A legal analysis of Frank Castle's trial from season 2 episode 7 and 8 of Marvel’s Daredevil. As Vulture eloquently put it: “In the Marvel Cinematic Universe, the “trial of the century” does not concern O.J. Simpson, but Frank Castle. It’s finally time for the Punisher to stand trial, and thanks to just about every imaginable thing going wrong, Nelson and Murdock must defend him against District Attorney Reyes, who has a stacked deck and enough clout to steamroll our favorite tiny firm with ease.”
The trial starts with jury voir dire. For inexplicable reasons the judge is mad at counsel for their inability to find an unbiased jury. Things go off the rails from there. At lot of good procedure, but right off the bat, the judge should have declared a mistrial. Still, fun to talk about reserving opening statements, federal rules of evidence, and expert cross examinations.

I get asked a lot about whether being a practicing attorney is like being a lawyer on TV. I love watching legal movies and courtroom dramas. It's one of the reasons I decided to become a lawyer. But sometimes they make me want to pull my hair out because they are ridiculous.
Today I'm taking a break from representing clients and teaching law students how to kick ass in law school to take on lawyers in the movies and on TV. While all legal movies and shows take dramatic license to make things more interesting (nobody wants to see hundreds of hours of brief writing), many of them have a grain of truth.

I like the idea that when the lawyer asks permission to treat the witness as hostile, he proceeds to punch him in the face when asking questions.

Hostile witness means that your witness has an adverse interest to you and its shown while theyre on the stand. Instead of cooperating with you, they speak and act otherwise. That is why they are hostile.

During this season Matt wasn't a good lawyer, he was distracted with the whole Daredevil and Elektra issue. But on the first season it was waaay better.

@@jensb3946 He's correct. The first season's legal proceedings were much less drama-filled, and mostly straight legal jargon. No speeches on the sickness of the city or anything like that.
@@The_Mold_Wizard I'm not sure Matt had much of a legal defense outside of insanity and jury nullification once the Medical Examiner was cut out of the case and Frank flipped out and admitted, on the stand, to being an unrepentant mass murderer. There was not a lot to work with. Sure Matt was kind of half-assing everything non-Daredevil, but it's not like he had much to go with anyway.

And in Matt's defense as a lawyer, this scene is from the 2nd season, which is basically about Matt's personal life and vigilante life falling apart and him not being able to balance the two. That's why he was late and a bad lawyer, he's usually brilliant in normal circumstances (not talking about the realist lawyer stuff, just his professionalism).
I want Hollywood to make a law movie where an attorney walks into the well, approaches the jury, and gets tackled by a bailiff
Try the first episode of All Rise. You get to see a bailiff tackle not a lawyer, but someone else, in the first scene.

Not going to lie, as a diehard Daredevil fan I'm a little afraid of what the outcome for Matt's lawyering skills is going to be. Especially if only using the Castle case as an example because it's a massive clusterf*ck scenario. There's a scene in The Defenders which I love with Matt tearing a chemical company to bits, I've always wondered how realistic that was.
I agree, I would like to see an analysis of some of Matt's other lawyer-ing parts
Same, this scene wasn't really a fair examination of Matt's abilities seeing as how by this time Castle has taken a deal from Fisk in Prison to sabotage his own case, plus the DA is corrupt and complicit in the murder of Castle's family (if I'm remembering that right). So whether or not Matt is a good lawyer shouldn't be decided by this one case.

@@krismartinez2685 He's saying Murdock is hypocritical. He's a man of the law by day, but a vigilante by night (defies the law to fight criminal activity). The idea is he fights criminals and then puts them to just punishment as a lawyer too, expressing the law is necessary but imperfect so he'll do everything it can't without being immoral.

He is a much better lawyer in the comics. Even there though he tends to step outside professional ethics, but as a superhero operating as a vigilante at all while also being a lawyer, it would not be much of a comic otherwise....

