Because there wasn't an initial plagiarism in this case. First of all, the chorus of both songs is based on the sample that has been already used earlier. Secondly, Soyeon wasn't even the main producer of the song, Poptime was. The core problem was in the arragment of the sample which Poptime was responsible for, check the credits.
