  • You might have had to deal with this. You walk out to find your car or truck has been towed. It happens - but if you think it’s an illegal tow, what can you do? One South Florida solution is to call Help Me Howard with Patrick Fraser.

    It was a blessing that his van got towed.. now he’s famous and i think he going to need to expand his business..

    So if one of their renters called a cleaning company to clean their furniture or carpet, you're going to call the towing company and have them towed? That's just wrong!

    It worked out for this guy. But I'll bet anything the towing company took his magnets off the van themselves. Then took a picture showing the lettering was visible, then towed it.

    Association is a key word. Their rules are in favor of them, not the residents.

    Tow companies are unscrupulous; bet they removed the magnets to make a quick buck. Apartment complex/management company did the right thing, though.

    i do wonder if maybe someone stole the giant magnets..... people steal stupid things all the time. maybe thats why they said there were none.

      Why would anyone steal them? It is much more likely that the tow truck operator took them off and threw them away. So he could make another tow.

      No chance in hell the parking enforcement/tow company would agree to replace the magnets out of the kindness of their hearts if they hadn’t taken them in the first place. Keep in mind the language they used “there were no magnets BUT EVEN IF THERE WERE you can’t have your vehicle here.” In my line of work (attorney, now a judge) that’s the same as an admission. There’s an old saying, if you hear the sound of hoof beats approaching, the sound isn’t coming from a running zebra. It’s a horse (the most likely solution is the right one)

    How was there no security cam footage of the tow company towing the van. A nice complex like that obviously has cameras in the parking lot.

    I lived in an apartment complex and they said I couldn't have my tow truck in there I also refuse to do any jump-starts or tows out of there either rules are rules

    Depending on how the rules are actually worded, it may actually be illegal for them to tow it, or any similar vehicle for being a "commercial vehicle".
    I had a similar fight with an HOA, though I never got towed.
    There bylaws banned parking "commercial vehicles" overnight.
    Just one thing, "commercial vehicles" are a specific legal thing, with their own sets of regulations and licensing requirements for drivers.
    Vans like these are not legally defined or registered as commercial vehicles, so any rule against "commercial vehicles" does not apply to them.

    Tow Truck game even stretching into snatching cars from apartment complexes,
    chain fast food joints and pharmacy's for expired tags (even if by one day).
    Owner often has the tag, but yet to attach it. Be on alert for lookouts lurking about
    parking lot's. Ponder why $$$ businesses decide on which tow outfit to do bizz wit?

    I have a problem with the management company subrograting the decision to tow. Particularly if the monitoring company profits from the tow!
    It's like law enforcement subrograting the issuance of traffic tickets to a company that owns, installs and operates traffic cameras, profiting from each "ticket" they issue. Is this legal? I have no problem with a ticket from law enforcement, but a "ticket" from a private company is nothing more than a gnat flying around me.
    Just because something may be legal, doesn't make it right.

    The towing business is one of the last mafia style business. They operate on the fine edge of the law. Do anything you can to not have your car towed. They are also in cahoots with police dispatchers making prosecution difficult unless you hire a layer.

    Tow companies have the right to take any car at any time they so choose and nothing you can do about it but pay them or they get a free car .

      Tow company has no rights to the private property of others, nor does the city or business with public parking...
      A business that is open to the public may limit time spent on property - may bill for use of property for time over limit.
      However, they should never tow the property of other's. Tow company should only be towing cars by owner request, are acceptable accident removel.
      Point - until you have due process, it's thief of private property. That's a criminal act...

      The person who is the one who own the car was a sleep - so who would he shoot after the fact of the crime?
      The tow company owner?
      The tow Driver?
      The ass who wrote the rules?
      Are himself for believing he could trust a HOA?
      This only make clear why you never buy/rent into a HOA....
      So again who would you blame - yourself, the land owner, the property management company, the tow truck driver, the tow company or the ass hole that allow bullshit rules in the first place!

    Tow company got a call from the monitoring company to do a job. They did. They didn't do nothing wrong. They were hired to tow a car with permission from the property decision makers. So they actually deserve to get paid for their service. It wasn't their property and they didn't have the decision to tow. They simply did a job they are hired to do by someone who had the authority to make that decision. If anything it falls back on the management company or the monitoring company and they did the right thing. Probably because they got a call from the news channel it the lawyer and they got scared but either way they ended up doing the right thing. Water under the bridge. It's over with. No over needs to sue anyone like state in these comments. It's a mistake that's been fixed.

    SERIOUSLY, SCREW THIS GUY. He wants to be an exception to the rule. I live in an HOA. The rules are clear. No Commercial Vehicles overnight. Period. Why? Because without this rule, could be carpet cleaning or could be a lawn service, they will make noise early in the morning when they head to work. Sometimes checking equipment. Sometimes, having employees meet them at the residence who park their cars and take up spots. Employees that do not live in the HOA and don't care who have loud cars and blast their stereo at 6:30 in the morning because the HOA rules don't apply to them. I have to pay for and office. He needs to pay for an office and/or a secure place for his work vehicle. It is the cost of doing business. I do not care about anything else that is going on in his life. He needs to park his work van at his office or at a secure storage facility LIKE EVERYONE ELSE.

      Did you actually watch the video? The property owner let him move in if he covered the writing on his van with white magnets (0:50). He did that, but got towed anyway. That's a breach of this agreement and it's NOT in any way his fault.

Not a place to park your lawn service and run your lawn mowers before you start work early in the morning. Not a place for your employees to park their cars. Not a place to park your work van, whether you work for a company or yourself. If I wanted to live next to an industrial park, that is where I would of bought a home.
