  • The plaintiff says he rented a room from the defendant, but the landlord won’t return the security deposit. He claims the defendant told him it’s because he let the landlord’s dog out. He’s suing to get the money back. The defendant claims the plaintiff was loud and disruptive, and says the other tenants complained about him.

    HA Connecticut, now it makes sense. Defendant is a clown.
    I've had Chinese and Vietnamese neighbors in housing and volume is a CULTURAL thing. It's not done intentionally, it's not ARROGANT lol. It honestly sounds so ignorant too, the way the defendant and the other tenant. It seems like they disliked this man and it doesn't sound like they made any effort to speak to him about it either. I feel like they thought a language barrier would work out in their favor.

    It sounds like the landlord just chose to blame the tenant for the dog getting out. Unless it's specified in the lease or through verbal agreement that is memorialized through text or email. He should have put that in the lease.

      Right. He needs to find doggy daycare or keep his dog in his room or something. How annoying is it to have to worry about your landlords dog running out every time you leave the house? Being that other people live there, the dog shouldn’t just be roaming around anyway

      It would be your responsibility to not let the dog out. If the dog gets out on his own, fine, but if you let him out it is your responsibility to correct your error.

      The other tenant is trying to protect his deposit from the guy with 9 CCTV cameras around the house and phone video apps to the ready. Defendant talking about the other tenants movements in his room that day is creepy as fcuk.

      Actually, this is by choice. He could easily have 1 tenant renting the house. This is a great way to have passive income while other ppl are paying off your house.

    The judge is usually very sharp, but why didn't she ask the landlord, "Why is it your tenants responsibility to ensure that your dog doesn't get out?"
    Why doesn't the landlord secure his dog in another area of the house, like a room, a fenced-in backyard, etc.? It is not the tenants job to look after the landlord's dog in my humble opinion. Like the judge always says if it isn't in the contract, then you don't have a duty to do it. I don't understand why she didn't throw this back at the landlord.

    I couldn't have live there. I stay up all night and I sing karaoke. And cook at 2 -3am in the morning. I would hate to have to go to bed because the rest of the world is asleep.😒

    I don't get the dog stuff. How is the dog the tenant's responsibility? If you live with the tenants and the dog is with everybody, keep him in your room. If you live in a separate place from the tenants, then keep the dog with you. It's not their responsibility, even if they leave the door open.

    So the defendant thought he could withhold the entire deposit because: (A) Plaintiff let the dog out. So what? It's not like the dog was killed, it was fine. (B) Plaintiff used a space heater in violation of the lease. That is a reason for eviction, but it's not a reason to withhold a security deposit, unless the heater actually did some damage. (C) Defendant had to come home and miss some work to put the dog back in. But, he never even attempted to contact anyone who might be at the house? If there was an emergency at my house (and a dog being potentially killed by a bear is definitely an emergency), the first thing I'd do is call everyone who might even possibly be there. Defendant knew that plaintiff was moving out that day, so it was quite likely he would be there. Why didn't defendant call HIM? I think defendant just didn't like plaintiff and was looking for any excuse to not give him his money back. JM made the right call here. Lastly, I'll never be able to have roommates because I'm up until 1:00 or 2:00 a.m. or even later every single night.

    That landlord is a jerk. Dogs have a way of sneaking out even if the humans are being as careful as possible not to allow them to go out. And besides it’s the landlords dog it’s not the renters dog so really it’s not the renters problem.

    The Judge was off on this one. Security deposits are for damages to the home; even if the tenant let the dog out and he lost wages from leaving work, that had NOTHING to do with the deposit!

      Watch again. He got his 300 back that the guy kept for loss wages. The reason he only got half is because he was suing for double his deposit. In some states you can sue for twice if the landlord does not give you written notice on why they are keeping it. He proved he sent an email therefore the judgement was cut in half of what he was asking.

He's security deposit was $300 but he was suing for $600 (he doubled it) because that state law says you can sue double for the deposit if the landlord did not write an invoice/reason why he is withholding the deposit. Since he (defendent) emailed him then it no longer is doubled but he does not have any reason to withhold the original deposit.

      @@KamalasNotLikeUs He was suing for double the security deposit b/c in some states if the landlord does not give you a break down of why they are keeping security deposit within a certain amount of time, you are entitled to double the amount of the security deposit. The landlord sent an email so he was not entitled to double security deposit.

