Recognizing is the job of our government, but as a Taiwanese, Somaliland is a democratic country to me, probably the best in the horn of Africa. Hopefully I've got the chance to go there someday.

It is ironic that two countries that want recognition the most didn't give it to one another and you've clarified why. I just want to add SL gave up on this small recognition for a bigger one. Maybe it is the beginning of a new policy where SL make similar deals with everyone. Arguably, it is better than what SL has at the moment, but SL is in a very dangerous region where recognition is a security matter in its self.

Ireland has diplomatic relations with Palestine with representative offices though there is no formal recognition. This situation could end up like that. If Taiwan did officially recognise Somaliland, its cause might be taken more seriously by other countries, maybe UN members who still recognise the ROC could then recognise Somaliland.
Yes, it really is an interesting situation in so many ways. When the news broke it seemed that there was a bit of confusion about what exactly had happened. Just the sort of situation I really love to delve into. Overall, the agreement as it appears to be structured makes a lot of sense. I suspect Hargeisa was a little more reluctant than Taipei to push things any further. It will be interesting to see how Beijing reacts, if at all. My sense is that this will fall just ok the right side of the irritation/anger line. With luck, it might force the PRC to take Somaliland a little more seriously. This is going to be a really interesting situation to follow. Anyway, how is everything with you? I hope all is well.

I hope Taiwan becomes extremely wealthy along with Somaliland and that they together can impact the world's economy drastically and demand recognition through their economic powerhouses. Hi James, This is a well-articulated analysis of the new relationship between the two unrecognised states; fully agree with your critics. As you said, there could be a mutual benefit for both states. Somaliland may benefit from economic relations while Taiwan may take advantage of its footprint in Africa. However, my biggest worry is that this relation may affect Somaliland’s quest for international recognition concerning China’s apprehension about these new developments.

Thank you James. You have certainly grounded my expectation in a positive manner. I am of the view that recognition is far over-rated. The Westphalia model of statehood and its 'sovereign' instruments are under threat. On the one hand, Statehood has yet to pay dividends to post-colonial states since gaining independence in the 60ies. While on the other I am yet unable to comprehend the replacement of "sovereign-protection". The gulf between developed and developing countries creates a distortion in perspective. From a developed-world perspective, sovereignty may have been outgrown, as the benefits of membership in regional or the international society offer an attractive expansion of wellbeing. For the developing world, there is as yet no substitute for sovereign instrumental functions to build necessary social trust to embrace concepts such as regionalism or globalism. Observing recent events in Ethiopia, which is both the headquarters of the African Union and key pillar in Horn of Africa integration; dampens the potential for integration. In so far as the United Nations, it's farewell is glimpsed by such acts as, appointing Somalia to a key post in the organization, while awarding Kenya head of the African representation for the security council. United Nations obituary is being written, if the league of nations met their demise in WWII, the United Nations has in post-cold war-conflicts. Without the balance of power that awarded the UN prominence in execution or championing Soft-power models; states and regions take unilateral action without consideration of UN consequence. Operation Linda Nchi 2011, when Kenya Unilaterally decided to invade Somalia, the UN did not so much as flinch, rather it capitulated and accepted an inevitable truth; it was no longer a significant player. I have no affinity for patriarchal delinquency nor do i relish Somaliland's ancient matriarchal folklore, but I am warming up to the ideas of Tickner(2001 ), Strange(1996) and Young(2004). The international fundamental principle should reconsider; Human needs to be free from fear, harm, and anxiety. In some settings, Sovereignty must be preserved as part of delivering such freedom, while those free should have a league of their own to exercise their desire for communion with whoever shares such ideals. It is most infuriating that the UN in its glass towers up in the clouds should posses a FIXED lens on the evolution of statehood or sovereignty. It is most inappropriate that UN wield any power in a singular setting for vastly unequal forms of states or sovereignties. UN shoots itself in the foot when it accepts a failed state unable to deliver the most basic of services to its citizens for 30years, while countries like Taiwan and Somaliland lack any representation or inclusion in global discourse. If the UN does not know it has failed, the international arena is possessed by a ghost institution in need of an exorcism. I do hope when we eventually lay it to rest, what inherits its place is neither patriarchal nor matriarchal dominated. I have no fancy title for it but the equivalent of secular, an epicene international arena. It would be most exciting to give those in need of a level playing field a chance to contribute.

