Initially, this 18 year-old woman appears to have done everything right. She aced the field sobriety tests and refused the preliminary breath test (PBT). She could have beat the DUI charges at this point. She initially said she did not drink any alcohol and could have argued there was no way she would have been served alcohol without a driver's license or ID. Once she was arrested, she messed everything up. She answered the deputy's questions after being read her Miranda Rights. Then she admitted to drinking alcohol. Finally, she submitted to the evidentiary breath test. What is the most surprising thing to me is that the deputy never questioned her about how she got the alcohol. She clearly has a fake ID, but he never questioned her about it. Shaking my head. Comment down below what your thoughts are.
By refusing the evidentiary breath test, She would have automatically lost her drivers license for 1 year. Worth it if she could have successfully beat the DUI. Refusing the EBT also results in being convicted of the refusal offense as well, which means mandatory harsher penalties along with the DUI sentence if found guilty. If your refusal happens within 10 years of a separate DUI violation, your license will be suspended for two years; and if it’s within 10 years of two or more other DUIs, the suspension will be three years in California and Washington. like you said.. with a good lawyer and refusing that EBT, She would have avoided the criminal DUI conviction,

With a .02 BAC there's no way officer smelled her breath stinking. And still stuck it to her with a DUI. This video is absolute proof that once you are asked to do a test, it doesn't matter how well you do, you're getting arrested.

@@mattgowans547 In WA it is 0.08% for most drivers and they are trying to get it down to 0.05% which is basically if you weight 100 pounds and have one drink every 4 hours. Where this girl got pinched was they have a special law for Under 21 drivers that you only have to be 0.02% to be charged with DUI... that's why she seems so coherent... she's not drunk and she's not even buzzed. As someone who doesn't drink and had an abusive alcoholic mom... this is a little nuts.

This is correct. Most of the time they aren't "investigating" they are going through with the required theater. I've heard several lawyers say to turn down FSTs and the PBT and let them take you to the station for a sample if they insist.
That’s because FSTs are not meant to prove you’re sober. They are done to satisfy probable cause for an arrest. You can scratch your nose during the leg raise, And it’s an indication of intoxication! 🤡

I feel the suspect was more coherent than the police officer. he was fumbling on his words and the officer knew from the beginning that she was driving her friends car. She also mentioned that the parents of the owner of the vehicle can pick the car up. The officer talks to the drunk females in the car stating she said her parents can come get another persons car. The cop was clearly lacking any comprehension to even submit a field sobriety. He needed one himself... Just a neutral opinion.

A good DUI attorney easily beats this case with a "Motion to Suppress Evidence" because acing the field sobriety tests took away the probable cause to do a PBT.
Seems like a silly and time wasting way to do things. It can be much simpler: If a driver is suspected of being under the influence of alcohol, Just do the PBT.. If that fails, Then bring them in for an evidentiary breath test.. If that fails, Charge! But If suspect refuses to do PBT, Then bring them in for an EBT.. If they also refuse that, Charge! Job done.
You're incorrect. The PBT has to be done last, you can't do it first because that could possibly taint your evaluation on the FSEs. Not to mention you don't need probable cause to administer FSEs or a PBT, only reasonable suspicion that the driver may be under the influence.

Always refuse the field tests. You are required to submit to a breathalyzer, but not to these stupid subjective tests...and they can't use that against you.

Regardless, the limit is 0.02 to account for mouthwash or other incidentals that may contain small amounts of alcohol that may be absorbed through the mouth or skin without actually consuming an alcoholic beverage. This would more than likely be tossed even with the most incompetent defense attorney.
Ofcourse you don't have a chance when you drink and drive. Good thing this cop did his job instead of thinking it was okay to continue drive because she was hardly impaired. This is about the safty of the public, not about how close to perfect you do on a sobriety test. People need to get the message, you simply don't drink after consuming alcohol, period.

