- The plaintiff says he rented a room from the defendant, but the landlord won’t return the security deposit. He claims the defendant told him it’s because he let the landlord’s dog out. He’s suing to get the money back. The defendant claims the plaintiff was loud and disruptive, and says the other tenants complained about him.
Case 29-148
Omgoodness i died when he said the dog not allowed to roam around freely but then shows the dog roaming around freely💀😂
😂😂😂
Yes, me too. 😆
😂😂😂😂
Exactly!! The dog rooms free without a leash. He needs to stop being petty
It's like a scene out of a sitcom.
When he said “My dog doesn’t roam free” while the guy is doing the video the dog is roaming around 😂😂😂
If I knew someone was moving that day, I would put the dog in a room, so he can’t get out
HA Connecticut, now it makes sense. Defendant is a clown.
I've had Chinese and Vietnamese neighbors in housing and volume is a CULTURAL thing. It's not done intentionally, it's not ARROGANT lol. It honestly sounds so ignorant too, the way the defendant and the other tenant. It seems like they disliked this man and it doesn't sound like they made any effort to speak to him about it either. I feel like they thought a language barrier would work out in their favor.
The defendant is so arrogant... i am questioning how many time the defendant keep the security deposit for false raison
It sounds like the landlord just chose to blame the tenant for the dog getting out. Unless it's specified in the lease or through verbal agreement that is memorialized through text or email. He should have put that in the lease.
The plaintiff is hilarious 😆 glad he won the case.
When did "arrogant" become a case for the courts?
Arrogant & stupidity! LOL
If I was choosing who was arrogant out of the defendant and plaintiff, I would definitely be choosing the defendant.
As a renter it's not my responsibility to ensure the dog is in the house.
As a human it’s your responsibility!
@Dominik Finley Patrick, dominik looks like the app instapawn works for me to allow us 3 to have a 3some. Now let’s get down and dirty.
Apparently we have to add “no killing my dog” to leases now
Right. He needs to find doggy daycare or keep his dog in his room or something. How annoying is it to have to worry about your landlords dog running out every time you leave the house? Being that other people live there, the dog shouldn’t just be roaming around anyway
It would be your responsibility to not let the dog out. If the dog gets out on his own, fine, but if you let him out it is your responsibility to correct your error.
Defendant is ridiculous trying to argue back.
This defendant got a bunch of people to lie for him. Why couldn’t the boss say that stuff on his own? Then in the video of the guy saying the dog don’t run free, the dog is running free in the background. lol
The other tenant is trying to protect his deposit from the guy with 9 CCTV cameras around the house and phone video apps to the ready. Defendant talking about the other tenants movements in his room that day is creepy as fcuk.
Yeah, it was actually called: Leading. you are not allowed to lead your witness to answer the question like that.
If you have to rent out every bedroom then you can’t afford the house. He had no business keeping the deposit.
Actually, this is by choice. He could easily have 1 tenant renting the house. This is a great way to have passive income while other ppl are paying off your house.
@@heyvern not if you're easily irritated by your renters. That's a huge sacrifice for having passive income as you call it. I know I couldn't do it because I too am easily irritated.
@@heyvern Nothing passive about this guy's income except that its served with a large dollop of passive-aggressive living conditions.
@@a.konadu4010 exactly lol. You can’t get “passive” income while nitpicking your tenants
I was thinking the same thing.
The judge is usually very sharp, but why didn't she ask the landlord, "Why is it your tenants responsibility to ensure that your dog doesn't get out?"
Why doesn't the landlord secure his dog in another area of the house, like a room, a fenced-in backyard, etc.? It is not the tenants job to look after the landlord's dog in my humble opinion. Like the judge always says if it isn't in the contract, then you don't have a duty to do it. I don't understand why she didn't throw this back at the landlord.
That's my question
She has biases sometimes towards certain individuals
She didn't have to say it cause she didn't even rule in his favor.
@@Sherelle216 LOL
I was waiting for the question "Show me in the lease where the tenant is responsible for sitting your dog when you are at work?"
All he had to do was keep his dog inside his bedroom when he was at work or away from home.
The guys are like: When the plaintiff closes the door he slams it; when he doesn't slam it, he must have let the dog out. They are painting him into a corner where he can't do anything right.
THIS!!!
The announcer is so extra 😂
The narrator is just creepy!!
That is probably why they keep him. Lol
ALWAYS
He's awesome 👌
It's what he do
Why would someone else be responsible for his dog? Please he just didn't want to give back his security deposit.
Bruuuuuuhhhhhhhhhhh this defendant is a joke
8:46 As the dog is walking freely about the yard behind him!😂😂😂😂
I couldn't have live there. I stay up all night and I sing karaoke. And cook at 2 -3am in the morning. I would hate to have to go to bed because the rest of the world is asleep.😒
Hope you live in a house because I'd be constantly upset with you singing Karaoke at 2 and 3am. That means that you don't have any respect and consideration for others.
