On books and on internet it shows CVC got statutory status in 2003 not in 1998...plz.remove this confusion

It's tricky. It got the status in 1998 but that status got a legal backing in 2003 after it was passed in the parliament. Since the Ordinance was finally passed in the parliament, the original date of the First Ordinance is taken as the date of the granting of Statutory status to CVC.

The Central Vigilance Commission Bill having been passed by both the Houses of Parliament received the assent of the president on 11th sept, 2003. It came on the statute books as THE CENTRAL VIGILANCE COMMISSION ACT, 2003 (45 of 2003) ( came into force on 11-09-2003)

For this you need to understand the difference between oridance and law passed by parliament.
oridance are laws that are promulgated by the President of India on the recommendation of the Union cabinet which will have the same effect as an act of Parliament and can only be delivered when the parliament is not in session. they enable the government to take immediate legislative actions at times when the legislature of the union is not in session and there is a need to make a l legislation or an act in emergency in such cases the government refers a proposal to the president or Governor and if they approve it then it becomes and oridanceblegally oridance is equal to. So you can see that CVC was given a statutory status using oridance. (25th aug 1998)
But in laxmikant it is written that in 2003 the Parliament enacted a law- which means that the bill was passed in the houses of the Parliament and then the law was enacted which granted statutory status on the CVC. It also consists of set of regulations or rules to be followed.( In 2003)

Q.. Sir i got a problem ...you said cvc got statutory status and cvc bill passed. 1998 and 2003 respectively, but in lakshmikant the date is 2003 ans 2014 respectively
The Ordinance of 1998 conferred statutory status to the CVC was issued. In 1998 the Government introduced the CVC Bill in the Lok Sabha in order to replace the Ordinance, though it was not successful. The Bill was re-introduced in 1999 and remained with the Parliament until September 2003, when it became an Act after being duly passed in both the Houses of Parliament. In 2004, GoI authorised the CVC as the "Designated Agency" to receive written complaints for disclosure on any allegation of corruption or misuse of office and recommend appropriate action.
@@gyanitasinha8360 but ordinance need to be get parliamentary sanction within 6 months otherwise the ordinance will become null and void so how it survived 5 years providing LS was in session these years?

@@gyanitasinha8360 passing just an ordinance can't give statutory status to a bill since it is passed by president when LS is not in session and it needs to be passed by both housed in order to get a statutory status as an act withing 6 months of first sitting of LS

I have a doubt regarding the statutory status.. we call it statutory when it is passed by a statute i.e when a law is passed in parliament.. so according to that the CVC should have the statutory status from 2003 and not 1998.. so is it a thing? Do correct me if Im wrong.. thanks

When an ordinance is promulgated, but the legislative session is yet to commence, the ordinance remains in effect as law. It has the same force and effect as an Act of the legislature. And thus it got a statutory status by the ordinance issued.