Maybe she was being responsible by having had the least of all her friends, like half a beer 3 hours earlier. She seemed fine. @@FUGP72 She got pulled over for no headlights, and while that is a top sign of a drinking driver, she was driving someone else's car, so it's not out of the realm of possibility that she didn't realize the headlights weren't automatic, just as she states in the video..., so that evidence won't hold up in court, because her lawyer will show she had a valid reason to have forgotten to turn them on. The officer didn't observe any bad driving. The girl performed flawlessly on the FSTs, and in most states, the third digit of the breath test resutls doesn't count, it etiher gets rounded up or rounded down to a 2 digit number, and so hers will get rounded down to 0.02 in court and these charges will likely get thrown out. The officer should know this. It's a huge waste of time. I guarantee you they dropped these charges, or at the very least they let her plea out to a wreckless driving ticket. She wasn't even held overnight. Why wasn't she held overnight? Because she wasn't intoxicated. Her lawyer WILL say these things in court.
If you get pulled over and asked to do FST's your getting arrested no matter what. Best thing you can do is know your rights snd stay quiet. Fight it in court!

In America, honesty is punished. Refusing to do tests, refusing to answer questions, and refusing to comply gets you free, but being honest and truthful gets you behind bars. Horrible, horrible, horrible court system, with zero "justice".

She proved in the test that she was over the limit, after lying about drinking. When she got a license, the DMV book told her those were the limits for under. 21. This officer may have nipped a problem in the bud and saved her or someone else from danger.

@eddiewouldknow She drank underage and was at least a little impaired (given she was driving at night with no lights, something a sober person would immediately notice). And even when she was obviously caught, she still probably wouldve caught a break if she took the PBT which wouldve showed that she was barely over the limit. Her obfuscation actually made things worse. I would definitely say she "deserves" a small punishment for all that: a fine and a 90-day license revocation would suffice.

The issue here though is that the cop could get in trouble if he encounters someone who is drinking underage and driving above their legal limit, and decides not to enforce. That cop is an asshole! I’m a retired law enforcement officer and I have arrested several people for DUI. She passed all her FST. Why would you ruin an 18yr old’s future? Just going through that experience will straighten her up if you will explain to her the full consequences.
yeah i actually saw some other YT videos recently and the driver's appeared perfectly fine and complained that they passed the test while being handcuffed.
She failed the breath test she declined to take. Had she blown a 0.00 she would have been fine. Most of us have driven after drinks at some point but being underage puts you at the .08 disadvantage right away. If she was over 21 she would have been fine.

I used to be Deputy. This video made me extremely angry. The cop wasn’t concerned about the safety of being on the side of the road during the FST’s. He’s only in a rush to get her to the station before that last bit of alcohol leaves her blood. Based on his evidence, she should not have been arrested. He claimed to smell it on her, which I can guarantee is a LIE. I question the integrity of this officer. He should be fired for lying. He’s probably some nerd that never got pretty girls, so he’s taking it out on her. I hope this got dismissed, seeing how he didn’t do the FST’s correctly. I'm not sure if you are coming out in defence of these girls, if so, that's possibly a problem. I grew up around a lot of serious teen drinkers and some could withstand incredible indulgence and show very little outward effects of drinking. I have a sister that could drink adult men under the table when she was in her teens. I suspect that many teens these days have built up a certain level of resistance to impairement. I mean 'jeez', vast numbers of them are weened on a cocktail of drugs and a greater assortment of alcoholic beverges than have ever existed.
Ive never known anyone to actually pass one of these test, no matter how well they do. If they ask you to take one, you might as well go ahead and put your hands behind your back.

The point of the FSTs aren't to put your guilt or innocence in the hands of some pass/fail game. It's to provide extra evidence if you decide to fight the charges. As somebody who was under age, she could have easily been over the legal limit and still "passed" the tests, which is what we watched happen.

@@andrewc673 Yes, it is. The simple smell of alcohol on its own isn't enough for conviction of a DUI, but it is definitely cause for an officer to suspect DUI and to detain the driver for questioning and field sobriety testing.

