    well even if patent can't protect your idea from been copied, in the least it protects you from been sued for actually using your own idea. the main question is, how valuable a patent lawyer actually is? should you pay 10k for it?

      What I usually do is file a patent for my higher end ideas and then abandon the application. It costs a few hundred dollars this way and then ensures that the information is common knowledge so I am not infringing since I was the one to document the idea in the first place. It saves me from fighting it in court if someone files a similar idea at a later date.

      Invention Therapy what do you mean by file and abandon the application? Just filling provisional for patent pending?

      Max Huggins If I am worried about patent trolls trying to sue me over some bullshit patent they hold, I usually file my own patent covering my specific technology but as time goes on, I may decide to drop the patent process altogether. This is just my approach in that with a related patent application being filed, it would be hard in most cases for them to take legal action unless I have infringed in some way. Infringement is unlikely since I always do extensive patent research during the design process and avoid any potential issues from the start. The trick is always to design around any existing patents which is easy to do in most cases. If I can’t design around the existing patents, I drop the idea altogether.

    This was great information. Thank you! What if I want to file a patent (mainly for the patent search) so that I can ensure myself that I won’t be sued by someone else for my invention?

    Love the information.. made tons of sense. However, what happens start selling my invention and someone decide to make a replica, have it patented then come for my earnings. like a reverse infringement. when I am truly the inventor. The thought of that is scary. so patents somewhat is helpful.

    good greeting For all the teachers Is registering an application for a patent valid for twenty years in the European office better than registering in several offices separately, for example, the registration of the German office, the United Kingdom office, and a French and Dutch office? Therefore, I want to register in the European Office in order to obtain a patent in several European countries together Thanks🙏

    Great video, thank you! I was going to rewatch a video step by step getting a provisional patent. I like your thoughts/experience. I've sat on many great ideas because I couldn't afford to get a patent. I sent one idea into an inventor help company & they ended up stealing my idea when I didn't want to send them ~$1,000 to "get started".

    Hi, there seems to be a lack of or no video teaching about the patenting of a Process. Specifically, I am interested in processes excluding programming. I am not sure what are all the processes that are considered as patentable Pocesses

      You can''t protect the invention without a real non-provisional Utility Patent. There is no such thing as a provisional patent, It is actually called a "Provisional Patent Application" which is just that, a provisional application stating that you intend to file a patent within one year.

    Ok that’s great but what if I sell my invention without a patent and then some guy comes along, patent my invention and then sue me for selling “his” product? Wouldn’t that be a good reason to get the patent first?

    Lets say for instance I want to patent something in the USA and the examiner does an search, do they only search in USA or world wide. If someone already has a patent in lets say France but has no PCT or they haven't filed in USA does this mean my patent will or won't be granted in the USA.
    If for some reason I'm not granted the patent then it will be possible to still manufacture and sell the product in all the other countries where the original patent inventor didn't register in without having any legal ramifications.

    I have an idea for the restaurant industry, without a patent what would stop a company from turning down my product and just making it on their own?

    • @InventionTherapy
      @InventionTherapy  4 года назад

      Nothing but you better get an actual patent and not a provisional application (provisional patent).
      I don’t even know if an idea for a restaurant can be patented. I think that would be more of a trademark issue but ask a lawyer.

    Well.... a Providence Patent "SHOULD" give SOME protection, unless you're saying.... that even though it's a GOVERNMENT ISSUED DOC, any one can still take "THEE EXACT" idea ... and legally use it???

    • @InventionTherapy
      @InventionTherapy  5 лет назад +1

      A provisional “patent” aplication is not a patent in any way. It just gives you a first to file date and then you must complete the non-provisional patent application within twelve months. Much more complicated process than you have been led to believe and the non-provisional application is a sealed document that can not be disclosed to anyone by you and is not reviewed by the patent office until the time of your actual patent filing. If you let the twelve months lapse, your idea is not protected in an way.

      There are too many companies out there taking people’s money and spreading bad information about patents. We all have ideas and unless we implement them, it is unlikely we will ever see any money otherwise.

    So I have a question. Let's say someone made a product that attaches to a vehicle wheel for getting unstuck? They made it from a solid block of rubber and has 2 straps instead of one. There's a utility patent here: patents.google.com/patent/US8807665B2/en that appears to cover anything that helps from getting unstuck. So my qurstion would be, could I or anyone build a block that could attach to a tire to get unstuck with my own unique design? Or has this person somehow got the license to make anything that attaches to a tire with a strap? Super curious what your feedback would be on something like this? Would love to talk to you personally if possible, but thought I would just comment it here :). Thanks! (Not expecting any legal help, just advice and I understand that any reply is not going to be legal advice)

    Hello I have an idea to improve recycling process and can be implemented nationwide if not world wide. It’s a process that would implement existing technology to improve recycling process. Is it logical to try to patent something like this and can it even be patented?