@@jennross6466 Well if my neighbors can smoke weed 24hrs a day and make me sick. They don't have any respect so then they can listen to me sing. And I respect people that show me some respect.
:)
I don't get the dog stuff. How is the dog the tenant's responsibility? If you live with the tenants and the dog is with everybody, keep him in your room. If you live in a separate place from the tenants, then keep the dog with you. It's not their responsibility, even if they leave the door open.
I don't get that if he saw the video, why he didn't just text or call the plaintiff and say you let the dog out, can you put him back in.
That landlord is some piece of work
The dog is running around unattended 8:38 minutes in behind the other resident being interviewed. That's case closed for me. Give him back his security!!!
😂😂😂😂
This case was so bizarre! Email isnt written notice! And I don't care if they guy let someone's children out, you can't keep his money because that doesnt violate a lease!
The landlord really be looking like Creed Bratton from the office tho
The dog looks like he’s saying, “I’m over this nonsense.”
Not known to roam around
..Noah strolls in🐕
So the defendant thought he could withhold the entire deposit because: (A) Plaintiff let the dog out. So what? It's not like the dog was killed, it was fine. (B) Plaintiff used a space heater in violation of the lease. That is a reason for eviction, but it's not a reason to withhold a security deposit, unless the heater actually did some damage. (C) Defendant had to come home and miss some work to put the dog back in. But, he never even attempted to contact anyone who might be at the house? If there was an emergency at my house (and a dog being potentially killed by a bear is definitely an emergency), the first thing I'd do is call everyone who might even possibly be there. Defendant knew that plaintiff was moving out that day, so it was quite likely he would be there. Why didn't defendant call HIM? I think defendant just didn't like plaintiff and was looking for any excuse to not give him his money back. JM made the right call here. Lastly, I'll never be able to have roommates because I'm up until 1:00 or 2:00 a.m. or even later every single night.
He sure went through a lot of trouble just for six hundred bucks, give the guy back his deposit fool.
It’s the landlords’ dog! It’s his job to make sure the dog is secure when he is not home. I do that for my pups.
That landlord is a jerk. Dogs have a way of sneaking out even if the humans are being as careful as possible not to allow them to go out. And besides it’s the landlords dog it’s not the renters dog so really it’s not the renters problem.
The plaintiff looks so angry. His eyebrows look like the creators of South Park drew them on to animate how angry he is.
The Judge was off on this one. Security deposits are for damages to the home; even if the tenant let the dog out and he lost wages from leaving work, that had NOTHING to do with the deposit!
@rapheALtoid No, he did not. He only got half. Maybe you should change the “toid” in your name to “turd,” so it can be more accurate. Ijs 🤷
Watch again. He got his 300 back that the guy kept for loss wages. The reason he only got half is because he was suing for double his deposit. In some states you can sue for twice if the landlord does not give you written notice on why they are keeping it. He proved he sent an email therefore the judgement was cut in half of what he was asking.
@@KamalasNotLikeUs lol i guess you were not paying attention. He's security deposit was $300 but he was suing for $600 (he doubled it) because that state law says you can sue double for the deposit if the landlord did not write an invoice/reason why he is withholding the deposit. Since he (defendent) emailed him then it no longer is doubled but he does not have any reason to withhold the original deposit.
@@KamalasNotLikeUs He was suing for double the security deposit b/c in some states if the landlord does not give you a break down of why they are keeping security deposit within a certain amount of time, you are entitled to double the amount of the security deposit. The landlord sent an email so he was not entitled to double security deposit.
@rapheALtoid I never said the deposit wasn't returned; I was wronging the Judge for not explaining that the deposit can't be dinged for something like that. She should have dismissed that argument right away.
The way the plaintiff keeps mean mugging the defendant 🤣😂 if looks could kill!!!
A Slammer! Come on, I’m married to one,& today is our 40th anniversary! Can’t we all just get along. RESPECT!🧘♀️
Human race is not evolving, seem to be de-evolving. Sad, be nice if people stopped with the "me syndrome" (that's what I call it lol)
Cabinet door bumpers! You can get 100 of them for less than 10 dollars! Cabinet slamming problem solved :)
I'm a slammer. I didn't notice this until my fiance told me. I didn't know that was like...a done deal for people.
Oh my gosh....I shared a house a few years ago with a woman named Michelle C who was a slammer. Presses, fridge, room doors, front door....all hours of the day and night! 😂
It really seems like the landlord just doesn’t like the tenant.
First we have to pay extremely high rents, now they want us to dog sit too!?!?
No one is responsible for your dog
The dog is not the renters responsibility. The defendant should have just gave him back his deposit 😂 he made the problem more difficult than it needed to be
That defendant was shady as fuck. Everything that came out of his mouth made no sense. I wouldn't rent shit for him. He can't even keep his dog in his house 🤦♂️
I think the dog should have testified!