Probably the best DUI arrestee I've seen. But since she was under 21, it was an uphill battle from the start and her compensating factors couldn't change the outcome.
This is why you should never consent to doing field sobriety tests. At that point, the officer has made up his mind, and he/she is just trying to gather evidence against you. Refuse test and invoke your right to remain silent. Ask for an attorney. Don't try to talk your way out of anything, it will only hurt you and never help.
I felt so sorry for this fine young woman. She was obviously ok to drive as opposed to myself at that age. 73 now, living my whole life without a DUI, and having driven home from Doors, Hendrix, Cream, and Pink Floyd concerts, to name a few in my youth tripping on LSD. Lucky to have never been pulled over.

What a smart and respectable young lady. She passed the sobriety test with flying colors, but she HAS been drinking underage. Hopefully she learned her lesson and the judge will simply let her off with a warning.

Honest to god I’d submit this video to any job interview I applied to if I were her. Really shows how great of character she has. Very polite, took responsibility, obviously wasn’t drunk but took a calculated risk to try to not wait 3 more years to party and lost the bet. We all pushed the envelope as kids every now and then and I wouldn’t hold this against her at all. They need to change the DUI limits to .08 for 18-20 since that’s a grown ass adult.
I agree -- if they are adult enough to vote, serve in the military, and are legally responsible for their choices, then drinking should also apply. In Europe, my daughter was served wine (only about an ounce) at 16 with my permission (school trip with photography club). Either change adult threshold to 21 or lower the drinking age.
I’m not expert, but I didn’t see any evidence of intoxication. Perfect field test. No slurring, imbalance, no trouble conversing or understanding. And, never talk to police, never talk to police, never talk to police.
Yah, it sucks being 18. The FST's don't work for a 0.02 BAC so the cop is basically forced to arrest an underage driver just for smelling alcohol. The only way she was getting out of that arrest was to take the PBT and blow zeroes. And even then he could arrest her because she smells like alcohol and drove with no lights.

My nephew went to college to become a cop. He told me when a cop pulls you over they are looking for any reason to put you in jail. Give the cop as little info as possible. Never drink any booze before driving.

She is so intelligent and sweet. She told the cop early that she didn't wish to incriminate herself and he's continued to question her. She is 18 and so composed. This cop is polite, but not very competent.

She even said it wasn't her car and the car she usually drives has lights that automatically turn on. If she and her friends had remained silent and if she hadn't taken the breathalyzer test, she likely would have won in court.
20 years ago you only saw females dressed like this in magazines. It’s crazy what young woman and sometimes very young girls are wearing. 12 and 13 year olds dressing this same way. Like wtf? I remember in high school they used to measure the girls dresses to make sure they weren’t too short. You couldn’t show your belly button. This wasn’t 1950. This was the late 90’s. I've seen a lot of videos from this department, and they are not required to keep them in handcuffs once the get into the DUI testing facility. One of the officers actually talked about it in another video. This officer could have taken her out of the cuffs along time before he did.
i can tell you for a fact, this girl lived an hour away from where this took place, and this officer, who had a friend on a ride along with him, offered to give this girl a ride home, which she refused. She called her parents, and they drove the hour to come and get her. A judge also saw the body cam footage and all charges were dismissed. Another side note, when the parents showed up to pick her up, the gentleman who was on the ride along hid behind some bushes. It is my belief that the cop and his friend intended on trying to scare and confuse this young lady, and they were going to try and get a quid pro quo out of her. you do this, and we will throw all this out. She refused and called her parents who drove to pick her up. i believe this cop was up to no good, and was most likely hunting for a young target, as this is a college city that comes alive at night from the student body. someone would be smart to request all this guys body cam footage from all stops, big and small. again this is my feeling

This cop seemed determined to make sure she was arrested. What was the point of the giving her the tests just to arrest her whether she passed them or not? So stupid man. Could've given her a warning and had her call her mom or something instead of having the car towed and everything else. I feel bad for this young girl. This is bad policing. In my state you are not under any obligation to take the field breathalyzer. She was not read her rights when she was initially arrested. She had previously told him she was uncomfortable being questioned.

