I was granted primary custody of my son over 11 years ago. The mother of my son lied in court saying she did not make enough money and automatically the court ordered her to pay the minimum amount of child support allowed by Texas standards ($365/month). Even at that laughable amount, because I knew she made a lot more money of what she claimed, she refused to pay child support for like 10 years and she never got in trouble with the law for that. Had it been the opposite way and I would have been locked up faster than you can say "bitter baby momma"
The State Revenue Department can get her records and she can go back and pay what she owed if you press the issue. Sadly if you did this in criminal court you'd get locked up quickly yet family court you can say and do whatever.

The thing I HATE... is that overtime can be calculated into child support. It's absurd that the system will never allow a father to get ahead. The more he works, the more he has to pay. And if overtime goes away that can take MONTHS to modify in child support. I don't think they should be allowed to add anything over 38 hours into child support.
Different states have different laws. In my state, ohio, they take the last 3 yrs and average the overtime unless the current yr is deemed to be less then the average. So it's a little better, but not much.
No kids shouldn't be brought into the world except by women who actually want to be good mothers. A good mother wouldn't let herself be impregnated (in consentual circumstances) by someone who isn't fatherly material in the first place bc to her, it wouldn't be about a paycheck. She has the other half to do whatever she wants besides work and she's complaining about lifestyle? Like MTR said, she wants more money to support her life style.

When I divorced my ex I rarely got child support. I worked 2 jobs and went back to school. She could very easily work more hours no the 14 days the children are with their dad. Single moms need to do better.
Child support is used more for compensation for getting pregnant and giving birth than providing for the child's (children's) needs. A lot of these women think this way to punish men for knocking them up and try to control him through those kids.

Sadly the courts allow them to drag the dad back to court every (3) years for "Modification" so a dad can look forward to (6) modification hearings by the time the kids are 18, and longer if the ages of the kids are staggered.
@oliverwhite30 most states are an automatic adjustment hearing every 3 yrs. They can actually be taken back to court anytime they can meet the threshold for an adjustment. In ohio it's 10% increase or decrease in the amount of support paid.
I’m a nurse as well, we make a very very comfortable living. She only makes $23 because she wants to work in a doctors office, working 9-5 and getting weekend and holidays off. If she wants more spending money she should go work at a hospital or nursing home she would be making double what she is making and there is always opportunity for overtime. If they are with dad half the time she should take those days to work as much as she can.
And isn't pediatrics the least paid specialty? If she wants more money, be a floor nurse and work overtime. I didn't hear if she was asked if she works overtime.

When my brother and his girlfriend broke up, they had two kids together. His girlfriend didn't work, have a driver's license, or a high school diploma. My parents paid for her to get get drivers license, which she failed to do. They also paid for her to get her GED, which she failed to get. So when it came time for the custody battle, the state paid for her lawyer because she didn't have a job. My brother had to pay for his because he worked. The court ended up doing joint custody, but my brother still had to pay 700$ a month in child support. The duty of picking up and dropping the kids off was supposed to be split between both parents, but since she has no license or car, it fell to my brother and my parents to pick and drop the kids off almost every single time. My brother couldn't always pick or drop the kids off because of work. My parents also pay for the kids to do things like dance, violin lessons, etc. Which they have offered to do those things, so their grandkids can learn new things and have fun doing stuff they enjoy. But the court still screwed my brother over. His ex girlfriend still had never gotten her license, GED, or even had a job, and she's like 30 years old now. She's gotten married, and just had another kid, so het new husband supports her and her kid, plus his two other sons with his ex wife.
Its completely ridiculous that the state or county provides "Children Attorneys", when the judge can just ask the simple questions. The entire child support system is designed to be difficult in order to employ thousands of state workers, attorneys, judges, baliffs, hearing officers...... Etc. Different states have different laws. In my state, ohio, they take the last 3 yrs and average the overtime unless the current yr is deemed to be less then the average. So it's a little better, but not much.

She has the other half to do whatever she wants besides work and she's complaining about lifestyle? Like MTR said, she wants more money to support her life style.

When I divorced my ex I rarely got child support. I worked 2 jobs and went back to school. She could very easily work more hours no the 14 days the children are with their dad. Single moms need to do better.

It makes my blood boil to watch these fathers get grilled about how much they make and contribute to the children's welfare, but never grill the mother. It also drives me crazy how these amazing fathers who contribute way more than the mother when it's 50, 50, but they never speak against these gold digging mothers and try to hold them accountable or to have them pick contribute more. They just sit there and respond with, "I don't have anything to say," when it's their turn to speak their piece. If they don't speak up when they have the chance, these women are just going to drag them back to court in the future to try again. It's so frustrating how broken the system is!
Sadly the courts allow them to drag the dad back to court every (3) years for "Modification" so a dad can look forward to (6) modification hearings by the time the kids are 18, and longer if the ages of the kids are staggered.
@oliverwhite30 most states are an automatic adjustment hearing every 3 yrs. They can actually be taken back to court anytime they can meet the threshold for an adjustment. In ohio it's 10% increase or decrease in the amount of support paid.

I’m a nurse as well, we make a very very comfortable living. She only makes $23 because she wants to work in a doctors office, working 9-5 and getting weekend and holidays off. If she wants more spending money she should go work at a hospital or nursing home she would be making double what she is making and there is always opportunity for overtime. If they are with dad half the time she should take those days to work as much as she can.
And isn't pediatrics the least paid specialty? If she wants more money, be a floor nurse and work overtime. I didn't hear if she was asked if she works overtime.
In calfornia, the DCSS out here can get a modification on their decision and they will stick to that, w/o you even seeing a judge (you can request a hearing, but you'll be required to fit the bill if they like)

With split custody, the mother could be working an insane amount of overtime as a nurse. There is a huge shortage of nurses and she could pick up shifts or even do telehealth services and work from home. Mom has zero reason to be in a position of poor financial health. She’s making a choice here and expecting handouts.

But towards the end, the judge came in and asked the woman where she works, for how long she has worked at her place of employment, and how much she is paid.

When my brother and his girlfriend broke up, they had two kids together. His girlfriend didn't work, have a driver's license, or a high school diploma. My parents paid for her to get get drivers license, which she failed to do. They also paid for her to get her GED, which she failed to get. So when it came time for the custody battle, the state paid for her lawyer because she didn't have a job. My brother had to pay for his because he worked. The court ended up doing joint custody, but my brother still had to pay 700$ a month in child support. The duty of picking up and dropping the kids off was supposed to be split between both parents, but since she has no license or car, it fell to my brother and my parents to pick and drop the kids off almost every single time. My brother couldn't always pick or drop the kids off because of work. My parents also pay for the kids to do things like dance, violin lessons, etc. Which they have offered to do those things, so their grandkids can learn new things and have fun doing stuff they enjoy. But the court still screwed my brother over. His ex girlfriend still had never gotten her license, GED, or even had a job, and she's like 30 years old now. She's gotten married, and just had another kid, so het new husband supports her and her kid, plus his two other sons with his ex wife.

I had a friend who was married for three months and no children and she divorced him and tried to get alimony. The judge laughed at her and actually said if she was going to be a gold digger she should have stayed married longer and obviously didn't do her research. I know what the judge said as my friends attorney was a good friend in our long time friend group. He has represented most of us in one way or another. Very good friend.
