Thanks for this. My wife and I agreed that I needed to be protected before we started to build, so we put a usufruct on it. It was an easy process and I am protected for the next 30 years. Seeing that I am 69 , I think I am good for life.
Does that means you had the right to sell away the property if your wife passed away first without need to compete with the wife relative on the right ? Thanks.

Hi James, watched a couple of your videos now as my thai wife and I will be moving over in October (Tak area also) so getting as much information as I can. Very good information about how to put myself on the property didn't know about that so thanks. Just got to build the house when we come out now so looking forward to that and caught your video on tips on building house 👍
Interesting advise as I'm also in the same scenario over in korat. I'm having really bad back issues too. I bought a mattress from home pro few years ago dunipillo 20,000 baht, so not a cheap one but every morning I'm hunched over like quasimodo, and only 39. So i bought a 2 seater recliner from do home 9000 baht and ofter more than not sleep on this which is more comfortable than the bed. One thing i will be getting is a back hyper extension, brilliant i used them years ago for strengthening the core, but been talking about getting one for 3 year now.
Hamstring stretch which also stretches lower back has helped me. Also been drinking loads of olive oil recently and my back is the best it's been, not sure if there's a correlation. Good luck.👍🍺
Thank you Mr James, interesting episode. If I ever make it to TH, I plan to rent a very modest apt/house/condo, since rent is so cheap, and I have no plans to marry or start a family. If it were me, I'd make sure the well cap is thoroughly waterproof, so in the event of flood your pump is protected from sediment/solids damage and water is not contaminated for days/weeks.

This is the first time I’ve seen your channel. Perfect video. I was planning on doing a 40 year lease on the land so this is the info I’m needing. Thanks and subbed.
As for the well-head - these cement rings can often break when being installed and, even if not cemented in position, are liable to break if you try to move them. But they're so cheap just get new ones. Maybe don't have them so high out of the ground (just enough to stop dirt falling in) and perhaps cover the whole thing with a timber or metal "dog-house". Someone else has already suggested sealing it from flood water - good idea... but might not be easy without ending up with an even larger structure above ground level. How deep is flood water in this area - can't be much or the whole plot would suffer.
Hi James good video like most frang everything is on the wife's name although her daughter's name is in the blue book never seen the deeds for any of the land purchased. As for workmen most say they can do something even when they can't all about losing face for say they don't know
Hi James, many thanks for sharing this process and thinking, really interesting. Not heard of this situation, but few of us are in the same situation/country/legal system. Good to see the work arounds.
Interesting vlog James. I understand returning the six plots to one (as was) but I would keep it separate from the house-plot so that, if you (or daughter) ever need cash (foreign studies / marriage etc.) it would be easy to sell the smaller plot. Then just get a usufruct for the house-plot, if doing two usufructs is too costly. I'm not suggesting you do this - just wondering if you considered it... and what you considered the drawbacks.
Nice work James, maybe once you have backfilled the area that has been washed away you could put some gabions on the bank and fill with rocks to hopefully stop further erosion, just an idea :)

This is an interesting video about a topic that seems to be "always in the news". Very well presented. I had been wondering what had happened to you during recent months. Having possessions is a blessing that causes extreme stress. Looks like you have as much smoke where you are as we have here in CM.
What is the price of land in that area? i.e. How much land did you buy and what price did you pay? What area of land is the house you built on and how much was that as you said that the woman selling the land found out how much you paid for your land and was upping the price?
Good informative video again James 👏 when we were looking at land in Cha Am last March, one of the land brokers turned up in a 7 series BMW, which got me on the defensive straight away, gotta be earning some serious coin for one of those bad boys. I've been in the building trade almost 40 years, so pacing out areas for square meterage is nothing new. The BMW lady showed us 3 different pieces of land, all under the square meterage she claimed they were. In one area, she made 10 plots out of 9. Needless to say the Mrs was having none of it. Until we looked at another 6 pieces of land, from another three brokers, I paced out all of them & told them the size of the land before they told me & was on the money every time. I feel sorry for those people who don't know.
Last year I saw a 4-rai plot - 40" frontage and about 160" depth - about 4-rai. But the owner asserted the frontage was 60" and the depth 250" - approx. 8-rai. I asked why he was advertising it as just 4-rai... and/or why he thought the dimensions were greater. He said: he had just had the front and one side fenced and the fencer gave him the lengths... So the fencer charged for 310 ft. instead of 200. Their are "cowboys" the world over. 555.

