    In an interview that will no doubt be criticized by the Modi government and its supporters and very possibly also annoy them, one of India’s foremost legal scholars has said the Modi government is interfering in judicial appointments adding “it happens in many ways - subtle, not so subtle, explicit or implicit”. More importantly, Prof. Mohan Gopal adds this interference is happening because “this government (has) an explicit mission to overthrow the present Republic and establish a Hindu Rashtra”. Therefore, going one step further, he says “it will be very dangerous to give this government … any role in judicial appointments”. He concludes “we must preserve and protect the Collegium because that is our best hope for now.”

    This interview really shook my faith in literary and civilised society of this independent nation. Have lived full life but what our children/grand children are going to face is really very scary.

      I worry about children who are witnessing divided and intolerant views. When they see it all-around it maybe normal for them as that is what is around them.
      When old their parents and others may get it back not out of spite but that was the normal their children grew up to.
      It saddens me because we grew up surrounded by love and tolerance and without divide.

      ​@@baratthuj Individual judges constitute the court. From a bunch of odd judgements, it's not clear whether there is any entity called SC that stands for anything. In particular, take the judgement upholding PLMA's most draconian provisions. This neither fits with constitutional principles nor with the basic Hindu dharma. This could only be politically driven. I'm not that optimistic that these judges are driven by principles alone.

      @@baratthuj What I meant was even those judges going by theocratic principles should find PLMA antithetical to those principles, even if they don't want to follow the constitution. So, the law cannot be justified based on Hindu dharma was my point.

      @@rigeshyogi oh sorry i thought you meant something else 😂 i agree theoretic judges are really becoming huge problem for the judiciary , i belive judiciary is only tolerating them maybe because they think it could be seen as violation of their rights(theocratic judge) but for me only theocracy i want inside our courts is constitutional theocracy and letting any other theocracy continue is a huge mistake and very dangerous for our country and courts good thing is that their numbers have started to dip down and we are seeing more and more constitutional judges holding key positions in judiciary starting with uu lalit's appointment as CJI , from outside we can only hope things get better over there. lets see what happens in the next hearing of the pmla case such laws really need some serious reforms.

    I am absolutely convinced that there is a 'sanatana dharma' that has been bought into constitution and reduced the constitution to statutory document only.     Thank you, Karan and Prof. Gopal, for this enlightening discussion. It has clearly outlined the judicial framework that the ruling government is promoting to realize their vision of a Hindu rashtra, and how this agenda can potentially be thwarted by the current judicial system. As an ordinary citizen, I could have easily misconstrued the government's move as an attempt to increase their control over the only constitutional institution that has maintained its independence in the face of eight years of rule. However, thanks to this interview, I now understand the larger agenda at play.

      This can only be done when the larger society is fairly literate. Rss Is being able to execute their agenda by forming govt. in states and more importantly at the centre. And how does anyone from the govt at the centre, through the states of U.P and Bihar. Whosoever wins these two states can form the union govt., at least by forming a coalition. And these two states are largely uneducated. For people in these two states in particular religion matters the most. Therefore, there's no way rss can be stopped.

    The Collegium should set a time limit within which the govt should send their decision on collegium 's recommendation and if govt doesn't respect the time limit the collegium should go ahead with the appointment.

    brilliant.. many thanx.. Indian judiciary in recent years deteriorate justice.. instead of and India should have been improving justice with reforms by bringing technology, participation, quality, efficiency, transparency, international standards and processes.. to resolve hugely pending court cases, shamefully large undertrials, languishing justice, inaccessibility of justice to a common Indian etc

    Eye-opening conversation. Never thought we had Ayatollahs on the bench. We could see hints of this in various judgments, but my suspicion was more about coercion by the executive, and some amount of quid pro quo (like plum positions after retirement). How someone can be a judge while violating their oath to uphold the constitution is baffling.

    Why do they wish the future of our country to become bleak and uncertain, by interfering in the Constitution.
    Our constitution of India is very strong, democratic, progressive, protective and non communal foundation based. It has to be saved and preserved by us all Indians.

    Very simple RSS/BJP/Modi/Mohan Bhagwat/Shah, will declare India to be a Hindu Rashtra and replace the constitution with Manusmriti. India will seize to become a secular state. Finally minorities will become a second class citizen.

    Interesting interview. Interesting points on Addendum of Ayodya judgement. I guess the other judges didn't go through the addendum at all. They should have ensured that it is signed and should have endorsed or not based on their own judgement.