It isn't (officially) recognition because neither territory is a recognized state, but it still matters due to the impact it'll have on both economies.
Morning! I hope you are well. It actually get rather interesting and potentially mind-blowingly confusing. Technically, and traditionally, most international lawyers would say that statehood is not dependent on recognition. A territory is a state if it meets the criteria. In that sense Taiwan and Somaliland are in fact states. And as states exerting sovereignty, they are perfectly entitled to recognise the sovereign independence of any other territory. But we do get into very strange territory when we start to talk about recognition beyond UN members. If a UN member recognises the statehood and sovereignty of a non-UN member, then the legitimacy that confers is clearly significant. But what happens when it then effectively uses part of that legitimacy to recognise another non-UN state? I didn't want to go into the legal complexities of these situations (although I hope to do a video on it at some point).

May I recommend the article "Somaliland's Authoritarian Turn" in the Nov. 2021 issue of International Affairs. The author Claire Elder does a great job making the case that although Somaliland says they are a stable and democratic polity, there are still serious concerns with authoritarianism, corruption, and abuse of civil and human rights. Not least of which includes the jailing of reporters and political candidates, as well as restrictions on political rights such as limiting elections to just three parties and it being illegal to advocate for union with Somalia.
In relation to establishing "Representative Offices", it is also interesting how the post-Soviet de facto states engage in relations with each other. While, (diplomatic) practice seems to amount to the de facto states recognizing each other, foe example, Abkhazia has a "Representative Office" in Transnistria with having an embassy in South Ossetia. mfaapsny.org/ru/foreign-policy/abkhazia/ Similarly South Ossetia has a "Representative Office" in Transnistria, but uses the word Embassy in brackets, as a qualifier. ryuo-pmr.org/kontakti.html I have previously looked at the various agreements between the republics, but was not able to find an adequate answer to the discrepancy. Even some officials failed to sufficiently explain the difference (if there is one in the first place).
Has there been a precedent where two-unrecognised countries sign a treatise of mutual acknowledgment of their De 'Jure pursuit? Is this a means to contravene international laws restricting the recognition of De fact states? Would treatise agreed during De facto status carry over following De 'Jure acquisition? Finally in the decline of the UN could its replacement, re-adust such classifications as De Facto and De'Jure, or the whole process of recognition attainment or loss?
Thanks so much, Ramesh. You are so right! The question of representation between de facto states is so interesting, isn’t it!? It opens up so many theoretical questions on top of the practical dimensions of the situation. Regarding this video, to my mind this agreement between Somaliland and Taiwan is a genuine and serious agreement. They are truly states, albeit with little or no recognition and this is proper interstate relationship. As I see it, it is certainly a lot more legitimate than the agreements between the de facto states in the former Soviet space, where South Ossetia reaches an “agreement” with the “Luhansk Peoples Republic” (which I don’t accept as a de facto state). In any case, I hope all is well with you. It would be really good to have a chat one if these days!
This is a fascinating area. De facto states often have rather strange relationships with each other, for various reasons. In the post-Soviet space they do have various relationships, as Ramesh noted. But a lot if these are sham ties to my mind. In other cases, politics plays a big role. For example, Northern Cyprus would happily create ties with Kosovo, but Kosovo is cautious as it doesn’t want to antagonise its EU supporters. Likewise, it has avoided ties with Taiwan so as not to antagonise Beijing, whose support it needs for eventual UN membership. There seems to be a interesting hierarchy of de facto states. They calculate how valuable their ties are to one another versus the affects it could have elsewhere. All-in-all, it is such an interesting field.
Do Donetsk and Luhansk have any diplomatic relations or recognition? I know they aren’t actually recognized by Russia (neither is Transnistria), but I didn’t know if Russia’s other satellites might have some interaction with them.
Dear James, Indeed there seems to be a hierarchy of diplomatic relations between de facto states. And to me it seems that the choice for recognition of some de facto states by other de facto states is influenced by the relationship the patron state has with the other de facto states. It is quite unlikely that Abkhazia would recognise Kosovo, or N. Cyprus would recognise Artsakh because of the positions of Russia/Turkey. However, that is not always the case, and when asked why SOssetia recognised The Donbass polities and Abkhazia didnt, the narrative among Abkhazians seems to relate that they don't want to engage in premature recognition. That said, I would not go as far and say that all the ties are "sham" but rather each relationship needs to be looked at individually. Relationship between Abkhazia, South Ossetia and Transnistria seem to be definitely genuine and based on diplomatic practices, but in certain other cases it must be explored to see whether the connections are genuine or have an ulterior motive to bypass the international legal system/sanctions etc. Indeed wold be great to have a chat one of these days.

