You are only talking about prosecution under article 20 (2) but the word used is prosecuted and punished.A person should be prosecuted and punished previously for taking the benefit of the article 20(2) in subsequent prosecution for same offence for which he is prosecuted and punished which means if a person is prosecuted and not punished in one trial then in subsequent trial if he is prosecuted and punished prohibition of article 20(2) will not apply and there is difference between Article 20(3) and Section 300 explain it if possible. Dont take it otherwise.
