FTCvideos Why did you pick 13 out of all ages for COPPA. I genuinely believe the age should be lowered to 11 because that’s when adolescence kicks in and kids start to get more mature. At the age of 11 and 12 information from children do get collected because there in middle schools and use email on chromebooks . I firmly believe COPPA should target 10 and under rather than, 12 and under because yes there are huge maturity differences between 12 and 10. A 12 year old usually knows if it’s an ad and should be smart enough not to reveal a lot of info about themselves on the internet. I sure was when I was 12 and so we’re all my friends.

As a regular RUclips viewer, I believe the current implementation of COPPA rules will severely hurt content creators and content on the platform. I regularly watch content creators who have raised concerns over the current COPPA rules and I believe their ability to monetize and create content on RUclips while also supporting themselves financially is at stake here. RUclips is nothing without its creators and without them being able to support themselves and their businesses on the platform, RUclips will indeed become a "desert of crap". I urge you and the fellow FTC members to reconsider the current COPPA laws and change them to suit the needs of the modern world today.

In fact the FTC said that if a child lies about their age (example an 11 year old saying they're 13 by making an account) then there's no fault on the website. The problem here is RUclips allows people to use it signed out. Signed out they don't get you agreeing to terms which state your 13+ so watching signed out they assume your 12 or younger and THAT'S the issue. RUclips could fix this all by making people make an account to watch, but won't because it cuts into their profit.

The free RUclips Kids app is a better solution than regulation targeting family-friendly creators. RUclips Kids removes privacy concerns around personalized ads. Parents buy devices and allow their children to watch RUclips Main. Many parents prefer to use RUclips Main because it has more features and less barriers. Creators should not be punished when parents choose not to use RUclips Kids. COPPA is about putting parents in control of protecting their children’s personal information online. The FTC should not use COPPA to remove parents from the process in regulating content and online advertising. While large corporations will survive these changes, small business creators face terminating employees, changing their business model, or shutting down production altogether. These regulations will particularly hurt young underserved audiences who participate in RUclips communities on topics like special needs, faith, and minority groups. These revised rules, while they have good intention, will do more harm than good. The categorization of "children's content' is extremely vague. By enforcing COPPA is such a way on RUclips, many content creators will be encouraged to either cease making content, or to convert their content to something more mature. For those who do comply with COPPA when creating kids' content, this can disrupt entire livelihoods, as well as forcing them to alter their entire business structure. If certain creators are fined, as the FTC claims they will, it can destroy entire lives. The huge issue is that it doesn't matter if you perceive your content to not be directed towards kids, because ultimately the final decision on whether or not you are compliant lies in the hands of someone who may not watch the entire video, goes only off of the title and thumbnail, and may not understand pop-culture and the vast interests of young adults. Many content creators who do not intentionally direct their content towards kids, yet still attract such an audience, will be impacted. Ultimately, this fear of not being COPPA compliant will encourage the creation of less kids' content because there is no monetary advantage in doing so. With less and less children's content available, kids will be exposed to more and more mature content. Ultimately, kids will always find a way on to the platform. Another issue is that vast amounts of children watch creators such as Jake Paul, and he isn't someone who is necessarily child appropriate in my opinion. Due to the legal definition of kid's content being so vague, if a channel such as his can be considered as directed towards kids, then where will the line be drawn? While it is true that there are a small handful of channels who do exploit kids using targeted ads, that is an extremely small minority. COPPA unnecessarily puts other channels at risk. In the RUclips terms of service you must be 13 or older to begin with, which is why they have been considered COPPA compliant until now. The issue the FTC fails to understand is that in most cases children are using accounts that are either their parents, or have been set up by their parents, which is a form of implicit agreement to RUclips collecting data on said accounts and issuing targeted ads. This is honestly an issue that has arisen because of the FTC's lack of expose to modern internet culture, and lazy / ignorant parents. If parents want their children to not be subjected to targeted ads on the platform, RUclips provides alternatives such as RUclips RED subscriptions and RUclips Kids. If a child lies about there age to create an account, which would then be subjected to information collection, the blame lies not with the content creators , but with the child for breaking RUclips's terms of service and the parents for not policing their children. The exploitation of kids does not lie in the blame of Google or RUclips. The FTC is not at fault in this situation either, they are simply doing their jobs, and this situation is due to misinformation. The FTC wants to solve the problem and up until the 11th of December were accepting feedback on the proposed regulations. In the end, COPPA will only be destructive to RUclips, and several other platforms, in more ways than one. To reiterate, it will only result in the production of less child-suitable content, which would then ultimately expose children to greater amounts of mature content because many utilize parent approved accounts that can view 13+ content to begin with. Furthermore, the monetary impact will be severely damaging to many creators who may or may not have believed themselves to be creating kids content. What are your opinions on the matter? It definitely should be unconstitutional, but not just for that reason. If everyone is required to correctly label whether their videos are for kids or not under threat of government fines, regardless of whether they monetize or run targeted ads or not, that is a form of prior restraint or imposing a requirement in order to exercise free speech. That's also arguably involuntary servitude which is against the 13th amendment, especially if also required for videos that have already been uploaded and published, which is also ex post facto unconstitutional meaning it's retroactively criminalizing something that was done in the past. There's also the fact that the content creators aren't the ones doing the data collecting; that's RUclips. Unless creators specifically consent to benefit from that data such as by agreeing to run targeted ads on their videos, then they have no involvement.

