    The claim of "Absolute Immunity" is so absurd that the Federal Court of Appeals should have not only dismissed it, but also have issued strong reprimand and punishment against Don the Con's attorneys who filed such an absurd and preposterous claim. Wasting the time of the court must be punishable by law.

      I recall Mr. Tribe tends to be overly optimistic about legal decisions against Trump. An hour later on CNN John Bolton gave a number of technical reasons why the court might take up the case, describing issues that Mr. Tribe never mentioned or seemed to consider. Imho, we need to stop uncorking the champagne at every step and look at the bigger picture.

    The wording of this decision is great. Over 50 pages of great wording. I certainly wish this case of presidential immunity hadn’t been brought up but this ruling should be final. There are no holes in it. Supreme Court should pass on this and save face.

    Perhaps the one upside to Trumps legal shenanigans is the shaking up and testing of the justice arm of the US concerning the Presidency and insurrectionism. It has really forced the law to be examined in minutiae on things hardly ever previously considered.

    Regarding Nixon. How can someone accept a pardon before they have been convicted? That should not be legal.

      Nixons pardon was for "any & all crimes for which he may have committed," Hence he was able to avoid the embarrassment of any trial. Not a situation very often in occurrence. But the acceptance of said pardon is still an agreement that the crimes did occur.

      @@floydrandol2731 That is being investigated but the difference is that "45" LIED about having them, LIED about having returned all of them and then OBSTRUCTED retrieval of them -- Biden voluntarily had someone search for any documents among his things AND he is the one reporting that he had them and he promptly returned them -- whereas "45" moved some behind a locked door that never got searched but there is VIDEO of his aide doing that. Also, from the classified information "45" had, he told a foreign national, in the presence of others, about US nuclear sub secrets AFTER he was no longer president and not authorized to declassify anything.

At this moment in time, President Biden could send Seal Team 6 into this courtroom, take out your client, you, and other members of this court, and would not have to face prosecution unless he was impeached and convicted by Congress.     AC, you seem to minimize their opinion by calling it "unsigned." It was a per curiam opinion, meaning it was unanimous joined in all aspects by all three panel judges. Use your terms more carefully! According to Wikipedia, "In law, a per curiam decision or opinion is one that is not authored by or attributed to a specific judge, but rather to the entire court or panel of judges."

      @@janejones8672 a good question! I’m thinking probably so. It takes 60 votes to carry this kind of bill in the senate, and while a few republicans will probably vote for it, as in those who crafted it, two Dems have already said they oppose it, because it doesn’t address broader issues.
      What’s amazing to me, is just how big a hit the republicans too today. The Dems have known for a while that if the border is your #1 issues, your not voting for Biden regardless of what he does. They want to cover those Hispanics who are already here legally, who are desperate to close illegal immigration flow. But the republicans learned today that the courts are not going to save trump, and with Johnson demonstrating he doesn’t have control over his own caucus, they’re simply giving up on 2024.
      If Biden doesn’t die before Nov 5th, he’s going to win re-election, the only question is how many others he can draw with him???

    This ruling may be first positive to come out of Ford's pardon of Nixon. It set the precedent that the only other President to be at risk of criminal prosecution recognized that he *could be* prosecuted (and that the succeeding President also recognized that risk).

    Suppose SCOTUS did take up the appeal, and for the sake of expedience simply "affirmed on the grounds stated in the opinion below."? Courts can do that.
    That way, it would not be ducking the issue, in fact, it would be putting finality to it. And they save time and effort, not having to rewrite an opinion which Tribe describes as " bulletproof ". BTW, Tribe is not just some old prof or political hack, his treatise on Constitutional Law was regarded as encyclopedic when I was in law school 40+ years ago. And once thus established as an expert in a field, constant study and research is what keeps one an expert.So he's been studying Constitutional Law, in-depth for all those years since. And he says the Circuit Court opinion is "bulletproof ". These judges have just been given the highest complements by someone who is foremost in the field.

      the defendant has till next week to submit a request for review from scotus. scotus can the either decline to hear it, accept it, or issue a stay while they contemplate taking the case up. and they can take as long as they need or choose. there is no deadline for them.

But keep this in mind: If SCOTUS takes up the case and decides in Trump's favor, they would essentially be stripping themselves of the power they took claim of in Marbury v Madison. They'd be neutering themselves. While I can see a couple of the Justices maybe being willing to do that (I'm looking at you, Alito and Thomas), I don't think 6 of the other 7 are (ACB is a toss-up). We know the liberals and Roberts are solid, and we'd only need either Gorsuch or Kavanaugh to have a sense of occupational self-preservation to pull out a 5-4 decision. Thing is, I think both Gorsuch and Kavanaugh are unwilling to side with Trump on this, and ACB may be unwilling, as well.
      If ABSOLUTELY NOTHING else, the SC is smart enough to realize that if they decide that way for Trump, they're also deciding that way for Biden, and he currently has control of all the levers.