Ireland has diplomatic relations with Palestine with representative offices though there is no formal recognition. This situation could end up like that.
If Taiwan did officially recognise Somaliland, its cause might be taken more seriously by other countries, maybe UN members who still recognise the ROC could then recognise Somaliland.
Yes, it really is an interesting situation in so many ways. When the news broke it seemed that there was a bit of confusion about what exactly had happened. Just the sort of situation I really love to delve into. Overall, the agreement as it appears to be structured makes a lot of sense. I suspect Hargeisa was a little more reluctant than Taipei to push things any further. It will be interesting to see how Beijing reacts, if at all. My sense is that this will fall just ok the right side of the irritation/anger line. With luck, it might force the PRC to take Somaliland a little more seriously. This is going to be a really interesting situation to follow. Anyway, how is everything with you? I hope all is well.

This is a well-articulated analysis of the new relationship between the two unrecognised states; fully agree with your critics. As you said, there could be a mutual benefit for both states. Somaliland may benefit from economic relations while Taiwan may take advantage of its footprint in Africa. However, my biggest worry is that this relation may affect Somaliland’s quest for international recognition concerning China’s apprehension about these new developments.
Thanks so much, Mohamed! I think this is a very serious concern for many. As I mentioned, I think the decision to stop short of formal recognition makes a lot of sense for just this reason. And its hardly as if Beijing was doing anything to help Somaliland in the meantime.

Thank you James. You have certainly grounded my expectation in a positive manner. I am of the view that recognition is far over-rated. The Westphalia model of statehood and its 'sovereign' instruments are under threat. On the one hand, Statehood has yet to pay dividends to post-colonial states since gaining independence in the 60ies. While on the other I am yet unable to comprehend the replacement of "sovereign-protection". The gulf between developed and developing countries creates a distortion in perspective. From a developed-world perspective, sovereignty may have been outgrown, as the benefits of membership in regional or the international society offer an attractive expansion of wellbeing. For the developing world, there is as yet no substitute for sovereign instrumental functions to build necessary social trust to embrace concepts such as regionalism or globalism. Observing recent events in Ethiopia, which is both the headquarters of the African Union and key pillar in Horn of Africa integration; dampens the potential for integration.
In so far as the United Nations, it's farewell is glimpsed by such acts as, appointing Somalia to a key post in the organization, while awarding Kenya head of the African representation for the security council. United Nations obituary is being written, if the league of nations met their demise in WWII, the United Nations has in post-cold war-conflicts. Without the balance of power that awarded the UN prominence in execution or championing Soft-power models; states and regions take unilateral action without consideration of UN consequence. Operation Linda Nchi 2011, when Kenya Unilaterally decided to invade Somalia, the UN did not so much as flinch, rather it capitulated and accepted an inevitable truth; it was no longer a significant player.
I have no affinity for patriarchal delinquency nor do i relish Somaliland's ancient matriarchal folklore, but I am warming up to the ideas of Tickner(2001 ), Strange(1996) and Young(2004). The international fundamental principle should reconsider; Human needs to be free from fear, harm, and anxiety. In some settings, Sovereignty must be preserved as part of delivering such freedom, while those free should have a league of their own to exercise their desire for communion with whoever shares such ideals.
It is most infuriating that the UN in its glass towers up in the clouds should posses a FIXED lens on the evolution of statehood or sovereignty. It is most inappropriate that UN wield any power in a singular setting for vastly unequal forms of states or sovereignties. UN shoots itself in the foot when it accepts a failed state unable to deliver the most basic of services to its citizens for 30years, while countries like Taiwan and Somaliland lack any representation or inclusion in global discourse. If the UN does not know it has failed, the international arena is possessed by a ghost institution in need of an exorcism. I do hope when we eventually lay it to rest, what inherits its place is neither patriarchal nor matriarchal dominated. I have no fancy title for it but the equivalent of secular, an epicene international arena. It would be most exciting to give those in need of a level playing field a chance to contribute.

