Yes. Absolutely you can use it commercially.
Microsoft says "Specifically, if a third party sues a commercial customer for copyright infringement for using Microsoft’s Copilots or the output they generate, we will defend the customer and pay the amount of any adverse judgments or settlements that result from the lawsuit, as long as the customer used the guardrails and content filters we have built into our products."

While giving Microsoft access to page content the pop-up says 'Send my browsing data to Microsoft to make AI-generated answers and suggestions' so is it also covered in commerical data protection or there is a miss in this because then Microsoft will be using the data to train the model.

If you login to Bing Chat using corporate account, data will NOT be sent or used for training.

After opening a PDF file in the edge browser and clicking on generate document summary it says that" I can't access your web page at the moment please try again in some time"

Open the vertical three dots at top right corner of Copilot pane in Edge - Notifications and App Settings - Activate the option Allow Microsoft to Access Page Content.
