      You have to be miraculous lucky with "clearly established" rule. In other words, finding a court case in the same jurisdiction that involved almost identical facts.
      The legal system currently treats constitutional rights more as shields than swords.
      ​The Shield (Defensive): If a federal agent enters your house illegally and finds drugs, the "Exclusionary Rule" kicks in. A judge throws the evidence out, and you don't go to jail. In this sense, your right is "protected" because the government didn't get what it wanted.
      ​The Sword (Offensive): If the agent enters your house illegally, finds nothing, breaks your furniture, and leaves-the Shield does nothing for you. You need a Sword (a lawsuit) to get justice. This is where Sovereign Immunity and Qualified Immunity (QI) act as a suit of armor for the government.

      This guy was offered a field sobriety test which he refused, just because he likes attention and drama.
      If he had taken the test, his only issue would have been the ticket for running the light.
      After they are done with it, he still keeps on motormouthing the cop.

      He lives in Poland. I like to watch films about police from other countries and compare them to our European one. Despite the training and professionals of the American police, I have the impression that the procedures here are so strangely complicated. In our country, it is normal that during the check, a police officer may ask you to blow into a breathalyzer. It's okay, because it eliminates potential drunken murderers and no one has problems with it. In Poland (contrary to what the Internet says) drunk drivers are really exterminated. High fines, jail time, confiscation of cars above 1‰ If you have caused an accident or if you have more than 1.5‰. "Sober mornings" are also made here, when after mass events in the morning and at night, the police check sobriety. After national holidays, there are also controls, on weekends... Sometimes even the police line up on side roads (which can be chosen by drunk people to avoid heavy traffic) and stop everyone for a sobriety check.
      In our country, if someone blows above 0.00 (the limit allowed is 0.2‰), a second measurement is made with a more accurate breathalyzer. If it detects something, you wait 15 minutes (to eliminate the false result by eating candy/mouthwash/sprinklers)
      If the next measurement detects above 0.2‰, you are detained to blood tests then u know...
      If you refuse to take a breathalyzer test, the policeman treats you as if you were under the influence. You are detained and taken for forced blood tests. They don't give a fuck whether you want it or not. With the help of a doctor, it will be taken for you. If you turn out to be sober, well... No one gives a fuck. By refusing to do so, you have given reasonable suspicion that you are not sober. No court will help you, because it is only your fault that you have led to such a situation.

      Can you explain to me, how is a police officer supposed to act when they literally see someone speed through a red light, and then are met with a driver that clearly is acting a bit off? If an officer suspects in the slightest the driver may be under the influence or unfit to drive for whatever possible reason, they’d be failing their duty to simply let them go with no further tests. People get killed every day by drivers running red lights, including my mates girlfriend last year.
      This guy deletes comments that are opposed to his warped narratives (which I’d expect from such an individual) so probably not much point to this.
      Most sensible people watch but don’t comment though. 99% of those that comment on RUclips do so because they don’t have a voice elsewhere because most don’t want to hear their nonsense.

The reason, I was confused because the officer keep asking me if I thought he should give me a ticket. As a respectful person with autism, I figured that was his call not mine.
      In hindsight I wish I would have advised him that he may not be mentally fit to be a police officer if he couldn't decide if someone deserved a ticket or not.

When I was a young man, I went to a party of a friend of a friend and didn't realize half of the people at the party were cops -- cop family -- and I said some shit about the police. Unbeknownst to me, the cops all got together and talked about how they were going to spike my drink, beat me up as I went back to my car, then call an on duty friend to do a DUI check when I got to my vehicle. My buddy overheard them talking and we left the party.

Probable cause is when he has enough evidence to arrest without a warrant. There was no probable cause here. Yes, a field sobriety test can be used as probable cause, but a legal refusal to conduct a FST can NEVER be used as probable cause. Not in any state as far as I know. This cop knew he had no probable cause from the very start. He just had a hunch. And his hunch was wrong. And a hunch can't be used as probable cause. His ego just wouldn't allow him to let the guy go about his business.

