So that is clearly not a sample, and I don't think it's even an impersonator. So no sampling or right of publicity concerns here. I guess the argument is that by using the hook of the chorus, he has infringed the original composition and "Good (Don't Die)" is effectively a cover of "I Feel Love." I think that's a crappy argument, legally speaking, but post-Blurred Lines, anything is possible.
He went to them and they explicitly turned him down. So he just recorded an almost identical version and rolled the dice. He knew the lawsuit was coming but he did it anyway. This is a black-and-white case of copyright infringement. "Blurred Lines" had a way better case.
This is a more cut-and-dry example than "Blurred Lines" or "My Sweet Lord." The Summer estate turned down the request for a legal sample, so a re-recorded sound-alike was used. Not cool.