This women was not impaired, yet was arrested and charged with being impaired based on a "i said so" technicality. 0.08 and below is the limit considered safe by the state (not considered impaired to drive) BUT if you are even 1 day than under 21, they lower that to 0.02 (well within the safe limit by their own standards) even though BAC is a % and therefore the same regardless of body size AND AGE. She performed those field sobriety tests flawlessly and gave no indication of being impaired. Likely, this cop was taking a chance, that he knows he can get away with, to accuse her, and hoping for the best (for him). The breath test was 0.026... she was obviously not impaired, just victim of a preda tory legal system that charges people for things they did not commit, depending on "crime" for the livelihoods of its operators. Because he had a hunch based on his experience and he was right. Say he didn't pull her over and allowed her to drive with her lights off and she hit you or a loved one? He detected the scent of alcohol in the car and he did his job.
FSTs are confirmatory, but they aren't used to rule out anything. From what I have seen, if they are going to test you, they have already made the decision to jail you. They just are trying to build a bigger argument in court. It's not for the benefit of the suspect.
My hunch is she had a fake ID in order to get into the bar and buy drinks, but she can't present that to the deputy, so she tells him that she forgot her ID.

You can't *pass* the tests, they are purely evidentiary in nature and designed to find people 0.10 and above. They would be useless in this case since some underage is in violation at .02 or above.

Initially, this 18 year-old woman appears to have done everything right. She aced the field sobriety tests and refused the preliminary breath test (PBT). She could have beat the DUI charges at this point. She initially said she did not drink any alcohol and could have argued there was no way she would have been served alcohol without a driver's license or ID. Once she was arrested, she messed everything up. She answered the deputy's questions after being read her Miranda Rights. Then she admitted to drinking alcohol. Finally, she submitted to the evidentiary breath test. What is the most surprising thing to me is that the deputy never questioned her about how she got the alcohol. She clearly has a fake ID, but he never questioned her about it. Shaking my head. Comment down below what your thoughts are.

By refusing the evidentiary breath test, She would have automatically lost her drivers license for 1 year. Worth it if she could have successfully beat the DUI.
Refusing the EBT also results in being convicted of the refusal offense as well, which means mandatory harsher penalties along with the DUI sentence if found guilty. If your refusal happens within 10 years of a separate DUI violation, your license will be suspended for two years; and if it’s within 10 years of two or more other DUIs, the suspension will be three years in California and Washington.

This is correct. Most of the time they aren't "investigating" they are going through with the required theater. I've heard several lawyers say to turn down FSTs and the PBT and let them take you to the station for a sample if they insist.

I feel the suspect was more coherent than the police officer. he was fumbling on his words and the officer knew from the beginning that she was driving her friends car. She also mentioned that the parents of the owner of the vehicle can pick the car up. The officer talks to the drunk females in the car stating she said her parents can come get another persons car. The cop was clearly lacking any comprehension to even submit a field sobriety. He needed one himself... Just a neutral opinion.

A good DUI attorney easily beats this case with a "Motion to Suppress Evidence" because acing the field sobriety tests took away the probable cause to do a PBT.

Seems like a silly and time wasting way to do things. It can be much simpler: If a driver is suspected of being under the influence of alcohol, Just do the PBT.. If that fails, Then bring them in for an evidentiary breath test.. If that fails, Charge!
But If suspect refuses to do PBT, Then bring them in for an EBT.. If they also refuse that, Charge! Job done.
You're incorrect. The PBT has to be done last, you can't do it first because that could possibly taint your evaluation on the FSEs. Not to mention you don't need probable cause to administer FSEs or a PBT, only reasonable suspicion that the driver may be under the influence.