Children should not be considered the same as general audiences, although this may be hard to implement because children will still watch general content. 2. The FTC should allow websites like youtube to handle content “for kids” and “not for kids.” It would make more sense to allow creators to decide if their content is for kids or not, and instead of using a bot to check if they’re “wrong,” allow users under 13 to enter (with permission from an email from parents). Instead of trying to fine creators on vague grounds, don’t recommend “not for kids” videos to kids under 13. I consider this similar to adult-oriented cartoons not being aired on children’s networks. 3. Instead of avoiding recommending videos “for kids” altogether, use a non-personalized recommendation algorithm for those ONLY to avoid collection of data. Separation of “for kids” and “not for kids” is important. 4. If a video is deemed “for kids” run ads targeted at kids in general instead of tracking individual users 5. As an idea for a “general audiences” category of video, it could appear individually in both the children and adult algorithm but treat the user differently based on the age of the account’s user

No, but the parent should set the mobile device, not the child. They are the users of the device, but the parents should be the owners to protect them breaking the terms of use of devices due to adding Parental Controls. Well, websites like ROBLOX usually don’t use the personal information of the users, however, they use age. If you say you’re under 13, there will be multiple restrictions because Children shouldn’t be screaming profanities or watching porn. 13-18 year olds are left out, mainly because they are more mature than Children, therefore, less gullible and vulnerable. You know that COPPA could ruin the lives of content creators. All they want is to share and interact with people who are interested in them. You could make content creators lose their money, and make them have a hard time to get through. If a child learns things he/she should not be learning at their age then that is the parents fault because they should be more aware and careful on what their child does in the internet. This will deeply affect content creators because they will create what they are forced and have certain limitations. RUclips should promote RUclips Kids more so that parents will know and won't ruin the content of RUclips. I am 13 but I do not agree on this "COPPA".
The only thing that makes any sense would be to see either of these guys create a Patreon or GoFundMe account for RUclipsrs to support that pays the expenses to fight COPPA’s unreasonable definitions of content made for kids under 13. WE (the creators) don’t knowingly serve children personalised ads. WE (the creators) are not in the home monitoring what the kids under 13 do! One RUclipsr said it well that if a kid is watching a TV show and changes the channel to an adult or teen station, you don’t fine the station because the responsibility for THAT rests completely with the parents, not the show creator and not even the station. The issue is that there really are a lot of hugely successful channels like Ryan’s World, and CocoMelon that are clearly targeting kids that were serving targeted ads. RUclips has been extremely irresponsible by not just creating a FULLY RUclips kids site that parents can sign their kids up for, and now all of us are in the line of Fire. On the back end, on the part of creators, we only see stats from viewers 13 and up. We have NO IDEA if kids under 13 are watching our content. On the back end, we looked at our moms ad account and there is actually no way for an ADVERTISER to specifically advertise to anyone under 18. The advertiser can specify that the person has preferences. They can also target specific videos, or channels, but THEY ABSOLUTELY CANT target under 18 specifically. The only solution to this is stripping children’s content out of RUclips and moving it to a new platform just for kids. And then, there is AMAZON PRIME. We are not sure HOW this works yet but we are considering it as an option for us, although our content is intended for teens (actually stats show it is mostly watched by 18-24 year old females which is weird). We rally would prefer to stay here but if things get super crazy we have to have options in mind. AMAZON Prime would be an IDEAL place for kids content to RE-UPLOAD like CocoMelon and especially Ryan’s World because they can more easily integrate into a selling platform for toys and games. Either way, content CLEARLY made FOR KIDS needs to go! This would not be happening if it were not for those clearly kids channels. We mean CLEARLY and absolutely like ABC Channels.

