1. Examine the principles and process involved in the extradition of individuals between countries. Highlight the role of international treaties and domestic law in facilitating extraction.
Introduction:
Extradition is a legal process involving bilateral agreements between nation.
A person some time known as a fugitive is returned to the nation from which he fled in order to avoid facing significant criminal accusation.
Principles:
(i) Principle of reciprocity
(ii) Principle of double criminality
(iii) Principle of double jeopardy
(iv) Principle of speciality.
Domestic law:
The British India, extradition was regulated by the United Kingdom’s extraction act (1870), followed by the extradition act (1903), presently the extradition act (1962) regulate extradition of India.
Extradition act (1962):
The Act provides for the extradition of fugitive criminals to India.
The extradition may takeplacein accordance with any extradition treaty with the requesting or territorial state.
Treaties:
Currently India has extradition treaties in force with 48 countries. Further arrangement with 12 countries.
Conclusion:
Extradition is an essential tool not only to render justice but also to test diplomatic ties. However the absence of extradition treaties in many countries become the loophole that fugitive exploit. There is a need to bring about a comprehensive international law relating to extradition.
