Your video was a TREMENDOUS help. I was able to apply for my waiver and got it within a few weeks. I asked for an operational window for a few months, but they issued it for 2 years. I can now operate over people AND vehicles!

Hello Greg et al. I'm a proud Pilot Institute grad (section 107) and the owner of an Avata 2. I purchased a Vifly anti-collision beacon, so I could apply for a waiver to fly over people. I so applied and was rejected. My application was broad seeking a general waiver of the rule in Section G airspace anywhere. The rejection letter: " In particular, your request did not describe your operation and it did not provide an explanation of how the operation would be safely conducted." Do you have any further guidance on the level of detail the FAA will require for this waiver? Thanks. Jeff
This is a great change. I'm a teacher and have been frustrated that I can't do a flyover of my students when we are outside learning about the world. This makes it easier to share what we do with parents and the community.
As a storm chaser, this is a must and I'm delighted. I applied today--as always, Greg, your guidance and direction is essential. I also didn't know I needed to re-register my drone under my Part 107 (which I got after taking your course). $5 well spent. I like being in compliance with my flights.

From that site, you'll see the section to request a waiver. Fill it in. I applied for day/night/twilight ops. They have questions about your drone (lighting, guards, etc). You have to provide some justifications, but it was easy to submit.
So a waiver to some regulation that is a bandaid for over-regulation - that also adds a little bit of extra regulation in the waiver? Nice. I wish the waiver flying near airports could be easier. My house is 1 mile away from the end of a rarely used runaway at a busy regional airport (most takeoffs/landings are on perpendicular runways). I would like to use my drone to inspect my solar panels and roof. I won't be flying over 50 feet. If there is an airplane flying 50 feet over my house they are either in serious trouble already or a giant a-hole.
50' is a great start for flat airport areas. I live in the city and the trees are around 75' If a aircraft is that low "Huston we have a Problem. Have a blessed day.

Hi Greg! Thank you this update! In the waiver application, it requires a "proposed location, with the class of airspace we want to operate... How do we fill this? Unless for a planned specific project, we don't necessarily know what the airspace will be? (given it would be for all airpsaces that do not require a special waiver, outside the LAANC authorization). Thank you for the insight!
My concern is the cost of an ASTM Parachute System. The prices I am seeing with the ASTM data for waivers is in the neighborhood of $2000. I think this was for the Phantom 4 V2. I am hoping more companies will develop parachute systems and the cost will come down some.
I have the need to fly over a small boat doing donuts with 2 passengers to promote a boating adventure business. Is there a special waiver for an operation like that, that doesn't make me have to get a parachute? There operators of the boat understand what I'm doing and give me permission. Thanks!
I just got these new diamond-tip propeller blades for my drone and was flying it about 200 feet agl when something went wrong and my drone fell out of the sky. It came down like a comet! As it went past a building, its blades dug deep into the marble surface, leaving huge gouges all the way to the ground. When it hit, it left a crater five feet deep! You can see why it's so important that we have these regulations in place, because that happened three more times that day!
According to this from the FAA, with a DJI Mini 2 using RFI Module, prop guards, I don't need to apply for any waiver in uncontrolled airspace. If I fly at night, I need to add a light. Does that sound right? "Part 107 Waivers The Operations Over People rule became effective on April 21, 2021. Drone pilots operating under Part 107 may fly at night, over people and moving vehicles without a waiver as long as they meet the requirements defined in the rule. Airspace authorizations are still required for night operations in controlled airspace under 400 feet."

Also, I've been trying to determine what category my DJI mini 4 pro falls under with the intelligent flight battery plus. I believe total weight will be around 290 grams.
I'm still unclear on whether this covers OOMV. Greg has said a few times that it does not. People in Vic's group have said to check both boxes on the waiver application. But will the new, more limited questions/responses be valid for 107.145? I don't want to delay my application if it does not.

Where do you find an anti collision light that is visable from a mile during the day? I have done a lot of testing over the past year and have never found a light that is that bright.

Cars are not allowed everywhere in NP. The problem with drones is that they have flammable batteries which can cause issues. I don’t see the NPS changing their rules any time soon.