"...but she won't have any of it..." - That's might be a good reason to rent, as it suggests her primary interest is in her potential assets... But maybe a 'usufruct' solves all. Good luck.
Great video, I’ve just asked the misses about doing a usufruct on her land, not because of the kids, but as you said the circling vultures, whoops I mean the extended family. Have you thought of getting Simone to shore up the banks to avoid losing more of your land

Hey Cousin James - Sorry you and your wife have been arguing. Did you say that the first argument was over the gym? Luckily my wife saw my garage gym in the US before I got over here. She already knows, if we finally build a place, that if she gives me a big gym with a TV and WiFi that I'll basically never leave the house! LMAO!! If not, we're scheduled for C-section on the 9th. Hope you and the lady are doing better today. Have a good weekend, and best wishes to Annie with her studies.
Was the conversion of the lot next door either a all or nothing proposition? Could you have split it into 2 or 3 lots versus the 1? Then maybe sell a lot in a few years to pay off your daughters schooling, or maybe cover an unexpected bill? Just curious… Love the info…I’ll be going through the same situation in the Philippines soon!

great contents reminds me of my time in thailand. my thai wife is also arguments every second day mainly miscommunication keep the content coming james well done
so the usufruct is in your name or joint , i was also advised just to do a usurfruct at the land office not a lawyer who would probably include clauses that only protect an owner and be bias ?
I believe not. You can do one with a gf/fiancé. The following thread and comments might be useful. aseannow.com/topic/171307-everything-you-wanted-to-know-about-usufruct-agreements-in-thailand/
Good idea James put it all in Annie's name and afford her every protection against relatives or a future husband doing what he wants and taking the place off her . She is a good girl and you are a great dad , I am sure she loves you and will look after you . You are securing her future for a time when you will not be there and you don't want to leave a legal mess for her from relatives or a husband who may contest property rights . Good idea in my opinion ..
James what about the step daughter, seems to be some discrimination there if she receives zero! definitely seems very unfair to her. "Our situation is quite complicated" is a phrase you use often...as you say you took the chance, Ha! Ha! usually find that most people create their own problems Gyms should definitely be outside the home in Thailand's climate, better have something built with plenty of air flow with moveable screens
@@jamesabroad8589 I think you'll find a lot of subjects are complicated for you i.e. Passport& of course you dodge my point of nothing for the stepdaughter
Westerners get all worked up about 'owning' land, leaseholds, usufructs etc. My reply is always, do you own it enough? Buy a house in the US (for example, and as a US citizen), pay off the mortgage, then stop paying your taxes. You'll find out just how much you really own the house. Same here in Thailand. If your usufruct is set up properly/well enough to protect you from the dodgy relatives booting you out before you die--you own the house enough. Maybe not in the same way as ownership in the west, but ownership enough.
i DO understand why thailand has the rules to protect thai citizens from forigners exploiting land and housing so they no longer can afford it themselves, but yeah this is hard
A few questions. As this is in affect a gift to Annie; isn't there gift tax or capital gains tax for Annie? What happens if Annie dies before the two of you?
Yikes...I didn't know your wife was a lawyer. You'll be living on the beach if you ever get a divorce 😄 I see the same workmen are there in Thailand that are in the west. I just had a plumber drill into a water pipe the other day. He fixed it right off but more work is now needed that of course he's responsible for but causes a delay in completion.
If you are not familiar with thai property law, culture, religion, marriage, etc..and stops buying landed property especially w-farang guys in thailand kap.🙏
Your long suffering wife has put up with your swimming and your mountain fetishism. Now it's a gym. Truly is a Saint. Miss the walkabouts with Annie. Great Craic 👍
Why SE Asia wont let joint ownership of land of MARRIED forienger is just absurd. My solution: I own a condo in my name. She owns a house on hers. If we split up I get the condo she gets the house.
Just another example of exponential growth and rampant overdevelopment. It is crucial to understand the Exponential Function. 5% growth, yearly, will destroy the environment of Thailand in the very near future. This is inevitable.
Why don’t you sell me the land so I can build a small house and be an annoying neighbour or a nice neighbour with a gym that can be free to use for the neighbours and obviously a pool.
The tractor driver definitely completely usufruct your well. A bit of a soicowboy it seems. Anyway at least you remain sanguine about it mate which is the main thing. TIT and all that.
@@jamesabroad8589 I agree with what your doing ,because if something did happen to your wife , that Thai family would be circling like a pack of vultures for that house . I been here 15 years working in the jewellery game in chanthaburi ,I only invest what I can afford to lose here and the money I make I pump back to my home in wales ain’t no Thai family or girls getting my bounty ha

