Because you are actually playing in E Dorian. E Dorian is the second mode of D major (Ionian), that means they are relative, they share the same notes. The reason that we say it is in a dorian is because the chords are based on E minor, not on D major.
The giveaway that it’s in E Dorian is that the root chord is minor, but the four chord is major (A7) instead of the normal minor that it would be if it was a typical E minor progression. Since Dorian is the mode starting on the second note of the major scale, you go down one whole step to D and play the D major scale. Just remember that this song is still in E Dorian, so you should emphasize that root note of E in your playing.
I should add that the B section of this song is really more in G Major, so if you are playing E Dorian / D Major over the A section, try switching to G Major for the B section. It’s great and adds a lot of color and a distinct sound between the two sections.
