Limitation period for 1 yr i can a suit last date of period if suppose i was insane middle of that year and got recover after two years then my disability period should start from when i got recovered but not from where the limitation period is starts? I think , wound up proceeding start hui suppose 1 jan 2001 ko... 1 march ko liquidator appoint hua.. now .. 1 jan to 1 june tk time exclude hoga... but 1 june k baad limitation suru ho jayega and applicant ko apply krna hi pdega liquidator ko or agar nhi krta to time barred ho jayega ... bcoz agar time jo exclude hona h usse phle apply hi kr diya to .. suit is deemed to be instuted on that very date .

Suppose kisi ne use krna suru kiya 1990 me... and 2023 m ab actual owner ne obstruct kr diya to.. 2 yrs preceding k according to 20 saal pure hone chahiye between 2021 to 2023 but yha 20 yrs complete ho rhe h 2010 m hi ..😂😂 to kya uska right gya ... that's not how it is works. I think jis date ko aap suit institute kr rhe h usse 2 saal phle hi 20 saal pure ho jane chahiye .. that's what tje section is saying Like .. in the above example, 20 years 2021 se phle complete ho jane chahiye.. 2021 k baad nhi
@@bushraali8299 but that right can only be claimed if after becoming the right absolute any one obstruct or deny to use such right ... so suppose koi rasta h usko use krte 30 yrs hogye ... or ab koi obstruct kre to ... kese clam krenge ya kese suit dalenge bcoz 20 saal complete hone k baad upcoming 2 saal m suit dalna tha according to you... iss situation m kya krenge fir .. ??
Hey bro let me clarify Ye section 25 ka subsection 1 and 2 dono ek dusre ke complementary hai. They both have to be read together. Suppose you have used any land for easement for 50 years, then any person obstructs you. Then you file suit against him regarding the obstruction of your easementary right. He challenges that you do not have an easementary right. Then here you need to prove two things- 1st that you have used it contionously for 20 years AND AND 2nd that you have also used this right within last 2 years from date of suit. So basically it means that if someone uses land contionously for 20 years or more but they then do not excercise right for 2 years then any other person CAN obstruct them. Hope this helps.