Douglas sure got some cakes 🎂👀👀👀
I’m glad to kno I ain’t the only one that’s been 👀
If I knew there was a bear in the yard previously...you'd see me come outside and look around for the bear before I got too far from the door.
The dog roaming in the video was priceless!!! Hahahahahha
Even if the dog had gone missing and it was shown that the plaintiff had caused that and knew about it, I don't think the landlord can withold security for that. He'd have to sue from his side.
I think you are exactly right!
Exactly! They are 2 different things
I agree the deposit is for either damage to the house or a mess, etc. when the renter leaves or to pay for rent that hasn't been paid. It seems like a lot of people think that they don't have to pay last month's rent because they have a deposit. That's ridiculous, since the deposit is supposed to be reserved in case you leave the place a mess or damaged or both.
Should’ve been given $600 not $300
That golf bag holder lives in CT, oh boy Mr uppity! He tried to get lost wages... fool. Even I knew he was wrong.
I wasn’t ready for the defendant’s voice
Guy's all wound up he allegedly let the dog out when there had been a bear in the yard just days before yet he has loaded bird feeders on his property to entice the bears over.
A door closer might be helpful in a situation like this - that way the dog's not getting out unless somebody's opening the door...
“ HE IS A SLAMMER”😂😂😂
That plaintiff should be an actor. He has great facial expressions, and he is tall and handsome.
I thought I was the only one who thought he was handsome. I was sitting here like "It's something about him.." 😏😅
@@madmuziq 14:20 ~ Not only is he handsome, he towers over both the defendant and Mr. Doug Llewelyn! There’s something about him that makes me feel like he has a beautiful aura.
In what world can you withhold a security deposit cuz a tenant let your dog out by accident??? Or because someone used a space heater? There are no damages.
I think it showed his pettiness in his letter of intention to keep deposit. When he said a date for the $3.00 that he had calculated in the $303.00 damages was to be put into his bank account. I wouldn't rent a room or anything from him ever.
A world where the landlord is incredibly ignorant of the law regarding what a security deposit is for and what it can be withheld for
The judge called the plaintiff 'sweatheart'. I mean really.
Shane is so attractive,to me. Those dudes are totally jealous of him,in my view. Shane,is clearly being bullied by these insecure, jealous guys. Proud that Shane sticks up for himself. Sexxxxxyyyy Shane!!!
Who's Shane?! The defendant?! Caz he is awful
@@mariaisupov6401 she's probably commenting on the wrong episode.🤣
Seems they were being racist against the Asian man...I thought it was telling when, he said there was a near outside...usually IF you hear that every time you walk out YOU would check...bears are quiet fast animals. I didn’t find it odd he looked around
THAT WHAT I SAID
I didn't feel anything in this case was due to racism.
@@granitemoss1451 OK
GOODNIGHT TO ALLL
@@granitemoss1451 I KNOW IT
The defendant is a slimeball.
The plaintiff said to Doug that he wasn’t sure if the dog was out. There is an easy way to be sure. Look inside and see if he’s there. If not…. 😂
The Chinese guy should definitely get his deposit back.
Who let the dog out whoot whoot whoot whoot 🤣😭
Who knew caddys were balling
I was thinking the same thing!😂😂
He isn't and that's why he rents out every room in his inherited house and stiffs ppl for their security money
This why I don't have roommates too much drama.... Just rather be by my self
The tenant sounds like he was very inconsiderate towards others living in the house. He is loud, arrogant, heater in his room when not supposed to, and lets the dog out knowing it could've got hurt or possibly killed by a bear. The landlord should've given him his deposit back and then he wouldn't have to deal with him again in court. Would've been worth it.
Some lame excuse of keeping the plaintiff’s deposit. Entitlement? Privilege? Ok
There was a whole lot of fluff in this episode to make a story because a security deposit is for damages or rent. A deposit has nothing to do with letting a dog out of the house or lost wages. The only explanation for the judge not explaining that earlier is that they needed a 20 min episode lol because the defendant made absolutely no sense in this case.
It's John Locke and Jin from Lost 🤣🤣🤣
Security can be withheld only for rent and damages. That's it.
Letting the dog out, whether maliciously or negligently, when he knew there were bears around, and he knew the owner was at work....and not trying to get the dog back into the house or even notifying anyone? That's a real jerk.
If a bear had killed the dog, it would be a whole different case.
"He's a jerk" is not a good defense.
The dog was not harmed (thank goodness), and he had no concrete proof of inflated electric bills or lost wages. I can't believe the landlord thought he could win.
Yeah but he couldn’t prove anything so it really wouldn’t have been a different case
Dog case defendant is the one who's arrogant.
