If he had withdrawn the fish from the program there wouldn’t have been any problem. There was a guy last year that entered a fish in the program and then realized that his license had expired. He called and withdrew the fish and they just gave him a warning. Leaving it in could be perceived as deceptive.
Some states arrest for minor offenses to keep those offenses from being ignored, especially by non residents. The State likely wouldn't want to expend money on extraditing on an FTA warrant for no fishing license. The SCOTUS in Atwater v. City of Lago Vista made arrests for minor offenses permissable so long as probable cause exists. The intent here is clearly to ensure he shows up for court and pays their fine because it was an "arrest". It's ridiculous considering what society associates the word arrest with. This just as easily could have happened had he been pulled over for having a tag light out and charged. Same process. It's just an administrative way for the State to be heavy handed and flex. Allows the game warden to stick their chest out at the office too because their "arrest"s numbers were X this month and they got a famous scalp. Ben was likely never in handcuffs. He did what was right and showed up, filled out some paperwork and was out the door with a court date 30 mins later. He will show up at court later, pay a small fine and never spend a second in jail. He has money, so alternatively he can get his lawyer to talk to the head of Fish and Game and do some free public stuff to boost their resource protection efforts and probably get the charge dropped. The use of the phrase tournament fraud seems like complete hyperbole as any mistake anyone made with the rules could be considered fraud legally. It's absolutely over reach and another example of government being about the process and not the People. Break their minor petty offense rules and it's an arrest for fraud. Ultimately the State would have a high bar to prove intent to deceive beyond a reasonable doubt. What is more probable is that he forgot his license expired and will be able to show that and a pattern of having a license in the past, mitigating their intent argument. Before everyone piles on keep in mind that if you've competed in a tournament and even unintentionally broken ANY rule at all it could be labeled "fraud" if you didn't report it. Intent is key and a high bar the State won't likely meet.

I don’t know much about Ben except for his You Tube channel. Although it is a careless mistake a Professional Angler should never make it would seem like disqualification from the tournament and refund of any money received would be proper. Plus a fine for the violation by the State Fish Commission. Unless the entry forms reads that fishing without a license leads to a criminal fraud violation, I can’t see fraud as a fair charge.

@@Parkerson16 I did the research. He entered a couple fish into a contest but didn’t have his license. This happens so much in this particular contest that they let you withdraw the fish so you don’t get into trouble and the contest keeps its integrity. Ben didn’t withdraw. He got his license afterwards and falsified his entries to make it look like his license were up to date at the time of the entries. Since the top prize is 10k it’s fraud. In general it’s lying and cheating. He was arrested and charged with fraud. Not a good role model. Especially if he releases statements lying about it.
His mistake is he should have been upfront about buying a fishing license before turning in the fish, but beyond that fishing with an expired license is hardly something to crucify the man over. Milliken is a talented fishermen, and I enjoy some of his content. He was an early adopter of livescope so that is probably why him and Randy have differences. Nothing to be overly dramatic about.

Could be an issue of thinking he had one license when he had another. Here in Texas there is a year to date license and a cheaper license that ends sometime in August ( regardless of when you buy it). Not making ANY excuses for him, not a fan at f him in any way but it is logical to make such a mistake ( if that was the issue).

It wasn’t “in a tournament”….he caught a Sharelunker and upon entering the information realized one of his probably 15 fishing licenses had expired….he renewed his license but because they give away 10K a year for to a Sharelunker entry it was considered tournament fraud. It’s more of a raffle really.

