Its a difference between "actual" possession and constructural possession. Actual possession, is when something is caught on the person. Constructural is when something is found around the person. In a Constructural case they need to prove that it's the person's without a reasonable doubt and also prove that they knew it was there. The defendants need to set up each situation, to stand on those laws. By not driving cars that's in there names one. Leave or drop work somewhere on a property they don't own. Leave room for reasonable doubt that the officers have to 1000000% prove. I've beat 2 cases this way irl. The layers also need to study in and out the process of arrest.. its loop holes there to get mistrial if the officers does not follow those rules. Plus attack credibility almost from the jump when dealing with lawyers especially if they simi dirty you can catch them in a situation they dont want to admit to but you can prove, but thats not going to effect the defendants current case. Find slips in information or statements given before and during trial. Etc
