duck or a pet pig or some other kind of crazy pet like a pitbull and you are saying that that is your emotional support animal then I have a problem with that.

      These laws actually do not make the animals as humans. They do not fall under "pets", but they change to either "assistance animal" for ESA or "medical equipment" for a service animal!
      I work with animals, and have ESAs, and I disagree with that ESAs do not require any training. I do support basic training for simple manners and teaching owners proper outlets for their dogs energy or needs.
      Also, I'm glad the laws states that any pet-specific damage falls financially to the tenant. Just because I have been given the privilege to my dog because of my disabilities, should not mean that I let my dog eat a wall and get no consequences for my lack of control over said animal. Just like parents, a good owner will make sure their animal is well behaved!

      Also pitbulls are commonly used as both service animals and ESAs because they are extremely intelligent. It’s ok if you don’t like them or aren’t comfortable, but if that animal provides a service for a disability either physical or mental and is approved then it can be an awesome esa or service animal!

    Because I have some English problem. I want to ask:
    1. Apartment has strictly weight limit of 25lb. but I have a emotional dog 80lb. Can apartment refuse my dog ?
    2. I want to confirm that apartment can not charge pet rent for emotional dog ?
    3. Is that true law has changed since 2021 ? As emotional support dog is not allow to enter grocery store ?