@@gromm93 When acting as a costumed vigilante, at all, is illegal, doing so is considered unprofessional and can get you disbarred irrespective of whether such restrictions are really justifiable and regardless of any and all good you actually do. Just maintaining a secret ID typically involves dishonesty and/or misrepresentation. There are not many individuals in the history of humanity generally let alone among lawyers past and present who have never told any level of lie, ever.
He did eventually win a case in the Supreme Court, though, that established the right of such vigilantes to testify anonymously, which could be seen as legitimizing vigilante activity more generally.

I request that you review the trail of John Healy from season 1 of Daredevil. This showcases Matt's legal skills much better than this episode, which was hampered by conspiracy and Matt's double life.

"there can't possibly be any classified information left"? There absolutely can. He refuses to disclose the objective of the mission, the exact numbers or location, or even the precise date. Telling a lawyer that they had a mission in a general area and faced an unexpected threat is hardly disclosing confidential information. It's similar to the difference between firing an employee because someone saw them doing something they shouldn't have been doing, and saying they're fired because Karen saw them smoking crack behind the dumpster out back. The (dare)devil is in the details.

Doubly so if they are mentally unstable, prone to fits of extreme violence, and are unrepentant.
Well in all fairness before Matt begins his questioning he hears a cop tell Frank, "think about what you want" and it's revealed that Frank sabotaged his defense because the villain from season 1 offered him info on his family's death that he could only get if he was in prison with him

If you're curious about who Clancy Brown is, though, he's the voice of Mr. Krabs on SpongeBob, the voice of Lex Luthor in Superman The Animated Series and Justice League Unlimited, and he played The Kurgan in the first Highlander movie.

Objection: In Foggy’s opening argument, he is stating Castle is a victim of PTSD as a former soldier. You say that opens them up to character assassination. But, Frank Castle has always been characterized as an exceptional Marine. Therefore, any testimony from his colleagues/superiors during his time in service should only be beneficial to his character.
The point is that the DEFENSE bringing in character evidence opens the door for the PROSECUTION to bring in character evidence - which _would_ be wildly detrimental. The defense can't just go around saying, "Our guy is so great!" and then not give the prosecution the opportunity to rebut that assertion. It was a huge point of contention in the Alex Murdaugh trial.
It's doubtful that Frank could get incompetent to proceed due to mental illness.
3:00 "Problem 1: the defendant understood the wrongfulness of his actions." -- you could make a *serious* argument that Frank Castle legitimately did not consider what he was doing to be wrong, particularly given the way he approaches the topic of justice vs. mercy and vigilantism while speaking with a chained-up Daredevil on the roof of an apartment building. His lines about "the stink of the city" and the fury behind his delivery make me think he honestly considered killing these criminals to be the right thing to do.
Even under the Model Penal Code instead of the M'Naghten Rule, the second qualifier for the insanity plea (that the defendant lacked substantial capacity to know that his conduct was wrong), a strong case could still be made.
His moral code was basically broken in war and then shattered when his family died. Everything is black and white to him. You could definitely say that he has multiple personality disorders.

While it may seem the General is disclosing plenty of classified information, he has actually withheld any pertinent details that could compromise national security, such as the precise location of the mission (the Hindu Kush is a very big place), the date and time the mission took place, the target they were sent to observe (or if you've seen The Punisher season 1, you know know they were really sent to kill), and the unit Castle was serving with. Without such details, it would be impossible to distinguish this mission of hundreds if not thousands of others that could have occurred in the region in the past five years alone.
At the same time I didn't feel he needed to tell us that parts were classified. He basically disclosed all facts relevant to the trial
This case was also failed because the kingpin basically owns the police and a police officer said for him to plead guilty to kill someone for Wilson Fisk. So no matter what he would have failed.
Fun fact, the man who wrote the previous run of daredevil comics, Charles Soule, as actually a currently practicing lawyer which is cool.

The trial wasn't on whether he killed people, but about whether killing those people was right.
Trial was more about the severity of the punishment, based on wether the killings were excusable or not
Keep in mind that Mr. Murdock is also a vigilante, and by that point he's already knocked the trial off the rails anyway without objection from the prosecution or the judge.