It isn't (officially) recognition because neither territory is a recognized state, but it still matters due to the impact it'll have on both economies.
Morning! I hope you are well. It actually get rather interesting and potentially mind-blowingly confusing. Technically, and traditionally, most international lawyers would say that statehood is not dependent on recognition. A territory is a state if it meets the criteria. In that sense Taiwan and Somaliland are in fact states. And as states exerting sovereignty, they are perfectly entitled to recognise the sovereign independence of any other territory. But we do get into very strange territory when we start to talk about recognition beyond UN members. If a UN member recognises the statehood and sovereignty of a non-UN member, then the legitimacy that confers is clearly significant. But what happens when it then effectively uses part of that legitimacy to recognise another non-UN state? I didn't want to go into the legal complexities of these situations (although I hope to do a video on it at some point).

May I recommend the article "Somaliland's Authoritarian Turn" in the Nov. 2021 issue of International Affairs. The author Claire Elder does a great job making the case that although Somaliland says they are a stable and democratic polity, there are still serious concerns with authoritarianism, corruption, and abuse of civil and human rights. Not least of which includes the jailing of reporters and political candidates, as well as restrictions on political rights such as limiting elections to just three parties and it being illegal to advocate for union with Somalia.

In relation to establishing "Representative Offices", it is also interesting how the post-Soviet de facto states engage in relations with each other.
While, (diplomatic) practice seems to amount to the de facto states recognizing each other, foe example, Abkhazia has a "Representative Office" in Transnistria with having an embassy in South Ossetia. mfaapsny.org/ru/foreign-policy/abkhazia/

I have previously looked at the various agreements between the republics, but was not able to find an adequate answer to the discrepancy. Even some officials failed to sufficiently explain the difference (if there is one in the first place).
Has there been a precedent where two-unrecognised countries sign a treatise of mutual acknowledgment of their De 'Jure pursuit?
Is this a means to contravene international laws restricting the recognition of De fact states?
Would treatise agreed during De facto status carry over following De 'Jure acquisition?
Finally in the decline of the UN could its replacement, re-adust such classifications as De Facto and De'Jure, or the whole process of recognition attainment or loss?
Thanks so much, Ramesh. You are so right! The question of representation between de facto states is so interesting, isn’t it!? It opens up so many theoretical questions on top of the practical dimensions of the situation. Regarding this video, to my mind this agreement between Somaliland and Taiwan is a genuine and serious agreement. They are truly states, albeit with little or no recognition and this is proper interstate relationship. As I see it, it is certainly a lot more legitimate than the agreements between the de facto states in the former Soviet space, where South Ossetia reaches an “agreement” with the “Luhansk Peoples Republic” (which I don’t accept as a de facto state). In any case, I hope all is well with you. It would be really good to have a chat one if these days!
This is a fascinating area. De facto states often have rather strange relationships with each other, for various reasons. In the post-Soviet space they do have various relationships, as Ramesh noted. But a lot if these are sham ties to my mind. In other cases, politics plays a big role. For example, Northern Cyprus would happily create ties with Kosovo, but Kosovo is cautious as it doesn’t want to antagonise its EU supporters. Likewise, it has avoided ties with Taiwan so as not to antagonise Beijing, whose support it needs for eventual UN membership. There seems to be a interesting hierarchy of de facto states. They calculate how valuable their ties are to one another versus the affects it could have elsewhere. All-in-all, it is such an interesting field.
Do Donetsk and Luhansk have any diplomatic relations or recognition? I know they aren’t actually recognized by Russia (neither is Transnistria), but I didn’t know if Russia’s other satellites might have some interaction with them.

Indeed there seems to be a hierarchy of diplomatic relations between de facto states. And to me it seems that the choice for recognition of some de facto states by other de facto states is influenced by the relationship the patron state has with the other de facto states. It is quite unlikely that Abkhazia would recognise Kosovo, or N. Cyprus would recognise Artsakh because of the positions of Russia/Turkey. However, that is not always the case, and when asked why SOssetia recognised The Donbass polities and Abkhazia didnt, the narrative among Abkhazians seems to relate that they don't want to engage in premature recognition. That said, I would not go as far and say that all the ties are "sham" but rather each relationship needs to be looked at individually. Relationship between Abkhazia, South Ossetia and Transnistria seem to be definitely genuine and based on diplomatic practices, but in certain other cases it must be explored to see whether the connections are genuine or have an ulterior motive to bypass the international legal system/sanctions etc.