That is great.. but RID + parachute are going to add a bit of weight right? So does the additional weight count towards the 3.5lb max? Or is the drone without those 3.5lb max, then you add those on. Also.. how the hell you deploy a parachute that is an add on? Adding prop guards to the mini 4 pro is going to put it over 250g too.. so does that count? Or is it JUST the drone + battery and it remains under 250g?
Weird, I purchased a Avata 2 yesterday for the 'speed' and being able to fly indoors during bad weather, now I discovered I can use it to for video, it does have a decent camera...
Has anyone flown much with the pro guards on a Mini 4 Pro? I flew once and it was extremely erratic, and I have never put them on again. I know it has to switch to pro guards mode, but the spazzing out was enough for me not to try it again and I can't imagine how bad it would handle in the wind.
Hi Greg. I have a DJI Mini 2 Ultralight 199g Japanese version. With prop guard, remote ID module, and strobe light - the whole thing weighs 249g. Can I fly over people without FAA waiver?
Man, the parachute requirement on those drones is ridiculous. It would leave no payload capacity left. let alone I don’t even know how you would attach a parachute system to some of the system listed.

You have to be careful though. Adding prop guards and anti collision light might put your craft over 249g. Also, if you're a Mini 4, RID won't work unless you are using the larger battery which puts you over 249g.
Collision with manned aircraft when your drone is under 400 feet? Are we flying over runways or are the manned aircraft barnstorming the people that we're trying to fly over?
EDIT: Already answered earlier on 5/29/24. Scroll down. Greg, are you aware of any requirements for the type of prop guards? The DJI prop guards for the Mini 4 Pro completely encircle all four blades. Other products , including the STARTRC, leave gaps, between the two front props and between the two rear props.
"Great" makes sense. Anti-collision light that will help not to collide with aircraft but required for flying over people waiver. So those people freak out. So if I am flying not over people I dont have to have the light? But the aircraft collision still exists.........
Can you clarify the rule on transitioning over people, (not a crowd or public gathering)? I have heard from other RUclips channels that as long as you are just transitioning over people and not loitering, hovering or circling them you are ok.
Nope, they are unfortunately incorrect. To transition over people, you still need a categorized drone or a a waiver, and this can only be done under part 107 (not recreationally).
@@PilotInstitute that’s good. They have sped up ones in the other industry too, but they left the backlogged ones backlogged. I know I’m getting one put in soon. Will be a good restriction lifted. I feel the FAA is at least trying, in some ways, to do the right things. Government moves slow. In most cases that’s a good thing. Just hard to remember that when it’s something we want.

Per DJI’s Website: “DJI Mini 4 Pro does not support obstacle avoidance after installing the propeller guard and cannot actively detour or brake when it senses an obstacle. When using intelligent features, the aircraft will not have obstacle avoidance capability.”
I see the StartRC guards for the Mini 3 Pro are much lighter, and provide less prop protection than some of the others. Specifically, the top of the props remain exposed. Any idea how the FAA will look at this? Would the StartRC qualify for this waiver? And thanks for the update!
The FAA won’t look at what product you use. They just want you to put props on that prevent lacerations. It’s up to you, as the pilot, to decide if this is enough protection and if it exposes you to more or less liability.
The Enterprise line should. The limitation is currently the lack of API/SDK for the consumer Mavics - there's no way for the parachute system to instruct the drone to kill the props.
I have the DJI Mini 4 Pro with intelligent batteries. How do I find how many kinetic foot pounds my drone would deliver upon impact? This is the last part I am waiting for so I know which category my drone falls under before I submit my request.
You don’t really calculate that. Your mini is not a categorized drone so you would have to go through the waiver process to be able to fly over people.

I started slowly flying inside a restaurant with the Avata 2, flew out the door, turned around and flew down under the deck, then back into the restaurant and flew around people, and over one guys head. What are the rules for flying inside around people? Will a waiver be required for that?

You don’t need a waiver for that, you need airspace approval. Did you try to submit an approval via the FAA DroneZone or via Aloft AirControl.

Parachute system 150.00. Once ASTM certified, 1600.00. Looks like I have another reason to buy a Mini series.

R&D is expensive for these. You can likely make that money back in a few flights.

A mini 2 needs prop guards which takes it over 250 grams, which means it no longer qualifies to fly over people.

