Why does either punishment, or authentic law have to be theorized? When crimes against another man or woman have been committed, then punishment must fit the crime without theories. It's the physics of natural law / universal law / God's law. Everything else is man-made codified policies and legislation operates under the fictional "legal" system of "color of law", that's all.