FTCvideos Why did you pick 13 out of all ages for COPPA. I genuinely believe the age should be lowered to 11 because that’s when adolescence kicks in and kids start to get more mature. At the age of 11 and 12 information from children do get collected because there in middle schools and use email on chromebooks . As a regular RUclips viewer, I believe the current implementation of COPPA rules will severely hurt content creators and content on the platform. I regularly watch content creators who have raised concerns over the current COPPA rules and I believe their ability to monetize and create content on RUclips while also supporting themselves financially is at stake here. RUclips is nothing without its creators and without them being able to support themselves and their businesses on the platform, RUclips will indeed become a "desert of crap". I urge you and the fellow FTC members to reconsider the current COPPA laws and change them to suit the needs of the modern world today.

In fact the FTC said that if a child lies about their age (example an 11 year old saying they're 13 by making an account) then there's no fault on the website. The problem here is RUclips allows people to use it signed out. Signed out they don't get you agreeing to terms which state your 13+ so watching signed out they assume your 12 or younger and THAT'S the issue.
RUclips could fix this all by making people make an account to watch, but won't because it cuts into their profit.

The free RUclips Kids app is a better solution than regulation targeting family-friendly creators. RUclips Kids removes privacy concerns around personalized ads. Parents buy devices and allow their children to watch RUclips Main. Many parents prefer to use RUclips Main because it has more features and less barriers. Creators should not be punished when parents choose not to use RUclips Kids. COPPA is about putting parents in control of protecting their children’s personal information online. The FTC should not use COPPA to remove parents from the process in regulating content and online advertising.
While large corporations will survive these changes, small business creators face terminating employees, changing their business model, or shutting down production altogether. These regulations will particularly hurt young underserved audiences who participate in RUclips communities on topics like special needs, faith, and minority groups. Limiting quality free content for kids expands the digital divide. Turning off personalized ads on kids’ content also encourages increased product placement and brand deals within kids’ content.
Creators face COPPA fines up to $42,530 per video, yet the regulation and definition of “child-directed” is vague. The FTC needs to provide creators with enforcement clarity.
We ask the FTC to:
1. Provide an enforcement statement for creators
2. Clarify the definition of “child-directed,” and not expand it to cover “child-attractive” content
3. Delay enforcement against creators until the FTC concludes its review of COPPA
4. Allow parents to use RUclips Kids or RUclips Main, without forcing creators to turn off personalized ads when parents choose to use RUclips Main