Plaintiff looks like a character from South Park
The announcer is doing the most.
Why did he only get half? Even if he let the dog out, there's was no damage, injury etc. Defendant has videos of his beer buddies pretending to be his boss etc. Why is the dog even there?
Noteworthy that the "roommate" said he was arrogant by slamming cupboards. The defendant said the exact same thing. Not a definition of arrogance. Rehearsed and they just didn't like him.
(Judge fumbled this one.)
He got the full amount of his deposit back. His deposit was $300. He was asking for double, but that didn't apply in this is situation because the guy gave him a written reason for withholding it. States that allow you to sue for double only applies if the landlord doesn't provide a reason within a certain amount of days. She even explained that in the video (the defendant emailed the plaintiff within the window). It doesn't matter if the reason is stupid, just so long as the reason is provided correctly.
@@SLHRUclips81 100% wrong. The reason has to be valid. If it is determined that you had no valid reason to hold the deposit, the letter won't save you. I don't know where you got that from. You can look it up in ANY state that allows the practice. New York and New Jersey are notorious for going after landlords who don't have legally valid reasons for not returning deposits. This judge gave the defendant a break, but by law she could have banged him. You must not have heard Harvey at the end explain the ONLY legally valid reasons for withholding a security deposit?
I don’t know what is cuter the bear or the dog
So many people have a bad habit of talking over other people. That’s very rude, and nonproductive. Definitely a pet peeve of mine. 😬
Sounds like my annoying roommate. Inconsiderate, always slamming, disrespectful of my dog
Why tf dude look so confused when he won... 🤣🤣🤣
John Locke over here lyin acting lost when the pertinent questions were asked.
In general, the people that Harvey speaks with, haven't a double digit IQ if you add all of them together.
They either have no idea what he is asking, or are just that thick, either way its discouraging!
where the f**k do they live that theres a damn bear in the yard ? !
The defendant just wanted to keep the deposit but the email explaining the amount plaintiff owed $3 🤡.😂😂😂😂The plaintiff did not have any malicious intent when the dog went out, but it is the owner who has the responsibility to keep his safety, not roommates smh, if he wanted a pet sitter then he should have provided a discount on the rooms he had for rent, or at least have it in the contract they will be expected to certain duties including making sure the dog was inside the house.
I’m surprised that the Judge didn’t ask if he always spy on the tenants. Because he it just happened that I looked at my phone that day. It sounded suspicious to me.
He is not your dog sitter
I would’ve thought a video of his boss stating that he left work and lost the amount of the days wages she would’ve took that into consideration. She said she would’ve took a letter but not a video. Don’t understand
The defendant is so dense!!! He can't get it through his thick head that he could have texted all his tenets to see if anyone was home to let the dog back in the house. I don't find that hard to understand at all! So what's his problem?
Doug needs a sarcasm class
Who let the dogs out? Woof woof woofwoof woof woof.😅 The defendant is a creep. What a pitiful excuse for not giving the deposit back. Its not the renter's responsibility to watch his dog, unless they've previously agreed to it. What a butt, defendant
Milian was really biased against the plaintiff - seemed like she really didn’t like him for some reason. Defendant was really sketchy/clueless. I would have been irate and kicked him out if he let my kitty outside.
First case: WTF!! Lmbo.
The defendant died suddenly, so it's all moot isn't it. The things we care about and then it's over.
Landlords who abuse their power and who are only in it for the money should be blacklisted (put on a special register) so that potential tenants can avoid them. Greedy and unscrupulous; it's written all over their faces...
I already hate this guy showing up to court with his dog
Why would he want to hold the deposit, its not like something happened to the dog.
7:20 objection, leading!
The dog roaming free around the house is very different than the dog roaming free around the yard. Get over it.
Hes a caddy? Not a golfer here, but he is the oldest caddy I have ever seen.
S,lamming doors get on my nerves
Anyone that lives in bear country knows the 1st thing they want is your bird feeders
He probably still could have received double the security because I believe those clauses have a stipulation that if it is unlawfully withheld they can still sue for double. Him accidentally letting the dogs out is not damage to the rented property so that landlord trying to hold the deposit under that circumstance alone is illegal...
She said that in his state he could sue for double if he didn't get written notice for why the deposit was withheld. The landlord sent him a notice explaining why he was withholding the deposit so he wasn't entitled to double even though the judge agreed that the landlord should not have kept the money. That's why he only got back his original deposit
He shldnt be allowed to keep a deposit for smthn that has nothing to do with rent issues.. he can’t just take money for potentially lost wages outta his security deposit.. if he rly wanted to be compensated for lost wages he shld have had to take him to court and file a separate suit for lost wages.. he can’t just take it outta a rent security deposit 🤦🏻♀️😂
I would never buy a house and then rent rooms out to strangers. It defeats the purpose of owning your own home.