On one hand, I can't say i'm surprised he got arrested. Here we can hear about out-of-state Texas trophy hunters that can’t buy a simple fishing license or tournament directors from the “best” league getting into fights with anglers at family restaurants (still waiting for the BNN take on that event). There’s always a story that uplifts, whether it’s Randy doing one of his biggest “A-Hole” series tales or a story from the Jealousy Archives, where we learn that the sexy shad color is the “worst” because Randy wasn’t the one who brought it to fame (some other guy did that). I really appreciate the insights I get into why gambling with our shared resources is a bad idea. I appreciate knowing that my Ducks Unlimited donations can help support childish bass fishermen taking fish from a DU impoundment to “win” money with Randy’s full throated support. Endless examples… great stuff!
If he had withdrawn the fish from the program there wouldn’t have been any problem. There was a guy last year that entered a fish in the program and then realized that his license had expired. He called and withdrew the fish and they just gave him a warning. Leaving it in could be perceived as deceptive.
Some states arrest for minor offenses to keep those offenses from being ignored, especially by non residents. The State likely wouldn't want to expend money on extraditing on an FTA warrant for no fishing license. The SCOTUS in Atwater v. City of Lago Vista made arrests for minor offenses permissable so long as probable cause exists. The intent here is clearly to ensure he shows up for court and pays their fine because it was an "arrest". It's ridiculous considering what society associates the word arrest with. This just as easily could have happened had he been pulled over for having a tag light out and charged. Same process. It's just an administrative way for the State to be heavy handed and flex. Allows the game warden to stick their chest out at the office too because their "arrest"s numbers were X this month and they got a famous scalp. Ben was likely never in handcuffs. He did what was right and showed up, filled out some paperwork and was out the door with a court date 30 mins later. He will show up at court later, pay a small fine and never spend a second in jail. He has money, so alternatively he can get his lawyer to talk to the head of Fish and Game and do some free public stuff to boost their resource protection efforts and probably get the charge dropped. The use of the phrase tournament fraud seems like complete hyperbole as any mistake anyone made with the rules could be considered fraud legally.
It's absolutely over reach and another example of government being about the process and not the People. Break their minor petty offense rules and it's an arrest for fraud.
Ultimately the State would have a high bar to prove intent to deceive beyond a reasonable doubt. What is more probable is that he forgot his license expired and will be able to show that and a pattern of having a license in the past, mitigating their intent argument.
Before everyone piles on keep in mind that if you've competed in a tournament and even unintentionally broken ANY rule at all it could be labeled "fraud" if you didn't report it. Intent is key and a high bar the State won't likely meet.

Sounds like someone was too busy for his own good. In my state (MN), you can get a fishing license online (computer or phone) in minutes. I'm not sure in Texas you can do that, but I would think you could.

I don’t know much about Ben except for his You Tube channel. Although it is a careless mistake a Professional Angler should never make it would seem like disqualification from the tournament and refund of any money received would be proper. Plus a fine for the violation by the State Fish Commission. Unless the entry forms reads that fishing without a license leads to a criminal fraud violation, I can’t see fraud as a fair charge.

@@Parkerson16 I did the research. He entered a couple fish into a contest but didn’t have his license. This happens so much in this particular contest that they let you withdraw the fish so you don’t get into trouble and the contest keeps its integrity. Ben didn’t withdraw. He got his license afterwards and falsified his entries to make it look like his license were up to date at the time of the entries. Since the top prize is 10k it’s fraud. In general it’s lying and cheating. He was arrested and charged with fraud. Not a good role model. Especially if he releases statements lying about it.

His mistake is he should have been upfront about buying a fishing license before turning in the fish, but beyond that fishing with an expired license is hardly something to crucify the man over. Milliken is a talented fishermen, and I enjoy some of his content. He was an early adopter of livescope so that is probably why him and Randy have differences. Nothing to be overly dramatic about.

The fact that Ben was arrested tells me there is a lot more to this story. And according to Texas, Game Fish, it was definitely more than just fishing without a license. He wouldn’t have been arrested much less fallen under a class felony according to the Game Fish.

Could be an issue of thinking he had one license when he had another. Here in Texas there is a year to date license and a cheaper license that ends sometime in August ( regardless of when you buy it). Not making ANY excuses for him, not a fan at f him in any way but it is logical to make such a mistake ( if that was the issue).
I have licenses in ten different states and they don’t all expire the same time of year it would be pretty easy to mess up plus how dare you catch the kings fish the fact we have to ask permission to fish in a “free” country is disgusting

No judge is going to throw out a ticket for fishing without a license, especially when tournament winnings are at stake. It was probably a result of not paying attention to the requirements of his profession. Not breaking the law with intent. I dont get it.

It wasn’t “in a tournament”….he caught a Sharelunker and upon entering the information realized one of his probably 15 fishing licenses had expired….he renewed his license but because they give away 10K a year for to a Sharelunker entry it was considered tournament fraud. It’s more of a raffle really.

On one hand, I can't say i'm surprised he got arrested. He has a gargantuan ego, so it was inevitable he eventually deluded himself into either doing something so stupid it's illegal, or getting into a physical altercation with someone who didn't tolerate his BS. One the other, I find it hard to believe you don't wish anything bad happens to him given the fact that you were grinning half the video.
Someone getting justice isn't a bad thing. One can be happy that a person like this may be punished, without hoping for unnecessary harm or actual bad things happen.