      Muricans believe something about "probable cause", which is basically "Police asks you to use a breathalyzer so they think you are DUI". Well the ARE ANYWAY.
      Breatalyzers work in EVERY SINGLE other country. But in USA, 10 officers spend the entire night doing subjective tests. If he had not stepped out, immediately 5 cars with officers, dogs and drawn weapons would be involved, he would be tased and violently handled. Arrested for resisting, assault, and 10 other things.
      USA is such a kafka'sk nightmare. Do never go there.

      I'm a Military Policeman, the 100% truthful answer is because having a suspect conduct field sobriety tests gives further evidence of intoxication to help build a D.U.I. case. For example, the smell of alcohol would give me a reasonable suspicion that you may be intoxicated. I could then begin an investigation. The field sobriety tests are how I could establish probable cause for the arrest. Then, if we wind up in court, I could testify all of the things I observed to lead me to believe you were intoxicated. (Stumbling, slured speech, horizontal gaze nystagmus and so on) This would protect me, ensuring I made a lawful arrest. It also provides further evidence that could demonstrate your guilt. It honestly doesn't benefit you to conduct them as it can be Subjective to the what the officer observes. I think this citizen pretty much handled it the best way you can. I think the officer set himself up for a bad case. Obviously, I don't think you should drink and drive, but this citizen definitely exercised his rights appropriately.

      Field sobriety tests is pseudo science.. Breathalyzer are accurate if they are calibrated.. and they fall out of calibration easily… But here’s the other problem with BAC… It only registers correctly if your last drink was 30 min before blowing… For example… no matter your body weight or gender.. if you are dead sober and take a shot of Vodka.. and set a timer of 5 min… You will blow over .08.. A grown man 230lbs will blow over.. So one thing is.. if you have been drinking make sure you buy yourself enough time.. (the 💩 faced drunks won’t be able to pass regardless) but if you have just had a few beers.. make them take you down to the station device to blow into…
      Background here.. I have a personal breathalyzer.. it’s not top of the line.. but when I got it, it came with a bunch of instructions… for instance you can damage the calibration of the machine if you take a shot and blow X amount of minutes after…
      In my humble opinion definitely refuse sobriety tests… take the breathalyzer on the road if you know you’re good.. If you’re 50/50 let them haul you down to blow into the main station machine

      @Ben-fx8lg Here in DK the way things go, and always problem / weapon free: Officer greets driver kindly. Asks for license. Assuming driver has a license, there may be a DUI test. Either this is done as a mass check of all cars on a stretch of road, or that single driver. Officer asks if and when driver had something to drink. If it is very recent, the level may be over (and mind you we have LESS acceptance, with 0.05 BAC). Then driver is told to wait 10 minutes in the car. Test is repeated. The level will have dropped if it's below acceptable amount.
      So YES it is possible to work around the "I just had a beer 2 minutes ago".
      Of course nobody does the clown show of a "Field Sobriety Test" where driver is forced out at gun point, asked to walk a line, recite poems, count backwards while lifting a leg and other stupid things. And at ANY point it is totally at the officers discretion if it is DUI (with absolute devastating consequences in USA).
      The American way is hopelessly slow and ineffective. 10 officers battle 1 driver for literally hours even if the driver is 100% sober. Meanwhile European officers can control EVERY SINGLE of 100s of cars, catching real DUI. And that by using only 2 officers and no reason for weapons out.

    Levi is about to retire from the tax payer of Frederick County. This is the Second time they've done this to him. That whole department needs to an investigation. I cant imagine how many people that weren't as informed as Levi that they've wrongly arrested and neglected. disgusting!

Levi is probably 1 of many victims of false arrests, but he had the ability to recognize it, gather all of the bodycam video and documentation and put the cops on full blast with it. Not everyone knows how to do that, or is willing to go through the process of doing it.

      Nothing in this stop is grounds for a lawsuit. He was lawfully pulled over and refused the sobriety check. And in Maryland as most states they don't have to smell anything, all they need is the way he was acting. He's actually acting more like he's on meth than alcohol though.
