      Unfortunately they can access your account even if it’s set to private. My former supervisor told me that I was looking for a husband based on what I posted, none of anyone’s business but they do search your profiles. I don’t think they should have the ability to access your account

    If Veronica is an at will employee (which most employees are) management can absolutely fire her for her social media activity. The first amendment guaranteeing freedom of speech only prohibits the government, not private companies, from censoring speech.

      Totally agree. These people stealing the content don’t even give credit to the original creator. RUclips are quick enough to shut a video down if you use 10 seconds of a tv clip, but this kind of blatant theft they’re fine with. Just a crap system.

    I only got "called to HR" once when my boss claimed I didn't sign off on a document. She came at me like 2 hours after my shift, I hadn't checked my emails because I was so busy and she said I had to sign off before I left. Fine, I usually closely reviewed the documents but, like everyone else, I just looked at the change log and signed. The document was promoted, couldn't have been done without my sign off but she claimed she looked and "didn't see my signature". HR still took her side but a week later she wasn't my boss any longer.

    This is good advice to protect your rights at work, esp. the part about mentioning your lawyer (mentioning your shop steward is also good) In any case, it's beside the point.     Here, in Alabama, in the 1970s and 80s and even the early 90s, Veronica would have been fired immediately, so she wouldn't have been able to afford a lawyer. It's a stupid "right to work" state, and somehow that translates into, "We can terminate you any time, no reason required." They also used to maintain wages low, so you could never save enough money to sue, especially if you were the only wage earner in the family.

    I work for a multinational. In one of the documents related to internet security they have a little nuggets hidden at the end in the legaless. Basically, it says, "You may not post the name of our company or its logo on any social media. You may also not post about any entity our company does business with" Like all such documents there is a section when you can make a comment about it and anyone that reads through the document can see the posts. I made a post about this section and asking if the company was going to make a master list available to all employees of all entities that the company does business with, updated weekly, so the employees would be able to follow this rule. HR was not happy. I really wish I could hire a lawyer to look over that and see if it is even legal, because I would guess that in the US, it wouldn't be.

    The manager should have just stuck to "HR is going to be contacting you to set up a meeting" and left it there, or waited until HR wanted to have the meeting and informed her. HR should just verify she hasn't violated policy and hasn't been doing the videos while on the clock or with company equipment.
    Beyond that, the First Amendment doesn't apply to private companies (to an extent), so the lawyer probably wouldn't be able to do much if she were fired, as it doesn't appear to be for an illegal reason (at this point), Veronica could, however, collect unemployment, as termination wouldn't have been "for cause", as she wasn't making the videos using company resources or on company time, unless she was violating company policy, which she says she wasn't and hopefully verified that before she started making the videos.
    All that said, I love the videos.

      ​@@SchoolforHackersWhatever we might wish to be the case, the first amendment contains no such exception. It is only applicable to the government.
      The government could put certain regulations in place to limit valid grounds for termination, similar to those that protect from wrongful termination based on gender, race, and etc., but doing so would likely create a pretty big mess, and have all sorts of unintended consequences. So yeah, theoretically, bosses can fire people for pretty much any reason that isn't specifically regulated, and they can usually work around those regulations easily enough. They can fire someone because of what they wear outside of work, what they say, write, or do. In some cases, it might be justified. If someone was spouting rabid neo nazi stuff on their tiktok and went viral, their employer's best bet is to issue a "this person no longer works for us and we don't condone their abhorrent rhetoric" statement. Generally speaking, a business doesn't gain anything from firing someone because they like ice cream or wear pink, even though they theoretically can, so they don't usually do that. But are we protected from them just deciding that they don't like the cut of our jib one day and letting us go? Not even a tiny bit.
      Unfortunately, a big part of knowing one's rights is knowing how vulnerable to the whims and abuses of the wealthy and powerful we really are. Heck, even the government doesn't exactly honor the first amendment if it isn't strictly convenient. There are enough loopholes in that thing to hang a mod sized army...

If an employer tries to block that speech outside of work, they’re in quicksand. But the employer isn’t obligated to keep the employee, so they can point out a problem and terminate at will.

    Isn't it always fun when they try to phrase "we want you to stop doing this" as a mutually beneficial and cordial conversation between equals?
    Personally, I always go to red alert as soon as my boss begins to imply that we are "all in the same boat" here or that something is "for the good of all of us". A groverling boss is a boss who either already f*cked up is about to ask something f*cked up.

Unless someone investigates and publishes who Veronica is and where she works we may never know. Personally, I like not knowing, but even if I found out it would have zero baring on the company unless they are harassing her. She could be doing these uploads from many decades of experience from various employers and it is hilarious because we have experienced the same BS from various employers, so we know it is TRUE.

    her right to free speech is irrelevant. free speech is against the government, not a company. the right to free speech is when the government is involved and tries to regulate or block your speech. the company can do what they want as long as they dont violate hostile work environment laws.

    I don't think Veronica understands what freedom of speech actually means in the United States context.
    A person has freedom of speech when it comes to the government, but does not have freedom of speech when it comes to private entities. So the company should tell her to bring her lawyers.

    Only the government is bound by free speech laws, not companies.
    They can absolutely require that you don't talk about them on social media. They can require that you keep trade secrets.
    You can absolutely be a whistle blower if there are unfair or illegal practices going on at work, but you're better off taking them to the EEOC (Equal Employment Opportunity Commission) than complaining on social media. Also, most potential employers (at least, for professional positions) will look at your social media presence before hiring you. Bitter complaints about former employers are a red flag. Even if you were totally in the right. It might also undermine your case if you do have to call a lawyer.
    If this video is purporting to inform workers about their rights, it's way off base. It just has inaccurate information and scenarios. If you think you're being treated unfairly in hiring practices OR in your workplace, or if you have questions about required or prohibited:
    --Accommodations for disability
    --Questions during an interview
    --Accommodations required for pregnancy, labor & delivery, related medical issues
    --FMLA (Family Medical Leave Act): Getting time off for medical issues for you or a family member
    --Pay (including the difference between hourly and salaried wages and who qualifies for which, including overtime pay)
    --Firing/forced resignation
    --Physical capacity/characteristics required for a job vs those that would be discriminatory
    --Discipline
    --References
    --Harrassment (hostile work environment)
    --Dress code
    Go to EEOC.gov. It's got good summaries of all of these and much more--and you can actually do something about a violation there. It's easily searchable, has clear menus. RUclips is great for entertainment, but just understand that it doesn't always have accurate information. Go ahead and rage watch this channel if that's you're thing, but if you actually want to know your rights in the workplace and what to do if they're violated, look for more accurate sources of information. And more importantly, learn how to take action without getting yourself fired. NLRB.gov (National Labor Relations Board) is another good source. Did you know your employer cannot forbid you from discussing your wages with co-workers or anybody else? Not because it's free speech, but because it's protected speech.

    Employers can terminate any employee without cause or warning as long as it's not for reasons related to discrimination as set out in in your State, Prov or Fed law. My guess is HR will wait for things to cool down and within the quarter Veronica is sacked, likely with a fair severance. She'll have no case for wrongful dismissal... and her colleagues will breath a sigh of relief.

    Love how the managers are so spineless, always qualifying everything, coming short of making any definite statements, and here waffling between 'I' and 'they" pronouns to try and obfuscate which entity is really sort of taking a position about her social media

    Great as always, but one little issue: the constitutional right to free speech doesn't extend to private companies.