These revised rules, while they have good intention, will do more harm than good.
The categorization of "children's content' is extremely vague. By enforcing COPPA is such a way on RUclips, many content creators will be encouraged to either cease making content, or to convert their content to something more mature. For those who do comply with COPPA when creating kids' content, this can disrupt entire livelihoods, as well as forcing them to alter their entire business structure. If certain creators are fined, as the FTC claims they will, it can destroy entire lives. The huge issue is that it doesn't matter if you perceive your content to not be directed towards kids, because ultimately the final decision on whether or not you are compliant lies in the hands of someone who may not watch the entire video, goes only off of the title and thumbnail, and may not understand pop-culture and the vast interests of young adults. Many content creators who do not intentionally direct their content towards kids, yet still attract such an audience, will be impacted.
Ultimately, this fear of not being COPPA compliant will encourage the creation of less kids' content because there is no monetary advantage in doing so. With less and less children's content available, kids will be exposed to more and more mature content. Ultimately, kids will always find a way on to the platform.
Another issue is that vast amounts of children watch creators such as Jake Paul, and he isn't someone who is necessarily child appropriate in my opinion. Due to the legal definition of kid's content being so vague, if a channel such as his can be considered as directed towards kids, then where will the line be drawn?
While it is true that there are a small handful of channels who do exploit kids using targeted ads, that is an extremely small minority. COPPA unnecessarily puts other channels at risk. In the RUclips terms of service you must be 13 or older to begin with, which is why they have been considered COPPA compliant until now. The issue the FTC fails to understand is that in most cases children are using accounts that are either their parents, or have been set up by their parents, which is a form of implicit agreement to RUclips collecting data on said accounts and issuing targeted ads. This is honestly an issue that has arisen because of the FTC's lack of expose to modern internet culture, and lazy / ignorant parents. If parents want their children to not be subjected to targeted ads on the platform, RUclips provides alternatives such as RUclips RED subscriptions and RUclips Kids. If a child lies about there age to create an account, which would then be subjected to information collection, the blame lies not with the content creators , but with the child for breaking RUclips's terms of service and the parents for not policing their children.
The exploitation of kids does not lie in the blame of Google or RUclips. The FTC is not at fault in this situation either, they are simply doing their jobs, and this situation is due to misinformation. The FTC wants to solve the problem and up until the 11th of December were accepting feedback on the proposed regulations.
In the end, COPPA will only be destructive to RUclips, and several other platforms, in more ways than one. To reiterate, it will only result in the production of less child-suitable content, which would then ultimately expose children to greater amounts of mature content because many utilize parent approved accounts that can view 13+ content to begin with. Furthermore, the monetary impact will be severely damaging to many creators who may or may not have believed themselves to be creating kids content.

The way this is implemented goes against the first amendment by being so broad, you guys need to either be constitutionally compliant or be replaced.
It definitely should be unconstitutional, but not just for that reason. If everyone is required to correctly label whether their videos are for kids or not under threat of government fines, regardless of whether they monetize or run targeted ads or not, that is a form of prior restraint or imposing a requirement in order to exercise free speech. That's also arguably involuntary servitude which is against the 13th amendment, especially if also required for videos that have already been uploaded and published, which is also ex post facto unconstitutional meaning it's retroactively criminalizing something that was done in the past. There's also the fact that the content creators aren't the ones doing the data collecting; that's RUclips. Unless creators specifically consent to benefit from that data such as by agreeing to run targeted ads on their videos, then they have no involvement.