DJI indicated that Avata 2 is not equipped with strobe, what after market strobe is recommended

You can get OOMV but with limitations. We got it with ours. So feel free to fill it out when submitting your application.

I came here to ask this. The Firehouse strobes are the usual go-to and against a sunny sky they vanish well below a 1/2 mile.

Has anyone flown much with the pro guards on a Mini 4 Pro? I flew once and it was extremely erratic, and I have never put them on again. I know it has to switch to pro guards mode, but the spazzing out was enough for me not to try it again and I can't imagine how bad it would handle in the wind.

Hi Greg. I have a DJI Mini 2 Ultralight 199g Japanese version. With prop guard, remote ID module, and strobe light - the whole thing weighs 249g. Can I fly over people without FAA waiver?
Yes, it qualifies as category 1.
Man, the parachute requirement on those drones is ridiculous. It would leave no payload capacity left. let alone I don’t even know how you would attach a parachute system to some of the system listed.
Does your company submit waivers for companies? We already have a fly-over people waiver but need to renew it with fewer restrictions.

No waiver, that's a category 1 drone.

You have to be careful though. Adding prop guards and anti collision light might put your craft over 249g. Also, if you're a Mini 4, RID won't work unless you are using the larger battery which puts you over 249g.

Collision with manned aircraft when your drone is under 400 feet? Are we flying over runways or are the manned aircraft barnstorming the people that we're trying to fly over?
Plenty of helicopters legally flying below 400 feet.

Greg, are you aware of any requirements for the type of prop guards? The DJI prop guards for the Mini 4 Pro completely encircle all four blades. Other products , including the STARTRC, leave gaps, between the two front props and between the two rear props.
Prop guards turn off OA. What's your view on this trade off?
You should be able to fly without OA in pretty much any situations. Prop guards will be safer than OA.

"Great" makes sense. Anti-collision light that will help not to collide with aircraft but required for flying over people waiver. So those people freak out. So if I am flying not over people I dont have to have the light? But the aircraft collision still exists.........
Can you clarify the rule on transitioning over people, (not a crowd or public gathering)? I have heard from other RUclips channels that as long as you are just transitioning over people and not loitering, hovering or circling them you are ok.
Nope, they are unfortunately incorrect. To transition over people, you still need a categorized drone or a a waiver, and this can only be done under part 107 (not recreationally).

Part 107 only. You cannot fly over people recreationally.

I was told by the FAA last week that they processed more waivers in a week than in the previous 5 months.
@@PilotInstitute that’s good. They have sped up ones in the other industry too, but they left the backlogged ones backlogged. I know I’m getting one put in soon. Will be a good restriction lifted.
I feel the FAA is at least trying, in some ways, to do the right things. Government moves slow. In most cases that’s a good thing. Just hard to remember that when it’s something we want.

Per DJI’s Website: “DJI Mini 4 Pro does not support obstacle avoidance after installing the propeller guard and cannot actively detour or brake when it senses an obstacle. When using intelligent features, the aircraft will not have obstacle avoidance capability.”
Obstacle avoidance is not required for this waiver.

More than likely, yes.
I see the StartRC guards for the Mini 3 Pro are much lighter, and provide less prop protection than some of the others. Specifically, the top of the props remain exposed. Any idea how the FAA will look at this? Would the StartRC qualify for this waiver? And thanks for the update!
The FAA won’t look at what product you use. They just want you to put props on that prevent lacerations. It’s up to you, as the pilot, to decide if this is enough protection and if it exposes you to more or less liability.

The sellers should have that on their website. Look at AVSS and ParaZero, both have ASTM approved models.

The Enterprise line should. The limitation is currently the lack of API/SDK for the consumer Mavics - there's no way for the parachute system to instruct the drone to kill the props.

I have the DJI Mini 4 Pro with intelligent batteries. How do I find how many kinetic foot pounds my drone would deliver upon impact? This is the last part I am waiting for so I know which category my drone falls under before I submit my request.
You don’t really calculate that. Your mini is not a categorized drone so you would have to go through the waiver process to be able to fly over people.

I started slowly flying inside a restaurant with the Avata 2, flew out the door, turned around and flew down under the deck, then back into the restaurant and flew around people, and over one guys head. What are the rules for flying inside around people? Will a waiver be required for that?