@@FUGP72 She got pulled over for no headlights, and while that is a top sign of a drinking driver, she was driving someone else's car, so it's not out of the realm of possibility that she didn't realize the headlights weren't automatic, just as she states in the video..., so that evidence won't hold up in court, because her lawyer will show she had a valid reason to have forgotten to turn them on. The officer didn't observe any bad driving. The girl performed flawlessly on the FSTs, and in most states, the third digit of the breath test resutls doesn't count, it etiher gets rounded up or rounded down to a 2 digit number, and so hers will get rounded down to 0.02 in court and these charges will likely get thrown out. The officer should know this. It's a huge waste of time.
I guarantee you they dropped these charges, or at the very least they let her plea out to a wreckless driving ticket. She wasn't even held overnight. Why wasn't she held overnight? Because she wasn't intoxicated. Her lawyer WILL say these things in court.
If you get pulled over and asked to do FST's your getting arrested no matter what. Best thing you can do is know your rights snd stay quiet. Fight it in court!

And even when she was obviously caught, she still probably wouldve caught a break if she took the PBT which wouldve showed that she was barely over the limit. Her obfuscation actually made things worse.
I would definitely say she "deserves" a small punishment for all that: a fine and a 90-day license revocation would suffice.

The issue here though is that the cop could get in trouble if he encounters someone who is drinking underage and driving above their legal limit, and decides not to enforce. That gets into a dangerous area of letting individuals choose which laws should be enforced and which ones shouldn't. The rules should apply to everyone equally.

That cop is an asshole! I’m a retired law enforcement officer and I have arrested several people for DUI. She passed all her FST. Why would you ruin an 18yr old’s future? Just going through that experience will straighten her up if you will explain to her the full consequences.

I used to be Deputy. This video made me extremely angry. The cop wasn’t concerned about the safety of being on the side of the road during the FST’s. He’s only in a rush to get her to the station before that last bit of alcohol leaves her blood. Based on his evidence, she should not have been arrested. He claimed to smell it on her, which I can guarantee is a LIE. I question the integrity of this officer. He should be fired for lying. He’s probably some nerd that never got pretty girls, so he’s taking it out on her. I hope this got dismissed, seeing how he didn’t do the FST’s correctly. A good attorney will make this cop look stupid.
EDIT: He also never read her Miranda Rights to her. I hope her attorney was smart enough to see that.

I'm not sure if you are coming out in defence of these girls, if so, that's possibly a problem. I grew up around a lot of serious teen drinkers and some could withstand incredible indulgence and show very little outward effects of drinking. I have a sister that could drink adult men under the table when she was in her teens. I suspect that many teens these days have built up a certain level of resistance to impairement. I mean 'jeez', vast numbers of them are weened on a cocktail of drugs and a greater assortment of alcoholic beverges than have ever existed.

This office should be fired. He had no reasonable suspicion to suspect that she couldn't safely operate a vehicle and proved it by asking for the preliminary breath test, he wanted to be sure but arrested her anyway. This was about as unprofessional as it gets.
Driving with your lights off and giving off the smell of alcohol is definitely probable cause to test for alcohol.

This is why you should never consent to doing field sobriety tests. At that point, the officer has made up his mind, and he/she is just trying to gather evidence against you. Refuse test and invoke your right to remain silent. Ask for an attorney. Don't try to talk your way out of anything, it will only hurt you and never help.

She was obviously ok to drive as opposed to myself at that age. 73 now, living my whole life without a DUI, and having driven home from Doors, Hendrix, Cream, and Pink Floyd concerts, to name a few in my youth tripping on LSD. Lucky to have never been pulled over.

In Europe, my daughter was served wine (only about an ounce) at 16 with my permission (school trip with photography club). Either change adult threshold to 21 or lower the drinking age.