James... I'm suspicious about you "making changes" to the house so soon after I sent you the link to that special Isan property. Are we about to see corner mounts in your gaff? 😉
Haha yes, corner toilets in all the rooms lol. Would love to take a look at that house actually.😁👍🍺
@@jamesabroad8589 I came across that place randomly and my first thought was "This is exactly the kind of place James would love" lol.
Let’s see after 15 years how this situation will develop.
If I'm still around, I'll update the situation.👍🍺
great contents reminds me of my time in thailand. my thai wife is also arguments every second day mainly miscommunication keep the content coming james well done
Cheers mate. It's been a bit of a bumpy road for me too lol. All the best.👍🍺
James, I Can't see My Wife " Kicking Me Out " Well NOT After 30+ Years.....
so the usufruct is in your name or joint , i was also advised just to do a usurfruct at the land office not a lawyer who would probably include clauses that only protect an owner and be bias ?
that was to buy a house as a single person
Hi great information 👍
Cheers Christopher. Just a bit of a chat really.👍🍺
Hi James one question do you have to be married to get a usufruct????
I have alittle boy with my Thai fiancee
Cheers yes, Getting on a bit, so good to get things in order. All the best.👍🍺
Interesting stuff and informative . thank you !
Cheers, appreciate it.👍🍺
James what about the step daughter, seems to be some discrimination there if she receives zero! definitely seems very unfair to her. "Our situation is quite complicated" is a phrase you use often...as you say you took the chance, Ha! Ha! usually find that most people create their own problems Gyms should definitely be outside the home in Thailand's climate, better have something built with plenty of air flow with moveable screens
Not at all. I don't discuss other assets etc. Just this land and house.
@@jamesabroad8589 I think you'll find a lot of subjects are complicated for you i.e. Passport& of course you dodge my point of nothing for the stepdaughter
Great video, " keep in the light"
Well use that one !
Cannot find the link ?
Sorry mate. Video link here and other info. in the pinned comment at top of comment section. ruclips.net/video/-fDMc1VpJaA/видео.html
You could sell me the small plot where the well is at.🙂👍 Just a thought.
700 baht an hour all in?
Yes, for clearing the land and breaking the well lol.👍🍺
Crispy pork bell sounds delicious now you made me hungry 🙂👍😋
Westerners get all worked up about 'owning' land, leaseholds, usufructs etc. My reply is always, do you own it enough? Buy a house in the US (for example, and as a US citizen), pay off the mortgage, then stop paying your taxes. You'll find out just how much you really own the house. Same here in Thailand. If your usufruct is set up properly/well enough to protect you from the dodgy relatives booting you out before you die--you own the house enough. Maybe not in the same way as ownership in the west, but ownership enough.
Completely agree. It's not 100% how I'd like but good enough for my circumstances.👍🍺
Wow! Thank you.
You're welcome!.👍🍺
With the new Thai law a foreigner can own max 1 rai land. But the foreigner must invest $1 million in Thai economy before can buy the land and own it.
I think the owning land bit was recently thrown out in a parliamentary vote. I might be mistaken.👍🍺
You might be correct. 🍻
Hi James, very interesting video thank you God bless 🙏🍺🏴
Cheers Steve, appreciate it mate.👍🍺
i DO understand why thailand has the rules to protect thai citizens from forigners exploiting land and housing so they no longer can afford it themselves, but yeah this is hard
Yep, Most land would end up in Chinese hands if they were to allow foreigners access.👍🍺
Good idea put property in name of daughter but what if your daughter ends up deciding she wants you both out.
I spoke too soon, you covered that,mi should have watched the whole video before commenting.
A few questions.
As this is in affect a gift to Annie; isn't there gift tax or capital gains tax for Annie?
What happens if Annie dies before the two of you?
That is what the usufruct is for .
Yikes...I didn't know your wife was a lawyer. You'll be living on the beach if you ever get a divorce 😄
I see the same workmen are there in Thailand that are in the west. I just had a plumber drill into a water pipe the other day. He fixed it right off but more work is now needed that of course he's responsible for but causes a delay in completion.
Never been to a beach in Thailand. Yet. 😁👍🍺
You mean that Tractor Maniac has no liability insurance to cover damages?
Not in this neck of the woods lol. 😁👍🍺
555...!
If you are not familiar with thai property law, culture, religion, marriage, etc..and stops buying landed property especially w-farang guys in thailand kap.🙏
Great video mate
Take her for a meal and make up 🙏🙏
