Ultimately whether eating and driving will get you a fine is left to the discretion of the LEO stopping you (but the maximum fine is ~1/5th of what you'd get for being on the phone while driving, in any case).
Also, the men of the Polizia Stradale are absolute no-nonsense hardasses and would have likely said, "yeah, that's a funny joke, but I can't tell if you just switched your real phone for a chocolate one, so you are still getting a fine for texting and driving, and good luck convincing the tribunale amministrativo that it was all a prank!".

Dobrze, takie wyśmiewanie durnych przepisów mi się podoba :D
Ten przepis nie jest durny. Wystarczy kupić słuchawkę bluetooth, i można rozmawiać do woli, za to polecam się przejechać po mieście za kimś, kto trzyma telefon przy uchu i jedną reką musi trzymać kierownicę, zmieniać biegi, włączać kierunkowskazy itd. Żółwia prędkość + brak uwagi na to co dzieje się na drodze.
