Of course the Talmud is full of horrible things that we Muslims reject, but if we are going to criticize it then we should read it in good faith and bring up actual arguments. If somebody had it with a 3 year. Then the punishment should have been mentioned not what money she can get when she marries and have to prove that she was raped by a grown man. And if they had to mention these things with such specifications, I wonder how much it is in practice. Because these things should have been out of question and must have been treated with severe criminality, but they have just mentioned what the victim must go through after the act of criminal.
And also applies to a woman, for there is no limit to the age of the boy, he only has to be under 9. Why do people just leave the women out of this? Typical feminisation of the world
Jewish law, similar to Islamic law, is very detailed and thorough, and goes into every single issue and makes sure no situation is left unaccounted for. If you read books of fiqh, you'll find prescriptions for the most strange of situations, such as whether it's okay to combine and shorten prayers when the travel between two far-off places occurs instantaneously by means of teleportation. The Shafi'is would make fatawa for situations that haven't occurred yet, just in case they would occur in the future. So just because in the Talmud there are prescriptions for how to deal with dowry in certain cases doesn't mean that those cases are in any way being endorsed; at worst they're recognizing the reality of such cases and giving them an understanding of how to deal with it.
"Niddah 5:4" is a Mishnah that teaches that a girl of the age of three years and one day may be betrothed by intercourse and if a yavam had intercourse with her, he acquires her thereby. The Mishnah emphasizes that this is not discussing the advisability of such an act, merely the efficacy. It also teaches that in a legal sense, sexual relations with a girl over the age of three counts as sexual relations. "Mishnah" - The Mishnah is the first major written collection of Jewish oral traditions, also known as the Oral Torah1. It was systematically compiled by scholars over a period of about two centuries and was given its final form in the 3rd century AD by Judah ha-Nasi. The Mishnah is considered the written form of oral explanations of the Jewish Law given to Moses by God. "bethrode" - engaged to be married. "yavam" or The surviving brother - the yavam - is called upon to replace his brother who has passed on and, by marrying his wife, effectively takes that brother’s place.