Went for a SomTam which helped a bit.😁👍🍺
Your long suffering wife has put up with your swimming and your mountain fetishism.
Now it's a gym.
Truly is a Saint.
Miss the walkabouts with Annie.
Great Craic 👍
Cheers, yes will do more with Annie in the holidays. She's very busy at Uni. At the moment.👍🍺
Parden the pun but don't dwell on the well. Sawasdee Kap.
😁 yes, All the best.👍🍺
Didnt happen to you. But it definitely happens.
It happens quite a lot by the way .
Yes, but not as often as people think in my opinion.👍🍺
@@farangutan6773 I wouldnt jump out of a plane if I knew 25% of the time it ended in failure.
Why SE Asia wont let joint ownership of land of MARRIED forienger is just absurd. My solution: I own a condo in my name. She owns a house on hers. If we split up I get the condo she gets the house.
@@jamesabroad8589 I wouldnt jump out of a plane if I knew 25% of the time it ended in failure.
I've got a bad feeling about this...
My girlfriend is always yelling at me, better than a dog or alarm.
Yes, I hear you.😁👍🍺
Not for anything I think the united States is the best anyone can buy a house and the land that's coming with it.
Ha ha ha ha ha ha ha ha . . . . What do you own😂 🤣😂 🤣😂 🤣😂 🤣😂 🤣😂 🤣? Bro you dieting?
Healthy food and no beer. Not sure how long it will last lol.👍🍺
Omg you got a housing development at the back now.
Yep a small one. My builders project.👍🍺
Just another example of exponential growth and rampant overdevelopment. It is crucial to understand the Exponential Function. 5% growth, yearly, will destroy the environment of Thailand in the very near future. This is inevitable.
👍🏻😎
How much are those houses at the back of your house selling for?.
1.9 million. 8 houses.👍🍺
@@jamesabroad8589 cheap....thanks.
Hire a Guy with a Chain saw and Burn the Area ! Sell the Wood back to the guy ?
Didn't have to use a makro in the end, but might well do that with the big trees on our main piece of land.👍🍺
Why don’t you sell me the land so I can build a small house and be an annoying neighbour or a nice neighbour with a gym that can be free to use for the neighbours and obviously a pool.
Always up for a pool party mate.😁😎👍
@@jamesabroad8589 I see you got you gym sorted,
The tractor driver definitely completely usufruct your well. A bit of a soicowboy it seems.
Anyway at least you remain sanguine about it mate which is the main thing. TIT and all that.
Yep, only way to be. He's a local guy and jumping up and down about it wouldn't have done me any favours.👍🍺
Use a lawyer, Or trust your Thai wife
She is a lawyer.😁👍🍺
Clearly you trust your wife’s Thai family to be hastily shifting ownership of the home ,to your daughters name 😂 …
We've been thinking of doing it since Annie was young but now she's nearly 20 we thought it was about time.👍🍺
@@jamesabroad8589 I agree with what your doing ,because if something did happen to your wife , that Thai family would be circling like a pack of vultures for that house .
I been here 15 years working in the jewellery game in chanthaburi ,I only invest what I can afford to lose here and the money I make I pump back to my home in wales ain’t no Thai family or girls getting my bounty ha
Just build an outdoor gym, you've got plenty of space.
Can't do much in the smokey/hot season unfortunately. Trying with Aircon for the first time and it's lovely.👍🍺
Your wife moving in look out
Need to be on best behaviour.😁👍🍺
Massive bit of land....grow some fruit trees or put a new house on it.
Water supply is always an issue in this area. We might develop it in the future.👍🍺
Dude you are done. Once that house is built your gone. You definitely will be crying soon enough
I built it 21 years ago, no problems with the missus.
You need to fence off your new land.
You can own a leasehold of the house ....give the land to your daughter.
Leaseholds aren't as binding legally as usufructs. 👍🍺
Get your wife to write a Will.
Yes she did, but this is more concrete in terms of keeping things out of dodgy relatives hands.👍🍺
I bought my ex gf a small house in pattaya and car and she got a new girlfriend after that. She got a new baby now from another new man....typical thai woman.
It's a shame us falangs leave our brains in the airport. But they certainly know how to take advantage of our good nature
@@ryanlewis2742 we play fair....they do not.
Thai people only care about money and their parents.
I learnt that living in thailand for 6 years now.
Boyfriends and husbands are just cash cows to them.
Tell your daughter find a rich boyfriend to marry that has a house or two....lots of rich people in thailand. My sister in law just bought a £125k porsche macan
She's very independent and can make her way by herself. 👍🍺
I never married and will never any woman....i have a partner and two kids with her....she kicks me out every 6 weeks from her family house....so no way is she getting a house from me.