Those are reference books, you don't typically "read" those as you would a normal book.
I would be interested in seeing your review of the trial in season 1 (I can't remember which episode) from what I can remember it did seem to be perhaps a little more accurate procedurally (at least I don't think Matt has a speech in the middle of direct or cross-examination).

Lawyers and their firms actually provide suits if the defendant doesn’t own one. I don’t know if he ever declined a suit.

The law was different, but trial procedures might be mostly the same. At its bones, To Kill a Mockingbird (at least the second act) is the story of a lawyer who accepts what he knows is a doomed case.
About 15 years ago I had a court case involving 1 DUI, and some traffic stuff (rolling stop, speeding). I was 22-23 and my parents still had to pay for my lawyer. The thing is, my lawyer refused to talk to me. Never returned my calls, would only talk to my parents. Then I got the book thrown at me and damn near got the max. (Good ol boy system is strong here, even stronger then). I know its too late now but did I have any recourse against my lawyer? or the case in general? Side note, I just got done paying a lawyer to expunge that crap (only stuff on my record) and it just so happens she was the district attorney who put me in this position in the first place. Really wish I had done something.

You must know that this is an older timeline . I noticed that when I saw Matt using an antique a$$ phone . I mean, not that a phone with just screen would be good for blind people but you get the point . I think that In this marvel phase the laws and ways to go to trial were a little different. Usually marvel does their homework and makes the movies or in this case series as close to reality as possible just with, well … superhero’s and aliens .

They'll probably just get screwed over. The most notable case of this (that I know of) was for Turing back in the 50s

They hadn't talked with Castle much because they took over the case from the court appointed attorney and the DA was giving them a really hard time with the transfer and rushed the trial so they literally took him on as a client and had to go to court pretty much the next day I think

Objection Your Honor!!! I'm no lawyer, but I've been in enough courtrooms to know that this courtroom skit deserves a C for realism. LOL. I've seen a real Judge get mad at something this fictional judge was tolerating. It could've costed him control of his own courtroom in a real setting.
My biggest issue is that they didn’t actually try to show that Frank wasn’t guilty. They should have had all the evidence the police had gathered and should have been able to find enought holes to create reasonable doubt.
There wasn’t that much evidence that Frank was the killer. Frank engaged his enemies from a distance, mowing then down through walls. The very first group we see on screen that gets wipes out by Frank were shot through the wall. From that, the most evidence they could have is the bullet and casings.
They also should have kept quiet about his family being killed unless the DA planned on bringing it up. By not beinging it up, they could create doubt as to Frank’s motives were in taking out the gangs.
Honestly, with just seeing the scenes of Frank’s crimes, the prosecution doesn’t have substantial evidence. The only time Frank could have been ID’d was during the DA’s bait op to capture Frank, which violated a witness protection contract. From what the show actually shows the viewer, there is not much evidence to convict Frank of that many murders. But, the show and all the characters in it act like they have the knowledge of a viewer and know for sure that Frank committed these crimes.
Frank should have appealed for a new trial due to the incompetence of Nelson and Murdock.
if or when (hopefully) there will be court scenes in the new Daredevil series, it'd be cool for Marvel to contact and ask people like this guy who know how a court works properly to try and get it 100% right
thats how i feel with all kinds of movies and i don't get why they don't. Like medical shows, government, law, military, etc would all be pretty easy to consult an expert but they never seem to
do some jessica jones, like especially season 3, and just on jerry hogarth in general

Yes, I agree with every word of the lawyer. And even in countries that follow the M'Naghten principle, the burden of proof to corroborate legal insanity beyond reasonable doubt lies with the accused and acquittal, in this kind of case, will not be that easy. And the difference between legal insanity and medical insanity is very crucial. Mere medical insanity will not buy acquittal.
P.S, this is only for the countries that follow the M'Naghten rules.