    Even if the dog had gone missing and it was shown that the plaintiff had caused that and knew about it, I don't think the landlord can withold security for that. He'd have to sue from his side.

      I agree the deposit is for either damage to the house or a mess, etc. when the renter leaves or to pay for rent that hasn't been paid. It seems like a lot of people think that they don't have to pay last month's rent because they have a deposit. That's ridiculous, since the deposit is supposed to be reserved in case you leave the place a mess or damaged or both.

      I think it showed his pettiness in his letter of intention to keep deposit. When he said a date for the $3.00 that he had calculated in the $303.00 damages was to be put into his bank account. I wouldn't rent a room or anything from him ever.

    The tenant sounds like he was very inconsiderate towards others living in the house. He is loud, arrogant, heater in his room when not supposed to, and lets the dog out knowing it could've got hurt or possibly killed by a bear. The landlord should've given him his deposit back and then he wouldn't have to deal with him again in court. Would've been worth it.

    There was a whole lot of fluff in this episode to make a story because a security deposit is for damages or rent. A deposit has nothing to do with letting a dog out of the house or lost wages. The only explanation for the judge not explaining that earlier is that they needed a 20 min episode lol because the defendant made absolutely no sense in this case.

    Letting the dog out, whether maliciously or negligently, when he knew there were bears around, and he knew the owner was at work....and not trying to get the dog back into the house or even notifying anyone? That's a real jerk.
    If a bear had killed the dog, it would be a whole different case.
    "He's a jerk" is not a good defense.
    The dog was not harmed (thank goodness), and he had no concrete proof of inflated electric bills or lost wages. I can't believe the landlord thought he could win.

    Why did he only get half? Even if he let the dog out, there's was no damage, injury etc. Defendant has videos of his beer buddies pretending to be his boss etc. Why is the dog even there?
    Noteworthy that the "roommate" said he was arrogant by slamming cupboards. The defendant said the exact same thing. Not a definition of arrogance. Rehearsed and they just didn't like him.
    (Judge fumbled this one.)

      He got the full amount of his deposit back. His deposit was $300. He was asking for double, but that didn't apply in this is situation because the guy gave him a written reason for withholding it. States that allow you to sue for double only applies if the landlord doesn't provide a reason within a certain amount of days. She even explained that in the video (the defendant emailed the plaintiff within the window). It doesn't matter if the reason is stupid, just so long as the reason is provided correctly.

      @@SLHRUclips81 100% wrong. The reason has to be valid. If it is determined that you had no valid reason to hold the deposit, the letter won't save you. I don't know where you got that from. You can look it up in ANY state that allows the practice. New York and New Jersey are notorious for going after landlords who don't have legally valid reasons for not returning deposits. This judge gave the defendant a break, but by law she could have banged him. You must not have heard Harvey at the end explain the ONLY legally valid reasons for withholding a security deposit?

    The defendant just wanted to keep the deposit but the email explaining the amount plaintiff owed $3 🤡.😂😂😂😂The plaintiff did not have any malicious intent when the dog went out, but it is the owner who has the responsibility to keep his safety, not roommates smh, if he wanted a pet sitter then he should have provided a discount on the rooms he had for rent, or at least have it in the contract they will be expected to certain duties including making sure the dog was inside the house.

    I’m surprised that the Judge didn’t ask if he always spy on the tenants. Because he it just happened that I looked at my phone that day. It sounded suspicious to me.

    I would’ve thought a video of his boss stating that he left work and lost the amount of the days wages she would’ve took that into consideration. She said she would’ve took a letter but not a video. Don’t understand

    He probably still could have received double the security because I believe those clauses have a stipulation that if it is unlawfully withheld they can still sue for double. Him accidentally letting the dogs out is not damage to the rented property so that landlord trying to hold the deposit under that circumstance alone is illegal...

      She said that in his state he could sue for double if he didn't get written notice for why the deposit was withheld. The landlord sent him a notice explaining why he was withholding the deposit so he wasn't entitled to double even though the judge agreed that the landlord should not have kept the money. That's why he only got back his original deposit

    He shldnt be allowed to keep a deposit for smthn that has nothing to do with rent issues.. he can’t just take money for potentially lost wages outta his security deposit.. if he rly wanted to be compensated for lost wages he shld have had to take him to court and file a separate suit for lost wages.. he can’t just take it outta a rent security deposit 🤦🏻‍♀️😂
