The Doctrine of Discovery and its grip on Indigenous lands

- Are cracks forming in Canada’s acceptance of the Doctrine of Discovery?
Would something come along to take its place?
These are some of the questions surrounding the controversial Roman Catholic claim that cleared the way for Europeans to “discover” and seize what we now call North America.
The “colonial land grab” as some see it was made possible by a series of papal bulls - decrees issued by the Vatican in the late 1400s.
The doctrine acted as international law and outlined principles to justify European expropriation and colonization of lands and resources despite the presence of non-Christians or Indigenous Peoples.
It said Peoples who were not Christian were not people and the lands they occupied were “terra nullius” or vacant and open to “discovery”.
APTN News asked experts to help explain the doctrine and whether it can be rescinded, renounced or revoked.

That reminds me of Palestinian situation.
I guess they don't change their strategy just its intensity

A similar event occurred with the English, pushing out and occupying the best Irish land, and these consequences persist to the present. But I really doubt that the Irish will be successful in getting compensation for their land grab. It’s pretty much what one tribe has been doing to another tribe since time immemorial
false equivalence
the crimes of the _past_ NEVER legitimately exonerate the crimes of the _present_
further, while one may choose to attribute the behaviour of the "primitive" "uncivilized" "savage"
tribal peoples
the "christian" "civilized" European monarchies / tyrannies deem themselves inherently superior
in morals, ethics, civility and hence have implicitly, even explicitly taken upon themselves
in their supremacist ideology ALL of the moral, ethical, spiritual, legal implications of their actions
with no recourse to the kind of rationalization / apologism to which you refer
@@Pollencakes You are not from here either.
ps. the adult male who raped and tortured me when i was 4 years old in foster care sure looked alot like you. I got a photographic memory thanks to that whole adventure in time. perhaps it was your father? did he ever get adopted in northern ontario?
Very similar. In fact, the same dudes who led those chartered companies that cut up ireland were the ones to found the first colonies in north america🤫
Ireland, Australia, New Zealand, Canada, USA and many others.
This was so well put together. Thank you❤

Figure it out
Pope doesn't have to rescind the Doctrine! The indigenous people are doing it for him hence the reason for so many empty catholic churches around the world plus the crimes against indigenous children!
Fair & truthful..

Hopefully The Church will give up it's indigenous lands.
The Church doesn’t have “indigenous lands”
Yeah, the church doesn't have any indigenous lands.
You do wrong you pay!
Do what's right!
Compensate for the stolen land , minerals, n devastatikn to the lands and the original ppl.
People that have lives there for over seven generations have as much right to live on the land as anyone else….theyve become native themselves. The biggest problem is modern people think they own the land, but the genuine indigenous people knew they could never make that claim. We are custodians and harmonious protectors…not owners! Titles are Roman treachery and theft.
The all mighty wants you to give them their stuff back.
You've neglected it long enough.
If you ask nicely, maybe they will let you stay.
But, we both know you'll say no.
And then you will have to face the all mighty's wrath.

I think the RCC had said it’s not a valid doctrine now.
Smh
This is what our landlord tried to do to us recently
Very well done, although it pretty much amounts to saying "Might makes right runs the world". And I think most people knew that.I may have missed it, but in april the vatican did in fact rescind the doctrine.
hola
It's crazy about any indigenous people of any country did it to their own people
more please thank you very well thought out

Thank you for Reality T.V. this is the REAL THING. Now USA needs to quit using this in out courts today. YES. THEY STILL HONOR THIS DOCTRINE!
And it continues to this day.
The path of recovery is all cleared up. Good luck to all of you. You jesuits of the christ are not out of your purgatory.

CONTINUING CHRISTIAN DOMINATION: A RESPONSE TO THE VATICAN’S REPUDIATION OF THE DOCTRINE OF DISCOVERY
Continuing Christian Domination: A Response to the Vatican’s Repudiation of the Doctrine of Discovery - April Online
The official name of Canada, i.e., the Dominion of Canada, directly refers to the text of the Doctrine of Discovery. No other country uses this morally repugnant title since everyone else has a modicum of decency. Though largely symbolic, changing this title should be front and centre on any path to reconciliation.
The government of Canada hasn't used the name Dominion of Canada since the 1960s. Its not on any official document or institution. They even changed Dominion Day to Canada Day. It also has nothing to do with the Doctrine of Discovery which was also rescinded a LONG time ago. I think we're good.

What the government does is hardly the point. The government also often claims it is conducting 'nation to nation' negotiations, but such negotiations would always involve international observers.
@@mikearchibald744 Nation to Indigenous nation is completely different. Indigenous nations are not nations in that classical sense - they're smaller semi-autonomous communities that exist within a larger country that provides them with support, resources ect.
Doctrine of Discovery hasn’t been used for over 500 years.
In The United States, it was used in a 1998 court case as well as a 2005 supreme court case. The first case in which it was used was in 1823, Johnson Vs. Mclntosh and this case was the base for what The United States property Laws were based upon. Native people only had the right to occupy the land ( like a fish occupies water), and it could be taken at any time, and only white land-owing men could own and discover land. Watch the Ted Talk by Mark Charles. It's very intriguing and informative.
@@reneedelacruz5103 AND how legal cases work is based on precedent, meaning a cases long ago cited it, then over time as other cases built up, those would be cited rather than the doctrine of discovery because basically when you do that, people say "oh, whats that" and then you have to admit "well, it basically means the legal system is based on imperial conquest'.
Which also technically means I can go to ANY piece of land and say "well I discovered this, therefore I own it since I put this house up and occupy it". Of course the courts would laugh at that, and what THAT means is that the entire court system is ONLY based on imperial conquest and has no justification AT ALL. Which is largely the case.
Manifest destiny has a part two...The retaking of the lands. Its Biblical not papal bull racist propaganda!🤬⚔️
This piece is is misleading, as is the title’s primary word “Doctrine” of Discovery. It implies to many that the Catholic Church declared a formal doctrine religiously about aboriginal rights as a matter of faith or morality. The papal bulls whereby the issue of competing political land interests among the European political powers were arbitrated by the papacy to minimize the risk of military conflicts unfortunately had little respect or consideration at the time for legitimate entitlements of indigenous peoples. But this was not any formal religious “doctrine” of the Church and the term’s use here is misleading especially in that that the Church formally and specifically repudiated the colonial powers’ abrogation of indigenous rights and freedoms in a sixteenth century declaration. The term “Doctrine of Discovery” was only first coined by the US chief justice in the nineteenth century. The use of the term now politically may have more to do here and elsewhere in the current media with anti-catholic bashing and/or compensation goals.
