I never really understood why they kept AFO alive in prison as opposed to executing him ASAP, given that he is such an absolutely massive threat and the highest priority for villains to break out--and the incredibly high likelihood that AFO would find a way to escape on his own if given enough time. At least the theme here is fantastic to help make up for the plot hole.
Unlike people like Moonfish, AFO there is no guarantee they COULD execute him. He might have quirks that stop poisonings, quirks that make him bullet proof, quirks that make him immune to the electric chair. And so much as moving him to other rooms is an opening he can take. Heck if they took the inhumane routes and just opened up his cell at the bottom and tried to kill him by drowning him. Who is to say he can't breathe underwater? AFO has been in custody for MONTHS and they STILL have no idea how many quirks he has. And there is no way All-Might punching off his face made him lose quirks. So he has an accumulation of 200 years worth. Machia is not as strong as his master at peak health. So there's just not any good way to put him down outside OFA. And honestly there are few things you want him to stay away from more. God forbid he finds Eri, Aizawa, some remnants of Twice, or things like Overhaul. He gets any of these quirks and he may as well be COMPLETELY unbeatable. Also AFO could have escaped from All-Might that day, but he didn't. Once the United States of Smash was over, AFO was conscious again minutes later. All-Might was easy pickings as were the cops escorting him. But he went. He got arrested on purpose waiting for this to occur.

Probably because without an official sentence, it would be illegal. The guards discussed in the episode how they’re already being questioned for possibly violating human rights, and they were also being recorded by an outside political group (the Hearts and Minds party). If they did kill him without the death sentence (which the guards also hoped would happen back in season 5, where one of them said they hope he gets sentenced soon), they’d probably be in a lot of trouble.
Having listened to the official version, I’m disappointed and sticking to replaying this. Official version is chopped up, and doesn’t have the full exact theme that played out during this scene for example the slowed down part for Overhauls escape. Thanks for this upload
