Because the point isn't to make a point that won't be overturned on appeal - it is to delay any substantive work on the case for as long as possible, in the hope that Trump will be re-elected and use the office of the president to cancel the case entirely. She probably expects that the ruling WILL be overturned on appeal - but that will take weeks, and then she no doubt expects that the re-opened case will just come back on her docket (so she can start over on the delay tactics with the clock reset)

Read the Constitution, only the President with the advice of the Senates can appoint a Special Counsel..period.
A Special Counsel appointee may hold this promotion up to 8-10years. The AG then can appoint any of these prosecutors to oversee any case.
However Jack Smith was never appointed to a Special Counsel statue by the President or Senates, so Garland had no power or constitutional rights to appoint Smith to oversee Trumps Florida case. Judge Cannon got this Right.