Everyone thought it was too stupid to pass and was worried about the "family friendly" rules/purge at the time.
Reply and tell me if i have any misconceptions included in the details of these ideas:
1. Children should not be considered the same as general audiences, although this may be hard to implement because children will still watch general content.
2. The FTC should allow websites like youtube to handle content “for kids” and “not for kids.” It would make more sense to allow creators to decide if their content is for kids or not, and instead of using a bot to check if they’re “wrong,” allow users under 13 to enter (with permission from an email from parents). Instead of trying to fine creators on vague grounds, don’t recommend “not for kids” videos to kids under 13. I consider this similar to adult-oriented cartoons not being aired on children’s networks.
3. Instead of avoiding recommending videos “for kids” altogether, use a non-personalized recommendation algorithm for those ONLY to avoid collection of data. Separation of “for kids” and “not for kids” is important.
4. If a video is deemed “for kids” run ads targeted at kids in general instead of tracking individual users
5. As an idea for a “general audiences” category of video, it could appear individually in both the children and adult algorithm but treat the user differently based on the age of the account’s user
COPPA ( the Federal Trade Commission ( the F.T.C. ) and the Federal Communications ( CENSORSHIP ) Commission ( the F.C.C. ) does not consider “General Audiences” a valid category!!! With them, it’s either for ADULTS or it’s for KIDS, there is no “General Audiences” ( grey area )!!! Try to list your video as “General Audiences”, and they will fine you $42,000.00 ( I hear they’ve UPPED the amount to something like $42,530.00 now ) for being an obvious pedophile and trying to DECEIVE COPPA!!!

No, but the parent should set the mobile device, not the child. They are the users of the device, but the parents should be the owners to protect them breaking the terms of use of devices due to adding Parental Controls.
Well, websites like ROBLOX usually don’t use the personal information of the users, however, they use age. If you say you’re under 13, there will be multiple restrictions because Children shouldn’t be screaming profanities or watching porn.
13-18 year olds are left out, mainly because they are more mature than Children, therefore, less gullible and vulnerable. However, I would say that they should protected in some form, I.e Disallowing access to pornagraphic sites such as porn hub.

You know that COPPA could ruin the lives of content creators. All they want is to share and interact with people who are interested in them. You could make content creators lose their money, and make them have a hard time to get through. If a child learns things he/she should not be learning at their age then that is the parents fault because they should be more aware and careful on what their child does in the internet. This will deeply affect content creators because they will create what they are forced and have certain limitations. RUclips should promote RUclips Kids more so that parents will know and won't ruin the content of RUclips. I am 13 but I do not agree on this "COPPA".

The only thing that makes any sense would be to see either of these guys create a Patreon or GoFundMe account for RUclipsrs to support that pays the expenses to fight COPPA’s unreasonable definitions of content made for kids under 13.

WE (the creators) don’t track the kids. WE (the creators) don’t knowingly serve children personalised ads. WE (the creators) are not in the home monitoring what the kids under 13 do! One RUclipsr said it well that if a kid is watching a TV show and changes the channel to an adult or teen station, you don’t fine the station because the responsibility for THAT rests completely with the parents, not the show creator and not even the station. The issue is that there really are a lot of hugely successful channels like Ryan’s World, and CocoMelon that are clearly targeting kids that were serving targeted ads. RUclips has been extremely irresponsible by not just creating a FULLY RUclips kids site that parents can sign their kids up for, and now all of us are in the line of Fire.
On the back end, on the part of creators, we only see stats from viewers 13 and up. We have NO IDEA if kids under 13 are watching our content.
On the back end, we looked at our moms ad account and there is actually no way for an ADVERTISER to specifically advertise to anyone under 18. The advertiser can specify that the person has preferences. They can also target specific videos, or channels, but THEY ABSOLUTELY CANT target under 18 specifically.
The only solution to this is stripping children’s content out of RUclips and moving it to a new platform just for kids.
And then, there is AMAZON PRIME.
We are not sure HOW this works yet but we are considering it as an option for us, although our content is intended for teens (actually stats show it is mostly watched by 18-24 year old females which is weird). We rally would prefer to stay here but if things get super crazy we have to have options in mind.
AMAZON Prime would be an IDEAL place for kids content to RE-UPLOAD like CocoMelon and especially Ryan’s World because they can more easily integrate into a selling platform for toys and games. Either way, content CLEARLY made FOR KIDS needs to go! This would not be happening if it were not for those clearly kids channels. We mean CLEARLY and absolutely like ABC Channels.