I "comprehended" that the OP said he is no lawyer and for that reason couldn't see any "evidence" of intoxication. So let me break it down for you; a breathalyser showing intoxication is evidence of intoxication. See how easy that was. The evidence is in the fucking video!
And before you go there, the definition of "intoxication" is according to Merriam Webster, and allow me to quote: "affected by alcohol or drugs" - she was _AFFECTED_ by alcohol, meaning she was intoxicated, to the point that she broke the law.
It's funny to watch sheltered Americans drive around like they own the world and can keep doing whatever the fuck they want without repercussions. Where I live, in the EU, the upper limit is 0.02 and if you go over it, you lose your licence for a year and if it's aggravated, which it is over 0.10, you go to prison for three months. You're given a breathalyser test immediately after being stopped and if it shows you're over, you go straight to jail - all without doing stupid gymnastics by the side of the road.

I've seen a lot of videos from this department, and they are not required to keep them in handcuffs once the get into the DUI testing facility. One of the officers actually talked about it in another video. This officer could have taken her out of the cuffs along time before he did.
i can tell you for a fact, this girl lived an hour away from where this took place, and this officer, who had a friend on a ride along with him, offered to give this girl a ride home, which she refused. She called her parents, and they drove the hour to come and get her. A judge also saw the body cam footage and all charges were dismissed. Another side note, when the parents showed up to pick her up, the gentleman who was on the ride along hid behind some bushes. It is my belief that the cop and his friend intended on trying to scare and confuse this young lady, and they were going to try and get a quid pro quo out of her. you do this, and we will throw all this out. She refused and called her parents who drove to pick her up. i believe this cop was up to no good, and was most likely hunting for a young target, as this is a college city that comes alive at night from the student body. someone would be smart to request all this guys body cam footage from all stops, big and small. again this is my feeling

I feel bad for this young girl. This is bad policing. In my state you are not under any obligation to take the field breathalyzer. She was not read her rights when she was initially arrested. She had previously told him she was uncomfortable being questioned.

It is pred atory, and weaponized policing (and therefore bad). This women was not impaired, yet was arrested and charged with being impaired based on a "i said so" technicality. 0.08 and below is the limit considered safe by the state (not considered impaired to drive) BUT if you are even 1 day than under 21, they lower that to 0.02 (well within the safe limit by their own standards) even though BAC is a % and therefore the same regardless of body size AND AGE. She performed those field sobriety tests flawlessly and gave no indication of being impaired. Likely, this cop was taking a chance, that he knows he can get away with, to accuse her, and hoping for the best (for him). The breath test was 0.026... she was obviously not impaired, just victim of a preda tory legal system that charges people for things they did not commit, depending on "crime" for the livelihoods of its operators. He smelled alcohol, and the DUI standard is lower for her age group. It was a safe bet she was DUI. He made it, and he was correct.

FSTs are confirmatory, but they aren't used to rule out anything. From what I have seen, if they are going to test you, they have already made the decision to jail you. They just are trying to build a bigger argument in court. It's not for the benefit of the suspect.

This cop should realize that at 18 years old, and she did this well on the exercises, he should of gotten her a ride. Discretion is key to a good cop.
However, people need to realize those who are borderline DUI or impaired are the most dangerous on the road. Why? Because they think they're invincible to drive safely when they are not. Most states have adopted a BAC level of 0.02 for anyone under the age of 21. For this 18 year old, that's equivalent to one drink due to her size and weight. Cops enforce laws. That's their job. Had this poor 18 year old killed an innocent family member of yours, you would be demanding she be locked up for good. Hopefully she learned her lesson.

You can't *pass* the tests, they are purely evidentiary in nature and designed to find people 0.10 and above. They would be useless in this case since some underage is in violation at .02 or above.

@@FUGP72 Stop being stupid long enough to realize a person with a BAC of 0.023 wouldn't smell of alcohol or be impaired. She admitted to having a drink and 1 is all it takes to be DUI when underage so the cop arrested her on that and that alone. This charge was most likely dropped or plea'd down to a lessor offense as it would child's play to beat in court.
